WHEREAS, KOLLAS AND COSTOPOULOS, of 1104 Femwood Avenue, Camp Hill,
Cumberland County, Pennsylvania, hereinafter referred to as Owner, is about to exedute
contemporaneously herewith, a contract, with NICKEL HOMES, LL.C., for the erection of a
house ancillary to development in a complex known as Westgate Development, Phase III, South
Middleton Township, Cumberland County, Pennsylvania, construction described as follows:
ALL THAT CERTAIN tract or parcel of ground known as and designated as Lot 1 as
shown on the Final Subdivision Plan for Westgate, Phases 3 and 4 recorded in the Office of the
Recorder of Deeds in and for Cumberland County, at Carlisle, Pennsylvania, in Plan Book 81,
Page 15.
NOW, this day of October, 2002, at the time of and immediately before the
execution of the principal contract dated October 24, 2002, and before any authority has been
given by the said Owner, to the said Contractor to commence work on the said building, or
purchase materials for the same in consideration of the making of the said contract with Owner,
and the further consideration of One Dollar and 00/100 ($1.00), to Contractor paid by Owner, it
is agreed that no lien shall be filed against the building by the contractor, or any sub-contractor,
nor by any of the material men or workmen or any other person for any labor, or materials
purchased, or extra labor or materials purchased for the erection of said building, the right to file
such liens being expressly waived.

described as follows, to wit:
Begflufing at a point on the westem riga-of-way line of Westgate Drive at the
line of land now or late of Robert B. Brooks, said poh~t beh~g located the following tt~ree
(3) courses from ~he northern right-of-way line of West Pine Street 1) by a curve to the
left, having a radius of twenty-five feet (R-25.00'), an arc distance oftl~irty-nine and
twenty-seven hundredth feet (,&'L=39.27'); 2) by a curve to the left, having a radius of
one hundred ninety-three and six hundredth feet (R-193.06'), an arc dislance of fifty aald
four hundredth feet (A/L=50.04'); 3) North fourteen degrees, zero minutes, zero seconds
East (N 14° 00' 00" E), a distance of eighty-four and eighty-four hnndredth feet (84.84');
thence from said point of Beginning, by land now or late of Robert B. Brooks North
seventy-six degrees, zero minutes, zero seconds West (N 76° 00' 00" W), a distance of
one hundred twenty-five feet (125.00') to a poim on the line of lm~d now or late of
