COMPLAINT
1.
Plaintiffs ELI D. DIVEN and NICOLE R. DONATO are adult
individuals who reside, respectively, at 260 Centervllle Road,
Newville, Cumberland County, Pennsylvania 17241, and 329 Juniper
street, Carlisle, Cumberland County, Pennsylvania 17013.
2.
Defendant ROBERT L. STOTT is an adult individual who resides
at the Cumberland County Prison, 1101 Claremont Road, Carlisle,
Cumberland County, Pennsylvania 17013.
3.
On July 31, 1997, Defendant shot Jimmy K. Diven, Jr. ~o
death.
4 .
Plaintiffs are the only children and sole testamentary
under the Last Will and Testament of the said Jimmy K. Diven"
Jr., Deceased, dated February 25, 1987.
(d) Deceden~s loss of enjoyment of life,
and
(e) punitive damages for Defendant's violent
termination of decedent's life.
WHEREFORE, Plaintiffs demand judgment against Defendant in
an amount in excess of $25,000 plus costs and interest.
COUNT II
WRONGFUL DEATH ACTION
10.
The averments of Paragraphs 1 through 6 above inclusive are
incorporated herein by reference as though fully set forth.

plaintiffs bring this action pursuant to the provisions of
42 Pa.C.S. 58301.

The decedent did not bring an action for personal injur!es
during his lifetime, and no other action for the death of the
decedent has been commenced against Defendant.
13.
As a direct and proximate result of the aforesaid violent'
conduct of Defendant, Defendant is liable for the follow!ng
damages:
(a) Medical expenses of the decedent from

(left atrium, pulmonary artery, transection of right pulmonary vein); right lung; intercostal
muscle between right posterior ribs 10-11 with fracture of 11; muscle, subcutaneous tissue
and skin of right lateral back
II, Toxicology: negative
OPINION:
After review of the history and complete autopsy on the body of Mr. Jimmy Diven, Jr.. death is attributed
to a gunshot wound of the chest. For further comments please see "OPINION" section at the end of the

Injuries present arc rclat~~~'~, pert<lrating (i.e. through-and-through) gunshot wound of the
chest. The approximatel:11on of the enll"llnce and exit sites arc depicted on the accompnnying
diagram. For the exact local Ion and appearance on the decedent's hody, please refer to uutopsy
photographs.
ENTRANCE: The entrance is located on the left anwior upper chest, 53 1/2 in. above the level of the
left heel, 3 1/2 in, to the lell ofl11idline, und" 1/2 in. ubove the nipple. The wound is
round, with a diameter of 1/4 in, and a partial abrasion ring extending 1'1'011112-7 o'clock. The abrasion
measures up to 3/16 in. (at the 2 o'clock position) Surrounding skin has no soot or stippling,
EXIT: The exit is located on the right lateral back, at the edge of the back, 44 1/2 in, above the level of
the left heel and 5 1/4 in, to the right of midline, The wound is an irregular laceration measuring
9/16 X 4/I6 in. The edges can be approximated. Copious hlood drains from this wound upon
positioning of the body. There is a large zone ofpalpahle crepitance surrollnding the wound, with
swelling.
DIRECTION: The direction of the gunshot wound i~~\"\l., left to right and down.

COURSE: Skin, subcutaneolls tissue and muscle of the lell anterior upper chest are penetrated. The
bullet lacerates through the pectoralis major muscle and strikes the left 3rd rib at the
midc1avicular line fracturing through it. Fracture fragments project inward, The bullet enters the left
chest, and perforates through the upper lobe of the lef\ lung in an anterior to medial direction. The bullet
then perforates through the pericardial sac and heart. There is a large, irregular 4-cm laceration on the
superior aspect of the left atrium which is associated with a large laceration through the pulmonary
artery. The left atrium has an exit laceration postcriorly, 4 cm, with transection of the right pulmonary
vein. The bullet exits the heart superiorly and posteriorly, perforates again through the pericardial sac,
and then enters the right chest cavity, Here it perforates through the lower lobe of the right lung starting
at the hilum and traveling to the right and downward exiting posterolaterally, Finally, the bullet
perforates through the intercostal muscle between right ribs 10-11 posteriorly, fractu,ing the 11th rib, and
then exits the body through muscle, subcutaneous tissue and skin of the right lateral back,
SEOUELAE: As a result of the gunshot wound thcre has been massive hemorrhage, At the time of the
autopsy, 420 gm of blood remain in the right chest cavity, The left chest contains 470 am
of blood. The blood is both liquid and clotted, There are perforations of the upper lobe of the left lung'
and the lower lobe of the right lung, In addition, the apex of the left lung is contused and there is II brold
area of contusion on the posterior aspect of the lower lobe of the left lung, Both lungs show a terminal
aspiration of blood pattern, and blood lines thc entire Irachea, and coats the tongue. The right posterior'
11th rib is fractured and the left anterior 3rd rib is fraclured, Thc left atrium of the heart is extensively

