OPINION OF THE COURT
HOFFER, J.:
In this opinion, we address both Plaintiff's petition for leave to proceed In
forma pauperis and his complaint which was filed simultaneously. Andy Torres
(Plaintiff) filed his pleadings with the Court on October 9, 1997, In which he alleged

thtl following: Torres Is a state prisoner at the State Correctional Institute at
Allegheny, At all the times set forth In the complaint he was incarcerated at the
State Correctional Institute at Camp Hill, Torres was Issued a flex-toothbrush
which has a head similar to that of a regular toothbrush but the handle consists of
a hollow rubber tube, Torres alleges that using the toothbrush caused him great

psychological anguish because he feared swallowing the toothbrush. Torres flied
a grievance with the grievance coordinator who passed Plaintiff's complaint to D.
Block Unit Manager Auxer (Defendant Auxer), Defendant Auxer told Plaintiff to
continue using the toothbrush. Torres appealed this decision to Superintendent
Kyler (Defendant Kyler) who affirmed Defendant Auxer's decision, Torres alleges
that he swallowed his flex-toothbrush on October 1,19951,
Torres now claims that Defendants were negligent and willful in disregarding
Plaintiff's pleas concerning the flex-toothbrush. Plaintiff has simultaneously flIed
a complaint asking for damages of $200,000 along with a petition for leave to
proceed In forma pauperis, We now deny Plaintiff's petition and dismiss his
accompanying complaint.
Pennsylvania Rules of Civil Procedure govern this case:
If, simultaneous with the commencement of an action..,a
party has filed a petition for leave to proceed in forma
pauperis, the court prior to acting upon the petition, may
dismiss the action..,lf the allegation of poverty Is untrue
or If It Is satisfied that the action..,ls frivolous,
Pa. R. Clv. p, 2400) (1997),
IAlthough we are dismissing this case on the ground that it Is frivolous,
we note that the event Plaintiff complains of occurred on October 1, 1995, yet
Plaintiff waited until October 9, 1997, to file his complaint. It is obvious that
Plaintiff has missed the Statute of limitations on a personal Injury action. ~
42 Pa.C,S.A. ~5524(2). (Actions to recover damages for Injuries to the person
must be commenced within two years,)

The United States Supreme Court has defined a frivolous action as one that
.Iacks an arguable basis either In fact or law,. ~,490 U.S. 319,
109 S. Ct. 1827, 104 L. Ed. 2d 338 (1990).
The Pennsylvania Superior Court has also spoken on this Issue and has held
that:
.[a]n Individual seeking to proceed In forma pauperis,
thus requesting to have court costs paid from funds
provided to the Commonwealth by Its taxpayers, has a
responsibility to present a valid cause of action, To hold
otherwise would violate Rule 2400) and would display a
blatant disregard for the notion of judicial economy,
Courts should not allow a litigant seeking In forma
pauperis status to use the court's time and the taxpayer's
money to support a frivolous claim,
Conover v, MlkoSkll. 415 Pa, Super, 348, 609 A.2d 558, 560, (1992). The court
additionally advised trial courts to dismiss a plaintiff's claim and specifically state
the dismissal In the order if the court determined the claim to be frivolous. k!.
Because we find Plalntlff's claim to be lacking in both fact and law, we both dismiss
Plaintlff's complaint and deny his petition for leave to file In forma pauperis,
Plaintiff claims that Defendants are liable for both negligence and Intentional
torts, The court finds both of these claims to be frivolous, For a claim of
negligence there must be a duty and a breach thereof, P,L.E., Chap. 1, ~2 (1960),
.Negllgence can also be defined as a lack or want of the due care which a

reasonable man would exercise under the r.:lrcumstances,. 1d. at ~1.
In the case at bar, we find no factual allegations which show the Defendants
to have breached any duty to the Plaintiff. There Is no Inherent danger In a
toothbrush, A box of Tide, commonly used by a housewife, does have an Inherent
danger; the manufacturer puts a label on the box telling you to keep It away from
children, and not to swallow It. A toothbrush requires no such label. That same
housewife, as a mother, teaches her child how to brush the teeth at two years old,
or younger, and the child, however reluctantly, does It without danger,
If used properly by Plaintiff himself, the toothbrush would have caused him
no problem, If it caused Plaintiff a problem, that was of the Plaintiffs own making.
Plaintiff also makes the claim that Defendants committed an Intentional tort
by requiring Plaintiff to use the flex-toothbrush, The rule for liability In an
Intentional tort requires the Defendants' conduct to be culpable and not justifiable
under the circumstances, Smith v, Griffiths, 327 Pa. Super, 418, 476 A.2d 22, 25
(1984).
The Court finds the Defendants' conduct to be neither culpable nor
unjustifiable, We see no hazard In the flex-toothbrush and the Defendants were
not acting maliciously In offering it to Torres, Based upon this reasoning, we find
Plaintiffs complaint to have no basis In either fact or law.
