2000, the parties and counsel having entered into an
agreement and stipulation resolving the economic issues on
October 30, 2000, the date set for a four-party conference,
the agreement and stipulation having been transcribed, and
subsequently signed by the parties and counsel, the
appointment of the Master is vacated, and counsel can
conclude the proceedings by the filing of a praecipe to
transmit the record with the affidavits of consent of the
parties so that a final decree in divorce can be entered.

THE MASTER: Today is Monday, October 30,
2000. This is the date set for a conference with counsel and
the parties in the above captioned divorce proceedings,
Present in the hearing room are the
Plaintiff, Donna K. Sheaffer, and her counsel Michael S.
Travis and the Defendant, Todd G, Sheaffer, and his counsel
Austin F, Grogan.
The action was commenced by the filing of a
divorce complaint on October 17, 1997, raising grounds for
divorce of irretrievable breakdown of the marriage.
Counsel
have provided the Master with affidavits of consent and
waivers of notice of intention to request entry of divorce
decree so that the divorce can be concluded under Section
3301(c) of the Domestic Relations Code, The affidavits and
waivers will be filed with the Prothonotary by the Master's
office.
The complaint also raised the economic claim
of equitable distribution,
There have been no claims raised
for alimony or counsel fees and expenses.
After negotiations, the Master has been
advised that the parties have reached an agreement with
respect to the outstanding economic issue of equitable
distribution and an agreement is going to be placed on the
record in the presence of the parties. The agreement as
placed on the record will be considered the substantive
agreement of the parties not subject to any changes or
modifications except for correction of typographical errors
which may be made during the transcription. After the parties
and counsel have had an opportunity to review the draft for
typographical errors, they will be asked to sign the agreement
affirming the terms of settlement as stated on the record at
this time,
Even though the agreement is not subsequently
signed by the parties and counsel, the parties are bound by
the terms of the agreement as stated on the record,
After the Master has been provided the final
agreement, the Master will prepare an order vacating his
appointment and counsel will then be able to file a praecipe
transmitting the record to the Court for a final decree in
divorce,
Mr, Grogan.
MR, GROGAN:
1, The parties acknowledge that they are the fee simple
owners of real estate located in West Fairview Village of East
Pennsboro Township, Pennsylvania, and that the Defendant will
be awarded the marital home which constitutes marital property
and will be responsible for the first and second mortgages.
The Defendant will prepare the deed transferring ownership
from husband and wife to husband and will forward that to
counsel of record within seven days, The Defendant will
indemnify and hold harmless the wife from any obligation to
pay the first and second mortgage secured by the marital home.
~he parties acknowledge that the wife filed a Chapter 7
bankruptcy in 1999 and was released from any obligation as a
result of her discharge in the bankruptcy.
2, The parties acknowledge that the wife, through her
employment with the Commonwealth of Pennsylvania, has
retirement funds of approximately $5,040.00 which constitutes
marital property and the retirement funds are awarded to wife
and the husband relinquishes any right and interest in the
marital portion of the retirement funds.
3, The parties are the joint owners of a 19B7 Pontiac
Grand AM which is currently in the possession of the husband.
The wife possesses the title. The Defendant, by Friday,
November 3, 2000, through counsel, will contact the Associates
to determine the payoff/redeemed value of the car and then the
Defendant will either pay that value and retain the car for
his use or return the vehicle to wife who will be free of the
lien as a result of the bankruptcy action,
4, The Defendant has a piano in his possession at the
marital home and the piano will be returned to wife on
November 10, 2000, at 6:00 p,m, Wife will make arrangements
to pick up the piano from the marital home. The Defendant
will return a vanity plate called Beaver Springs Raceway if it
still in his possession, The wife believes the last location
was in the garage near a tool box.
5, The parties acknowledge that there was marital debt
accrued during the marriage in addition to the first and
second mortgages to include a MasterCard, PSECU Visa card, and
a Lowes credit card, Husband has assumed responsibility for
those debts as a result of the marriage and will hold harmless
the wife from any obligation to pay those, It is also noted
that these debts were included in wife's bankruptcy petition
from which she received a discharge under ehapter 7 of the
bankruptcy code,
6. Husband shall retain all of the personal property in
the marital home other the piano and the vanity plate already
identified in this agreement,
7. Husband shall retain ownership of the 1993 Escort and
the Honda 250cc motorcycle, as well as the 1991 Chevrolet
Cavalier Z24.
B. Except as herein otherwise provided, each party may
dispose of his or her property in any way and each party
hereby waives and relinquishes any and all rights he or she
may now have or hereafter acquire under the present or future
~
laws of any jurisdiction to share in the property or the
estate of the other as a result of the marital relationship
including without limitation, statutory allowance, widow's
allowance, right of intestacy, right to take against the will
of the other, and right to act as administrator or executor in
the other's estate, Each will at the request of the other
execute, acknowledge, and deliver any and all instruments
which may be necessary or advisable to carry into effect this
mutual waiver a~d relinquishment of all such interest, rights,
and claims.
MR, TRAVIS: Mrs, Sheaffer, you've been
present during the reading of the terms of this agreement; is
that correct'?
I1RS. SHEAFFER: Yes, I have.
MR. TRAVIS: And do you understand that
you're relinquishing any right to alimony, support, or marital
property except that which is specifically provided in the
agreement'?
MRS. SHEAFFER: Yes.
MR, TRAVIS: And you are agreeable with those
terms'?
MRS. SHEAFFER:
Yes, I am,
MR. T~~VIS: And even if the agreement is not
signed today, you understand that you are bound by this
agreement'?
MRS. SHEAFFER: Yes.
MR. GROGAN: Todd, were you present during
the agreement being dictated'?
MR. SHEAFFER: Yes, sir.

