PRELIMINARY OBJECTIONS
AND NOW, this 12th day of November 1997, comes
Susquehanna Orthopedic Associates, above-named Plaintiff, by and
through its attorney, Richard E. Guida, Esquire, and respectfully
avers the following:
Denied that Plaintiff's Complaint does not state a
cause of action upon which relief can be granted. On the
contrary, section 4102 of Title 23 of the Pennsylvania
Consolidated Statutes provides that it is lawful for a creditor
to institute suit against husband and wife for the price of
necessaries contracted for by either spouse.
WHEREFORE, Plaintiff respectfully requests that Defendant's
Preliminary Objections be denied.

AND NOW, this =- I day of October 1997 comes
Susquehanna Orthopedic Associates, above-named plaintiff, by and
through its attorney, Richard E. GUida, Esquire, and respectfully
avers the following:
1. Plaintiff is Susquehanna Orthopedic Associates,
located at 460 Powers Avenue, Suite 101, Harrisburg, PA 17109.
2. Defendant is Tina Kemper, residing at 31 North
Humer Street, Enola, PA 17025.
3. Defendant's husband, Robert Kemper, received
medical services from Plaintiff resulting in a debt contracted
for necessaries. Exhibit A.
4. Since Defendant was married to Robert Kemper at
the time of the services and continues to be married to him,
Defendant is responsible for payment of the services along with
her husband. 23 Pa.C.S. seotion 4102.
4. On Deoember 20, 1993, Defendant made a payment for
the servioes.
4. Since then, Defendant has failed to pay Plaintiff
the remaining balance for the above-mentioned services whioh were
billed at a fair and reasonable rate.
WHEREFORE, Plaintiff respectfully requests that
judgment be entered in favor of Plaintiff and against Defendants
in the amount of $6895.00 plus interest and costs of the
proceedings.

MOTION TO ADD DEFENDANT
AND NOW, this 9 day of September 1998 comes
Cumberland Waste Service:-Inc. above-named plaintiff, by and
through its attorney, Richard E. Guida, Esquire, and respectfully
avers the following:
1. On July 29, 1997, Plaintiff filed a civil
complaint in District Court 9-1-02 indexed at CV-0000283-97
against Robert Kemper and Tina Kemper, husband and wife.
2. Plaintiff sought payment for medical services that
it provided to Defendants.
3. On October 3, 1997, the district justice entered
judgment in favor of Plaintiff and against Robert Kemper in the
amount of $6,895.00. Exhibit A.
4. In disregard of 23 Pa.C.S. 4102 (proceedings in
case of debts contracted for necessaries), the district justice
did not enter judgment in favor of Plaintiff against Defendant
Tina Kemper.
5. Plaintiff appealed the case against Tina Kemper to
the Cumberland County Court of Common Pleas.
6. On July 20, 1998, Plaintiff obtained an
arbitration award against Tina Kemper in the amount of $6,895.00.

7. On September 2, 1998, the Prothonotary entered
judgment in favor of Plaintiff and against Tina Kemper in the
amount of $6,895.00. Exhibit C.
8. Plaintiff seeks to have Robert Kemper's name added
to the judgment so that only one writ of execution is needed.
WHEREFORE, Plaintiff respectfully requests that Robert
Kemper be added as a defendant on the judgment indexed at 97-
5574.
