2 The facts snd occurrence hereinafter related took place on or about the
3 middle of July 1997 at one of the plaintiff' a customer's home.

5 Defendant received a check from Plaintiff'" customer, made out to the
6 Plaintiff'. Business (American Ilome Improvement Discounters).

8 Defendant proceeded to his bank and deposited it in his account for his
9 own enjoyment. We do not know the exact nature of hoW he was able to commit
10 and violate a federal law. This will be forthcoming.

12 ~rior to this happening there was absolutely no communications between
13 the Defendant and the Plaintiff. Reason being is that the defendant would not
14 answer his phone when home, would not return numerous messages left on the
15 Defendants answering machine. would not answer his cell phone. Another
16 Businessman also had work for the Defendant, again no return calls.

18 Plaintiff had numerous jobs lined up with the Defendant (approl(.
19 7,000.00) worth. The Plaintiff had several reasons to try to get in touch
20 with the Defendant. I.e. When can we start this job. When is that job g01n'1
21 to be done. I have another job for you, Do you want it? E:tc. However no
22 return calls.
23 Took the check that was made out to the Plaintiff'. bu.iness and drooped
24 out of sight. Still no effort to call the Plaintiff and tell him that the jO~
25 was finally completed.

Defendant awrs that the PlalntilT's Complaint fails to comply with the rules of court as set forth
in Pu. R.C.P. I028(a)(2).
4. This mattcr Involvcs an appcal from a judglllcnt rendcred by a District Justice at
which timc both partics proceedcd Il!lUl: and, as a consequencc, this Court's scope of review of
the District Justicc's judgment is de novo in naturc. As u result, thc PlaintilT's references to the
proceeding before the District Justice in thc COlllplaint reprcsent "impertinent matter" as set forth
in Pa. R.C.P. I028(a)(2).
5. The averments contained in PlulntilT's Complaint violate Pa. R.C.P. 1028(a)(3),
since those averments are insufficiently specific so as to allow the Defendant to prepare 1lO
appropriate responsive pleading.
6. It is believed by the Defendant and, therefore, llverred that the PlaintilT's cause of
action in this matter is predicated upon the alleged breach of an oral contract. However, the
PlaintilT's Complaint is legally insufficient to prove such a cause of action in violation of Pa.
R.C.P. 1028(a)(4).
WHEREFORE, the Defendant respecllully requests that the Court grllOt the Defendant's
preliminary objections llOd dismiss the Plaintiffs Complaint with prejudice.

5. Al all limes material hereto, Plaintiff Moles and Defendant Gainer
transacted business with one another In an arrangement whereby Plaintiff Moles would
acquire customers who desired home alterations and Plaintiff Moles would enler Into
agreements with Defendant Gainer to perform the work at the customer's home.
6. In the middle of June, 1997, Plaintiff Moles obtained a customer named
Michelle Bailey, 680 Soulh 82nd Street, Harrisburg, PA and Moles orally agreed wilh
Defendant Gainer for Gainer to do work at Bailey's home.
7. Defendant Gainer rocelved a check in the amount of $675.00 from the
customer made payable to "American Home Improvement Discounters", and Defendant
Gainer deposited this check into his account and deprived Plaintiff Moles of these
funds.
8. Plaintiff Moles was further forced to hire a substitute contractor to clean
up the construction site after Defendant Gainer failed to complete the job at Bailey's
home, at a cost of $20.00.
9. In or about July, 1997, Gainer orally agreed with Moles to do work at the
home of Charles MOil, Harrisburg, PA, but failed to perform any of said work. As a
result, Moles suffered damages of $736.00 in hiring a replacement contractor.
10. In or about July, 1997, Gainer orally agreed with Moles to do work at the
home of Nancy Swartz, Carlisle, PA, but failed to perform said work. As a result, Moles
suffered damages of $200.00 in hiring a replacement contractor.
11. In or about July, 1997, Gainer orally agreed with Moles to do work at the
home of Michelle Davenport, Harrisburg, PA, but failed to perform said work. As a