MR. GROGAN: Did you understand it?
MR. SHEAFFER: Yes, sir.
MR. GROGAN: Did you agree to it?
MR. SHEAFFER: Yes, sir.
MR, GROGAN: You had some reservations
earlier this morning, are those reservations resolved where
you feel comfortable with this agreement?
MR, SHEAFFER: Yes, sir,
I acknowledge that I have read the above
stipulation and agreement, that I understand the terms of
settlement as set forth herein, and that by signing below I
ratify and affirm the agreement previously made and intend to
bind myself to the settlement as a contract obligating myself
to the terms of settlement and subjecting myself to the
methods and procedures of enforcement which may be imposed by
law and in particular Section 3105 of the Domestic Relations
Code.

I. Plaintiff is Donna K. Sheaffer, who currently resides at613 Geneva Drive,
Apartment 8-35, Mechanicsburg, Cumberland County, Pennsylvania, since August 1997.
2. Defendant is Todd G. Sheaffer, who currently resides at 416 State Slreet, West
Fairview, Cumberland County, Pennsylvania, since July 1995.
3. Plaintiff and Defendant have been bona fide residents in the Commonwealth for at
least six months immediately prcvious to the filing of this Complaint.
4. Plaintiff and Defendant were married on October 6, 1990, al Summerdale,
Pennsylvania.
5. There have been no prior actions of divorce or for annulment bctween lhe parties.
6. The marriage is irretrievably broken.
7. I'laintiffhas been adviscd that counseling is available and that Plaintiff may have
the righl to request thaI :ne court require the parties to participate in counseling.

Dear Mr. Travis and Mr. Grogan:
I am writing in response to Mr. Travis' letter of June 20, 2000,
indicating that the parties have been unable to settle the case.
Consequently, Mr. Travis has asked that (issue a new directive for pre-
trial statements.
On October 17,1997, a divorce complaint was filed raising
grounds for divorce of irretrievable breakdown of the marriage and the
economic claim of equitable distribution. No claims have been raised for
alimony or counsel fees and expenses.
( assume that the parties will sign affidavits of consent or have
been separated for a period in excess of two years. Therefore, I am going
to proceed on the basis that grounds for divorce are not an issue.
In accordance with P.R.C.P. 1920.33(b) I am directing each counsel
to file a pretrial statement on or before Monday, July 24, 2000. Upon
receipt of the pretrial statements, I will immediately schedule a pre-

I received a certification document from Mr, Grogan on February 7,
2000. I was about ready to ask the Court to vacate my appointment but
since I have received a certification from Mr. Grogan that discovery is
complete (I have not heard from attorney Sheaffer), I will conclude that
all discovery matters are resolved and that the case is ready for trial. We
will not consider any discovery issues in the course of my proceeding as
we go forward.
The action was commenced by the filing of a divorce complaint on
October 7, 1997, raising grounds for divorce of irretrievable breakdown of

Ms. Sheaffer has asked that I contact you in an effort 10 bring this case to a conclusion. I
am nol in possession of the entire file in this case, which I have requesled from Ms. Prosser.
Notably, I am absent a copy of the complaint and any pleadings. Equitable distribution rnusl
have been requested in the complaint.
It looks like you Iisled this matter with the divorce master on AuguSI 27, 1999. I do not
believe any further discovery is required. However, before we go through the expense of
preparing an inventory and pretrial stalemenl, it appears that only Ihe following issues remain
outs landing.
Ms. Sheaffer is willing 10 relinquish any right to the marital home. Your client would be
responsible for the mortgage and the loans discussed in your June 7, 1999, letter. Your clienl
may also keep the Pontiac, ifhe wishes to pay the outstanding loan on that vehicle. Otherwise, it
will have to be returned 10 the bank, the loan being in her name, and discharged by bankruptcy.
As an incenlive, Ms. Sheaffer is willing 10 pay the fee for property deed and recordalion of titles.
Lastly, there is a piano of modesl value being stored at the marital residence. My client
would like that as part of the equitable distribution.