Range of fire is thus considered to be visually distant.
CLOTHING:
The decedent is wearing the following garments:
o
a tan T-shirt, the arms of which have been cut 011': the label is "Champion", and this logo is
present across the front of the T-shirt; the size is Large; the shirt has been cut down the center as
ifby scissors; the shirt is blood soaked in the back, has clotted blood on the inside of the back; on
the left upper portion of the shirt there is a 1/4-in round hole, corresponding to the gunshot
wound entrance site; grayish apparent bullet wipe is present along a portion of the margin of this
hole; there is a second hole on the back of the shirt, towards thp. right side, corresponding to the
gunshot wound exit site; this hole 1TI<:asures 5/16 in. and the majority of the ~~H1lated blood
clots are in the vicinity of this hole; ~~"(\,i
a pair of "Levis" blue jeans which are appropriately ZiPpe~I.\~\~QlFdQg29 X 30; they are
soaked with blood in the back; in the left front pocket GUIS ~0rlgister receipt dated
7/30/97 for $1.59 and there is also a small black pocket ftO in the right front pocket there are
four pennies; in the left rear pocket there is a blood soakM white handkerchief;

o a pair of white "fruit of the Loom" briefs, size 30-32; they arc worn inside out; they are blood
soaked in the back;
o a pair of hiking style boots which are brown, black and olive green; they are appropriately laced;
the label is "Mighty Tough," size 7 1/2; a small amount of blood is present on the back of the
right shoe; the back of the left shoe also has a smaller amount of possible blood;

The condition of the pericardinl sac and thc heart in relation~Op~~~~y described gunshot wound
has becn noted Epicardial surface is shiny and thcrc are no aMiesions between the epicardial surface and
the pericardial sac. The hC1l11 weighs 290 gm and its chambcrs are dcvoid of blood. Myocardium is a
homogeneous pink throughout and endocardium is frec of mural thrombi, Cardiac valves are thin and
leafY and free of vegetations, There are no intervcntricular scptal dcfccts and foramen ovale is closed.
Great vessels enter and leave the heart in a normallilshion and both coronary ostia are normally
positioned. Serial sectioning of the coronary artcries reveals two small foci in the ReA of very early
atherosclerosis, one of these regions producing 20% narrowing and the other about 10%, The LAD and
circumflex vessels are thin walled and patent.
RESPIRATORY SYSTEM:
The tracheobronchial tree contains abundant blood throughout its entire length, There are no mucosal
defects involving the trachea, The right lung weighs 365 gm and the Icn lung weighs 370 gm.
Lacerations and hemorrhage in relation to the previously described gunshot wound have been noted.
Visceral pleural surfaces are smooth, and have rocal, mild anthracotic staining, Palpation reveals a few
subplcural small calcified granulomas, no larger than 0.5 cm Multiple sections through the lungs show
no mass lesions or palpablc areas of consolidation,

lungs are slightly enlarged. with dark pink-red interiors coasislent with reactive change, Lymph nodes
elsewhere are inconspicuous,
URINARY SYSTEM
Both kidneys are normally situated and have capsules which strip easily to reveal smooth tan shiny
surfaces. The right kidney weighs 100 gm and the left kidney weighs 115 gm. Sections show
parenchymal pallor with preserved cortlcomedullary demarcations and unremarkable pyramids, Both
ureters are intact and pursue their usual course to the urinary bladder without obstruction or dilatation.
The urinary bladder holds IS ml of yellow urine Bladder mucosa is gray-white and free of lesions,
REPRODUCTIVE SYSTEM
Prostate gland is usual size for age without nodules or masses.
ENDOCRrNESYSTEM.
The thyroid gland has a spherical 2 X 1 cm encapsulated nodule in the right lobe. Parathyroid glands are
not dissected. Thymus gland is not identified, Both adrenal glands are intact without hemorrh.ge or '
necrosis. Pituitary gland is unremarkable,

third party which even remotcly suggests 1I conspiracy IIgllinst him, What is clear Is that the
delendant hc/icved that there was a conspiracy lInd that the d.:lendant was obsessed with the
notion that his wile was perjuring hersclfin the course of the divorce proceedings and that
various attorneys, including the district attorney, were in league against him. A review of ::1e
record will reveal that Mr, Stott was given great latitude with regard to his theory of a
conspiracy. Admittedly, we did not permit him to reliligate every aspcct of the divorce case nor
did we permit cumulative testimony.
Next, the defendant contends that the jury should have found that he suffered from a
diminished mental capacity at the time of the shooting and that he was therefore unable to fonn
the specine intent to kill rcquired to support a verdict of murder in the nrst degree, It is true that
a diminished capacity delense serves to mitigate lirst,degree murder to third-degree murder by
allowing a linding that the delendant lacked the specific intent to kill at the time of the crime,
