COMPLAINT IN CONrlSSION or JUDGMIHT IN ASSUMPSIT AND NOW, comes the Plaintiff, Kenneth F. Caffrey, Jr., by his attorneys, Ronald D. Butler, p.C., and makes his Complaint as follows. 1. plaintiff, Kenneth F. Caffrey, Jr., is an adult individual with offices at 110 Sport Hill Road, Mechanicsburg, Cumberland County, pennsylvania 17055. 2. Defendant, United Buying Group, Inc., is a corporation existing under the laws of the Commonwealth of Pennsylvania with offices c/o Paul Cline, 250 pennsylvania Avenue, Carlisle, cumberland County, pennsylvania 17013-0186. 3. Plaintiff and Defendant entered into a written lease agreement on May 20, 1988, whereby Plaintiff leased to Defendant 7,852 square feet of warehouse space at 110 Sporting Hill Road, Mechanicsburg. Cumberland County, Pennsylvania. A copy of the original lease agreement duly executed by the Defendant is attached hereto as Exhibit "A" and made a part hereof. 4. The attached judgment has not been assigned. 5. Judgment in assumpsit has not been previously entered on the attached instrument in any jurisdiction. 6. Default has been made by Defendant by virtue of Defendant's failure to pay rent for the period July, 1997 through October, 1997 at $1,963.00 per month, for a total of $7,852.00. Default has also been made by Defendant by virtue of Defendant's failure to pay late charges for the period July, 1997 through October, 1997 in the amount of $920.00. Defendant has also failed to pay as additional rent attorney's collection fees in the amount of $a77.20. The total amount due and owing is $9,649.20. 7. The entire sum is in default and is immediately due and payable. WHEREFORE, Plaintiff demands judgment in assumpsit as authorized by the warranty of attorney appearing in the Lease Agreement for the unpaid rent, late charges, real estate taxes and attorney's collection fees in the total amount of $9,649.20, plus costs of suit.
