PETITION FOR APPROVAL OF SALE OF BOROUGH PROPERTY
I. Petitioner, Borough of Camp Hill ("Borough"), is a political subdivision
of the Commonwealth of Pennsylvania with offices newly located at 2145 Walnut Street, Camp
Hill, Cumberland County. Pennsylvania.
2. The real property subject of this Petition includes the former Borough
Office Building. located at 220 I Market Street, Camp Hill, and the American Legion Building,
Post 43, located at 22 South Twenty-Second Street, Camp Hill, and as well, the parking lot and
sheds formerly used by the Camp Hill Public Works Department. Said properties are owned by
the Borough of Camp Hill and are more particularly described in Exhibit "A" hereto allached and
hereof made a part.
3. Said properties are totally vacant and are of no current or anticipated use
to the Borough. All Borough facilities have been relocated to other locations.
4, Pursuant to statute, the Borough published an advertisement for bids on the
subject property in The Patriot and the Eveninu News, a newspaper of general circulation, on or
about August 8 and 13, 1996. A tllle and COITeet copy of the proof of advertisement is attached
as Exhibit "B" and hereof made a part.
5. No bids on the property wcrc rcceived, either on thc due date for bids or
therealler.
6, Aller advertising the propcrty with no bids received, the Borough listed the
property for salc with a leading commercial rca1 estate broker.
7. Dcspite strenuous effort on the part of the cOImnercia1 real estate broker,
and the same appearing in thc commercial multi-list publication, thc property remained on the
open market for nine months without any offcrs.
8. Finally, on or about May 26, 1997, aller extensive negotiations with the
Borough, Hugh J.T. Simpson, a professional real estatc investor residing at Mechar.icsburg, PA,
(not affiliated with the listing broker) bid $376,500 for the propcrty, and a contract therefor,
contingent on Court approval, was executed. A true and correct copy of said contract is attached
hereto as Exhibit "C" and hereof made a part.
9. Two real estate appraisers havc opined that the subject property is worth
between $375,000 and $400,000.
10. The negotiated contract, representing the only bid received by the Borough,
incorporates provisions controlling the integrity of the community by providing for timely
approvals and proof of financial responsibility.

II. The aforesaid contract of sale commits the buyer to immediate construction
of at least ten townhouses.
12. In addition to the sales price of the property, the Borough will receive
significant lax benefits and building permit fees from the planned construction of thc propcrty.

13. The Borough Code slates that "no real estate owned by the Borough shall
be sold for a consideration in ellccss of fifteen hundred dollars ($1500) except to thc highcst
bidder after due notice by advertisement for bids or advertisement of a public auction in onc
ncwspaper of general circulation in the borough." 53 P .S. ~ 4620 I.
14. There is no specific provision in the Borough Code for the sale of real
cstate if no bids are received in response to the advertisement for public bids.
15. The said principal buildings, i.e., the former Borough Office Building and
the American Legion Building, require either extensive rehabilitation and/or demolition as a
condition precedent to their utilization, a significant cllpense which cannot be justificd by thc tax
base of thc Borough of Camp Hill.
16. Silting idle and unoccupied, thc said propcrtics arc non-incomc-producing
and will continue to deteriorate, waste, and lose significant value.
17. Acquisition of these properties by a privatc invcstor will immediately rcsult
in placing the same on the tax roles, thereby benefiting not only the Borough, but thc Camp Hill

School District and the County of Cumberland, in addition to rclieving Camp Hill taxpaycrs of

thc ongoing cxpense of maintenance, insurance, utilities, and security.
18. Strict construction of the cited provision of the Borough Code, and absent
this Honorable Court's permission and approval to consummate the proposed sale would result
in the Borough being unable to convey clear title to the property to this or any similar buyer.
WHEREFORE, Petitioner requests this Honorable Court to:
a. conduct a public hearing on the sale of the real estate; and
b. after hearing, approve the sale of the property from the Borough to
the buyer for the amount offered by buyer.
