COMPLAINT
NOW COMES the Plaintiff, Barbara E. Woods, by her attorney,
Emily J. l,eader, Esquire, and makes out the following complaint:
1.
Plaintiff, Barbara E. Woods ("Ms. WOods"), is an adult
individual residing at 479 Farm Road, Newville, Pennsylvania
17241, with a mailing address of P.O. Box 237, Carlisle,
Pennsylvania 17013-0237.
2.
Defendant, Hughes Supermarket, Inc., is a Pennsylvania
Corporation with a registered address of 429 East Orange Street,
Shippensburg, PA
17257 and with a place of business located at
12 North Baltimore Street, Mt. Holly Springs, Pennsylvania 17065.

On October 22, 1995, Ms. Woods was shopping at Defendant's
Mt. Holly Springs supermarket on North Baltimore Street. She was
wearing deck shoes and a sweat suit.She picked up some canned goods
and carried them in her arms as she walked up the delicatessan
aisle, planning to pass the meat cases, on her way to the dairy
case. Some distance away from her, facing the meat counter, was a
young man wi th a mop.
There were no warning signs, wet floor
signs, or buckets along her area of travel nor were any visable
from where she was walking to indicate that she was in an area with
a wet floor. Ms. Woods did move to the side of the delicatessen
aisle to avoid the area where the young man was apparently mopping
and in order to pass him. She saw two women who had been walking
ahead of her turn the corner.

As she travelled down the aisle, Ms. Woods I right foot
suddenly slipped back, her left knee hit the floor and was skinned,
her arm with the cans tucked in, causing her to bruise her ribs,
she fell on her right palm, flipped back onto her bottom and hit
the small of her back against the freezer case. Her pants got so
wet from the floor where she fell that she was cold when she went
outside. The young man with the mop turned as she flipped
backwards and asked if she was okay. She replied that she thought
she was, but she could not get up. As she sat for a moment, she
saw that the bucket was sitting around the corner of the meat cases
before some doors, completely out of sight from where she was
walking when she fell on the slippery, wet floor. She turned onto
her knees to get up and the young man walked her partway down the
aisle.

As a result of this fall on Defendant's wet floor, Ms. Woods
suffered injuries including, bruises, cuts, scrapes, left trapezius
strain, bilateral subacromial bursitis and rotator cuff tendinitis,
and mild bilateral carpal tunnel syndrome. She has suffered and
intermittently or chronically continues to suffer pain in her neck,
her back, her tail bone, both shoulders, her right hand and arm.

and she haa suffered headaches and trouble sleeping. She required
medical treatment, anti-inflammatory and pain medication, and
physical therapy.
She continues to suffer from hip, neck and
shoulder pain and from headaches, all related to the injuries she
sustained in this fall.

Between October 23, 1996 and ,Tune 13, 1996. Ms. Woods incurred
the following medical expenses in connection with these injuries
set forth in paragraph five above:
Alexander Spring Rehabilitation Center
Walnut Bottom Radiology
Belvedere Medical Corporation
Hershey Medical Center
Hershey Hospital

and she also incurred some additional medical expenses since that
time as well as expenses for medicine and she expects to incur
additional expenses in the future in connection with this fall on
Defendant's premises.

Ms. Woods is a real estate agent and she was ~nable to work
for several days after this fall. Her injuries interfered with her
ability to work and to earn a living for approximately nine months
after she fell. During the period in question, and as a direct
result of the injuries she sustained on Defendant's premises, she
suffered significant business and financial losses resulting in
lost income in excess of Fifteen Thousand ($l5.000.001 Oollars for
1995 and 1996.

Due to her ongoing pain and her inability, due to her need to
earn a living, to continue to attend physical therapy appointmens
on a sufficiently regular basis to afford her relief from her pain,
Ms. woods researched and installed, in a Pole Darn structure
erected for this purpose, a Sierra Hot Tub with twenty-one jets,
located at strategic areas to treat her lombar area, her mid-back
and her upper back. The Pole Barn cost Nine Thousand Seven Hundred
($9,700.00) Dollars to construct and the hot tub, because it was a
prior year's model, cost Four Thousand Seven Hundred ($4700.00)
Dollars. This was purchased solely due to the injuries Ms. Woods
sustained in her fall at Defendant's premises.

Ms. Woods avers that her the cause of her fall and the
injuries she sustained in the fall on Defendant's premises and her
losses as set forth in paragraphs five through eight above, were a
direct result of Defendant's negligence for causing the floor in a
public area to be wet and slippery; failure to exercise reasonable
care to maintain its premises in a safe condition for its
customers; permitting cleaning operations during hours when the
store was open to the public; failing to warn customers of the wet
condition of the floor; and/or failing to dry the floor to correct
its dangerous condition.
WHEREFORE, plaintiff, Barbara E. Woods, respectfully requests
this Honorable Court enter judgment on her behalf in an amount in

interest from date of filing and costs of suit.

letter of April 26, 1999 rescheduling the arbitration hearing to be held in Attorney Deardorff's
office, If the hearing room in the Old Courthouse should become available by the time of this
arbitration hearing, then we will simply conduct the proceedings at the Old Courthouse, but I am
not presently anticipating such availability. In any event, the s~heduling of this proceeding in
Carlisle would appear to be more convenient to the parties and the witnesses which are

Dear Attorney Dorer:
In response to your letter of April 22, 1999, Defendant plans to present the live testimony
of one witness, Greg Griffie, and will present by deposition the testimony ora physician's assistant,
Nelson R, Ehly. We may also want to present some medical records, depending on the records
presented by the Plaintiff, Copies of these records have already been forwarded to counsel for the
Plaintiff. These would be the records of the treating physician, Dr. Hollen; the physical therapy
records; and the Hershey Medical Center records, So the live testimony from Defendant will only
take perhaps 45 minutes,
With regard to the location of the hearing. we have a conference room which could be used
that morning and accornmodate the parties us well as the arbitration panel. I think you are familiar

Consistent with my several telephone conversations with each of your offices oflate,
enclosed please find Notice of Arbitration Hearing scheduling the arbitration hearing in this matter
for Monday, June 28, 1999 at 9:00 a,m.
Please note that the enclosed Notice tentatjvelv schedules this hearing to be held in my
office insofar as I was unable to secure the usual hearing room in the Old Courthouse as the Court
Administrator's office already had that room calendared for another arbitration proceeding. I
would appreciate it if each of you would contact me and provide me with your preliminary
assessment as to the number of witnesses you intend to present at this hearing, and the projected
length of the time of this hearing, Ifnecessary, we can reconsider amending the enclosed Notice
to a more suitable location for this hearing,
As well, I am amenable to suggestions from either counsel for the parties, or from the
other arbitration panelists, as to an appropriate 10eatiDn for this hearing, I anticipate that my
office would be suitable for a hearing perhaps a few hours in length, with no more than a few
witnesses, If counsel for the parties believes that the hearing will exceed these parameters, than I
