There lIlust be strict compliance with Pa,R.C.P, 237,1.
A wriiten notice of intention to file II praecipe must
be ghen in accordance with the rule before the entry
of a default judglllent. The exception to this is wbere
both parties enter into a written agreellll!nt as described
in Rule 237.1.(a). The glvinp of written notice of
intent to file preacipe is nn F~ PARTE IIlBtter and
requires no action by opposing counsel, However, if
the party seeking to enter a default judgaent elects
to refrain from the giving of a written notice, then
on agrel!lllent. between the part iea IDUst be entered and
this requlreR 0 I18nifestation of mutual assent to the
teras of the agreement, This is the IIlOre difficult
route to follow than the giving of notice in accordance
with the form set forth in Pa.R.C.P. 237,l.(c) as the

this Court to open the default judgment entered on, 1/23/98, and

1. Plaintiff commenced this action on 12/5/97, by complaint
in order to recover damages in the amount of $32,136,89. A copy
of plaintiff's complaint is attached as Exhibit "A".
2 . On or about 12/5/97. the complaint with notice to defend
was mailed to the Defendant. Said complaint and notice were mailed

to Tioga County Prison, the Defendant was no longer at that address
and subsenquently said notice was not recieved.
