This is the date set for a conference with counsel and the parties in the above captioned divorce proceedings, Present in the hearing room are the Plaintiff, Donna K. Sheaffer, and her counsel Michael S. Travis and the Defendant, Todd G, Sheaffer, and his counsel Austin F, Grogan. The action was commenced by the filing of a divorce complaint on October 17, 1997, raising grounds for divorce of irretrievable breakdown of the marriage. Counsel have provided the Master with affidavits of consent and waivers of notice of intention to request entry of divorce decree so that the divorce can be concluded under Section 3301(c) of the Domestic Relations Code, The affidavits and waivers will be filed with the Prothonotary by the Master's office. The complaint also raised the economic claim of equitable distribution, There have been no claims raised for alimony or counsel fees and expenses. After negotiations, the Master has been advised that the parties have reached an agreement with respect to the outstanding economic issue of equitable distribution and an agreement is going to be placed on the record in the presence of the parties. The agreement as placed on the record will be considered the substantive agreement of the parties not subject to any changes or modifications except for correction of typographical errors which may be made during the transcription. After the parties and counsel have had an opportunity to review the draft for typographical errors, they will be asked to sign the agreement affirming the terms of settlement as stated on the record at this time, Even though the agreement is not subsequently signed by the parties and counsel, the parties are bound by the terms of the agreement as stated on the record, After the Master has been provided the final agreement, the Master will prepare an order vacating his appointment and counsel will then be able to file a praecipe transmitting the record to the Court for a final decree in divorce, Mr, Grogan. MR, GROGAN: 1, The parties acknowledge that they are the fee simple owners of real estate located in West Fairview Village of East Pennsboro Township, Pennsylvania, and that the Defendant will be awarded the marital home which constitutes marital property and will be responsible for the first and second mortgages. The Defendant will prepare the deed transferring ownership from husband and wife to husband and will forward that to counsel of record within seven days, The Defendant will indemnify and hold harmless the wife from any obligation to pay the first and second mortgage secured by the marital home. ~he parties acknowledge that the wife filed a Chapter 7 bankruptcy in 1999 and was released from any obligation as a result of her discharge in the bankruptcy. 2, The parties acknowledge that the wife, through her employment with the Commonwealth of Pennsylvania, has retirement funds of approximately $5,040.00 which constitutes marital property and the retirement funds are awarded to wife and the husband relinquishes any right and interest in the marital portion of the retirement funds. 3, The parties are the joint owners of a 19B7 Pontiac Grand AM which is currently in the possession of the husband. The wife possesses the title. The Defendant, by Friday, November 3, 2000, through counsel, will contact the Associates to determine the payoff/redeemed value of the car and then the Defendant will either pay that value and retain the car for his use or return the vehicle to wife who will be free of the lien as a result of the bankruptcy action, 4, The Defendant has a piano in his possession at the marital home and the piano will be returned to wife on November 10, 2000, at 6:00 p,m, Wife will make arrangements to pick up the piano from the marital home. The Defendant will return a vanity plate called Beaver Springs Raceway if it still in his possession, The wife believes the last location was in the garage near a tool box. 5, The parties acknowledge that there was marital debt accrued during the marriage in addition to the first and second mortgages to include a MasterCard, PSECU Visa card, and a Lowes credit card, Husband has assumed responsibility for those debts as a result of the marriage and will hold harmless the wife from any obligation to pay those, It is also noted that these debts were included in wife's bankruptcy petition from which she received a discharge under ehapter 7 of the bankruptcy code, 6. Husband shall retain all of the personal property in the marital home other the piano and the vanity plate already identified in this agreement, 7. Husband shall retain ownership of the 1993 Escort and the Honda 250cc motorcycle, as well as the 1991 Chevrolet Cavalier Z24. B. Except as herein otherwise provided, each party may dispose of his or her property in any way and each party hereby waives and relinquishes any and all rights he or she may now have or hereafter acquire under the present or future ~ laws of any jurisdiction to share in the property or the estate of the other as a result of the marital relationship including without limitation, statutory allowance, widow's allowance, right of intestacy, right to take against the will of the other, and right to act as administrator or executor in the other's estate, Each will at the request of the other execute, acknowledge, and deliver any and all instruments which may be necessary or advisable to carry into effect this mutual waiver a~d relinquishment of all such interest, rights, and claims.
