1. The Plaintiff is Christine Wiser, residing at 200
MeLand Road, Mt. Holly Springs, Cumberland County, Pennsylvania
l7065.
2. The nefendant is Dean Bear, residing at 43l South Pitt
Street, Carlisle, Cumberland County, Pennsylvania 17055.
3. Plaintiff seeks custody of Heather Bear, born January
21, 1996 and who currently resides with Plaintiff at Plaintiff's
residence.
The child was born out of wedlock.
The child is presently in the custody of Christine Wiser,
the Plaintiff herein.
Since the child's birth, she has resided at 200 MeLand Road,
Mt. Holly Springs, PA, with Plaintiff and Defendant.

moved out of the residence in August of 1997.
Plaintiff is the mother of the child and she is single.
Defendant is the father of the child and he is single.
4. Plaintiff has not participated as a party or witness,
or in another capacity, in other litigation concerning the
custody of this child in this or any other court.
Plaintiff has no information of a custody proceeding
concerning the child pending in a court of this Commonwealth.
Plaintiff does not know of a person not a party to the
proceedings who has physical custody of the child or claims to
have custody or visitation rights with respect to the child.
5. The best interest and permanent welfare of the child
will be served by granting the relief requested because:
a. The child has resided continuously wi th the
Plaintiff since the child's birth and the Plaintiff has
provided for all the child's needs; and
b. The Plaintiff has demonstrated that she will
provide the nurturing and care that this child will
need to grow and be healthy spiritually, physically and
emotionally.
6. Each parent whose parental rights to the child have not
been terminated and the person who has physical custody of the
child have been named as parties to this action.
WHEREFORE, Plaintiff requests the Court to grant custody of
the child to Plaintiff.

PETITION FOR A CONCILIATION HEARING
AND NOW, comes the Petitioner, Dean Bear, by and through
his attorneys, Saidis, Shuff & Masland and respectfully avers
the following:
1, Petitioner is Dean Bear an adult individual residing
at 1133 A Harrisburg Pike, Carlisle, Pennsylvania,
2, The Respondent is Christine Wiser an adult individual
residing at 200 MeLand Road, Mt. Holly Springs,
Pennsylvania.
3, The parties are the natural parents of Heather Bear
born January 21, 1996.
4, On or about November 11, 1997, the parties entered
into a stipulated custody agreement, whereby they
shared physical custody of the child on an
alternating week basis; a copy of said Stipulation is
attached hereto and made a part hereof and marked
Exhibit "A".
5. Since that time, the parcies had at one point
reconciled, and the minor child resided with both
parties,
6, Circumstances have now changed in that the week to
week custody arrangement will not work, as the
Respondent does not have any suitable housing for the
child at this point,
WHEREFORE, the petitioner respectfully requests Your
Honorable Court to enter a Custody Order giving him primary
physical custody of the minor child, subject to periods of
partial physical custody in the Respondent once she resides in
suitable housing for the child,

1, The Petitioner is Dean L, Bear, an adult individual

6, This physical custody schedule will begin with
Respondent receiving the first period of custody beginning

7. The parties also agree that the non-custodial parent
will have a period of visitation on the Wednesday of the other
party's week, from after work until Thursday morning,
8, The parties further agree that should Respondent have
off from work on Fridays, she may have custody of the child.
9. The parties further agree that provided the shared
physical arrangement is still in effect, Petitioner will be
responsible for paying babysitting costs, to a babysitter as
mutually agreed upon by the parties,
10. The parties will share physical custody of the child
each' Thanksgiving and Christmas, with times of exchange to be
by mutual agreement.
11, The parties will alternate physical custody of the
child<Jn New Years Day, Easter, Memorial Day, Fourth of July,
and Labor Day, with petitioner having New Years Day 1998,
12, The parties desire that this be evidenced by Order of
Court,
13. This Court shall retain jurisdiction in this matter.

l. The pertinent information concerning the Child who is the subject
of this litigation is as follows:

2. A conciliation Conference was held on February l5, 2000, with the
following individuals in attendance: The Father, Dean Bear, with his
counsel, Johnna J. Deily, Esquire, and the Mother, Christine \~iser, who
appeared at the Conference without counsel, although she indicated that she
is represented by R. Mark TholMs, Esquire.
3. Pursuant to a Stipulation entered into by the parties and made an
order of Court on December l7, 1997, the parties have been sharing physical
custody on an alternating weekly basis. The Father filed this Petition for
Modification and seeks primary physical custody of the Child. The parties
were unable to even discuss the custody arrangements in a civil manner let
alone reach an agreement on any of the issues. It will be necessary to
schedule a Hearing.
4. The Father's position on custody is as follows: The Father
expressed concern that the Mother was living in a motel at the time of the
filing of this Petition, has no car or employment and may soon be evicted
from her current apartment. The Father claimed that the Mother frequently
leaves the Child with a babysitter so that she can go out with her friends.
The Father believes that he can provide a more stable environment for the
Child.
5. The Mother's position on custody is as follows: The Mother stated
that she was living in an efficiency room at the time of the filing of this
Petition and that if she is evicted from her current apartment it is due to
the Father's conduct. The Mother denied that she leaves the Child to go
out at night and argued that the Father goes out much more frequently than
she does. The ~Iother stated that she is currently trying to find a job and
obtain a car although she is able to obtain transportation whenever
necessary. The Mother believes the parties should continue to share having
physical custody of the Child on an alternating weekly basis.
6. Due to serious COllIllunication problems between the parties at the
Conference, the conciliator strongly recoomended that the parties obtain
counseling to establish the minimum amount of corrmunication necessary to
maintain a custody schedule. The possibility of a custody evaluation was
also discussed at the Conference, however, the Mother indicated that she is
not able to contribute toward the cost at this time.

consideration of the attached Custody Conciliation Report, it is ord red and dIrected as follows:
1. All prior Custody Orders of this Court are vacated and replaced with this Order.
2. The Mother, Christine Wiser, and the Father, Dean Bear, shall have shared legal custody of
Heather Bear, born January 21, 1996. Each parent shall have an equal right, to be exercised jointly
with the other parent, to make all major non-emergency decisions affecting the Child's general well-
being including, but not limited to, all decisions regarding her health. education and religion. Pursuant
to the terms of this paragraph each parent shall be entitled to all records and information pertaining to
the Child including, but not limited to, school and medical records and information.
3. The Father shall have primary physical custody of the Child,
4. The Mother shall have partial physical custody of the Child on alternating weekends from
9:00 a.m. until 5:00 p.m. on both Saturday and Sunday, beginning Saturday, September 7, 2002. In
addition, the Mother shall have custody every Wednesday, beginning September 4, 2002, from 4:00
p.rn, until 8:00 p.m. During the Mother's Wednesday periods of custody, she shall ensure that the
Child completes her homework and has been bathed when there is school the following morning.
5. The parties shall share having custody of the Child each year on Thanksgiving and
Christmas. with the specific times for exchange to be arranged by mutual agreement. The ~arties shall
alternate having custody of the Child en New Years Day, Easter, Memorial Day, July 4' and Labor
Day each year, beginning with the Mother having custody on Labor Day in 2002. The alternating
holiday periods of custody shall run from 9:00 a.m. until 5:00 p.m. on the holiday unless otherwise
agreed between the parties.
6. The Mother shall be responsible to provide all transportation for exchanges of custody to
and from the Fathcr's residellce or the babysitter's residence. unless othcrwise arranged by agreement
of the parties.
