Whereas, on the 15th of Octooor an Agreement was entared
into bet'..,een Subway ^uto Body hereinafter called,
Owner, and the above contracting firm, hereinafter called Contractor,
wherein and whereby said Contractor undertook and agreed to
Construct a 40' x 60' x 14'-6" rretal huilding (Paint Building)
upon the property
said Owner, located at 1231 Ri tner Highway
NOW, therefore, this ,ag:oeeme:1t wit:1esseth, that the said Contrac tor
for and in consideration of the sum of One Dollar ($1,00) to him in
hand p'a.id by the said Owner, receipt ...,hereof is hereby acknowledged,
for himself, ~~d h.is sub-contractors, and all parties acting through
or under h.im, covenants and a~ees that no mechanics liens or claims
shall be filed or mai:1tained by hi~, them or any of them against
the said building and the lot of ground appurtenant thereto, for
or on account of any wor~ done or materials furnished by hi~, them,
or any of them under said contract, or otherwise, for, towards, in
and about the erection and construction of said bUilding, ~~d the
said Contractcr, for himsel~ ~~d his sub-contractors, and others under
him, hereb:r express ly 'o'/'ai'les and relinq).lishes the right to ha're, file
or maintain any mechanics liens or claims against the said building
and ag:oees that this agreeme:1t waiving the right of lien shall be an
Independent ~ovenant.
