AND NOW, comes the Plaintiff, The Ohio Casualty Insurance Company, by
its attorneys, METrE, EVANS & WOODSIDE, and files the following Complaint:
1, Plaintiff, the Ohio Casualty Insurance Company, is a corporation registered
to conduct business in Pennsylvania, with offices at 2000 Linglestown Rood, Harrisburg,
Dauphin County, Pennsylvania, 17110.
2. Defendant, George H. Sellers, 1s an adult individual residing at 340 North
Second Street, Wormleysburg, Cumberland County, Pennsylvania, 17043.
3. Defendant, Darlene K. Sellers, is an adult individual residing at 340 North
Second Street, Wormleysburg, Cumberland County, Pennsylvania, 17043,
4. Defendants, George H. Sellers and Darlene K. Sellers, at all times relevant
hereto, conducted a business under the fictitious name George's Outdoor Shop, with an
address of 100 South Front Street, Wormleysburg, Cumberland County, Pennsylvania,
17043.
5. It is believed, and therefore averred, that George'a Outdoor Shop is a
general partnership comprised of Defendant George H. Sellera and Darlene K Sellers.
6. In February, 1984, Defendants signed, sealed and deliverer! as obligors an
Application for Fishing License Bond to the Commonwealth of Pennsylvania,
Pennsylvania Fish Commission, naming Plaintiff as surety and the Commonwealth of
Pennsylvania as obligee. A true and correct copy of Defendants' Application for Fishing
License Bond is attached hereto as Exhibit "A."
7, Pursuant to the express terms and conditions of Defendants' Application for
Fishing License Bond, Defendants agreed to indemnify Plaintiff and hold it harmless from
and against all loss and/or expenses of whatever kind or nature, including attorney fees
arising out of execution of the Bond. See Exhibit. A."
8, Purlluant to said Application for Fishing License Bond, Plaintiff issued, and
Defendants purchased, an annual bond in the amount of Six Thousand ($6,000) Dollars.

9, On or about January 27, 1997, Plaintiff received correspondence from the
Commonwealth of Pennsylvania, Pennsylvania Fish and Boat Commission, requesting
reimbursement in the amount of $4,834.00 for outstanding fishing licenses, trout stamps
and Lake Erie permits that the Defendants sold in 1996, A true and correct copy of this
correspondence and the attached Proof of Loss Statement is attached hereto as Exhibit
MB."
10. Plaintiff has notified the Defendants by letter that the Commonwealth 0:
Pennsylvania has requested reimbursement in the amount of $4,835.00 for delinquent
hunting license fees, and has requested that Defendants promptly remit full payment for
the delinquent fees to the Commonwealth.
11. On or about February 27,1997, Plaintiff made a payment in the amount of
$4,835.00 to the Pennsylvania Fish and Boat Commission, on behalf of the Defendants for
delinquent fishing license and trout stamp fees. A true and correct copy of the Release
and Assignment of Claim, evidencing payment by the Plaintiff in the amount of $4,835 to
the Commonwealth of Pennsylvania, is attached hereto es Exhibit "C."
12. Defendants have breached their contract with Plaintiff by failing and/or
refusing to indemnify and hold harmless Plaintiff for the $4,835.00 forfeited to the
Commonwealth of Pennsylvania, which amount was paid to the Pennsylvania Fish and
Boat Commission by Plaintiff pursuant to the terms and conditions of Defendants' bond
application.

Dear Sir:
On November 28, 1995 we shipped 1996 Pennsylvania Fishing Licenses,
Trout Stamps and Lake Erie Permits to Georges Outdoor Store for sale
through the store. The licensas and stamps were shipped under the
above subject bond.
As of this writing thera are 160 residents @$16.25, 13 non-resident
licensas 1$34.25, 20 senior licenses 1$3.25, 20 7-day tourist licenses
1$29.25, 179 trout stamps 1$5.00, 10 lake erie permits @$3.00 and 15
3-day tourist 1$14.25 which totals a balance of $4,834.00. Account
also has a debit on of $1.00 which gives a total balance owed on the
account of $4,835.00. I am enclosing a statement of Proof-of-Loss.
Under the terms of the bond you have issued to us for the above
principal we ask that you promptl~ remit the above amount that remains
outstanding.
