A review of ::1e record will reveal that Mr, Stott was given great latitude with regard to his theory of a conspiracy. Admittedly, we did not permit him to reliligate every aspcct of the divorce case nor did we permit cumulative testimony. Next, the defendant contends that the jury should have found that he suffered from a diminished mental capacity at the time of the shooting and that he was therefore unable to fonn the specine intent to kill rcquired to support a verdict of murder in the nrst degree, It is true that a diminished capacity delense serves to mitigate lirst, degree murder to third-degree murder by allowing a linding that the delendant lacked the specific intent to kill at the time of the crime, Com, v.
