AND NOW, this 28th day of May, 1996, after
hearing at which the natural mother, Charlene Baker, was present
with her Court-Appointed Counsel, Daniel J. Sodus, Esquire, the
natural father, James B. Wileman, was present with his
court-Appointed counsel, Robert P. MUlderig, Esquire, the
juvenile was represented by Rachel Mensch-Stoltenberc;l, Esquire,
his guardian ad litem, and Cumberland County Children and Youth
Services was represented by Ruby D. Weeks, Esquire, it is found
that John Wileman continues to be a dependent child. lie is
discharged from h!s placement in foster care through Cumberland
County Children and Youth Services. Ills care and custody is
directed to be returned to his mother, Charlene Baker. However,
the Court orders and directs that the father and paternal
grandparents shall have the following periods of partial custody
with John: every other weekend from 6:00 p.m. Friday to 6:00
p.m. Sunday, and the last half, If the summer school vacation.
lie shall return to his mother's :::3re and custody three days
prior to the start of kindergarten in the Big Spring school
District. The parties shall arrange for an exchange of custody
with respect to the child at a point approximately halfway
between the home of the natural father and the home of the
natural mother.

ordered and directed as follows:
1. A hearing is scheduled in Court Room No. _-r- of the
Cumberland County Courthouse on the --:t'. fJ ~ day of

be taken in this case. At this hearing, the Hother, Charlene
H. Baker, shall be the moving party and shall proceed
initially with testimony. The parties themselves, or legal

memorandum setting forth the history of custody in this case,
the issues currently before the Court, a list of witness who
will be called to testify at the hearing and a summary of the
anticipated testimony of each witness. This memorandum shall
be filed at least ten days prior to the hearing date.

CONCILIATION CONFERENCE SUMMARY REPORT
IN ACCORDANCE WITH THE CUMBERLAND COUNTY CIVIL RULE OF PROCEDURE
1915.3-8(b), the undersigned Custody Conciliator submits the
following report'
1. The pertinent information pertaining to the child who is the
subject of this litigation is as follows:
John B. Wileman, born January 26, 1991.
2. A Conciliation Conference was held on December 19, 1997, with
the following individuals in attendance,
The Mother, Charlene M. Baker, and the Maternal Grandmother,
Betty M. Wileman.
3. The child resides wi th the Mother on a primary cllstody basis.
Pursuant to Order of Court of Judge Oler dated May 28, 1996,
the Father and the Paternal Grandparents have temporary
custody on alternating weekends and for one-half of the sununer
months. The Father is disabled and lives with his parents.
4. Mother now petitions the Court to modify the custody
arrangement. Mother suggests tha t the child is not being
properly disciplined when he is with the Father and
Grandparents and that they should have supervised custody
where the Grandparents come to visit the child with the Mother
or some other type of arrangement. Mother also suggests that
the child does not spend a great deal of time with the Father
and Grandparents when the child is in their custody.
5. The Paternal Grandmother vigorously denies these allegation.
She indicates that the child does spend a good deal of time
with them and she does exercise appropriate discipline with
the child.
6. Mother is wi thout counsel and the Defendants are wi thout
counsel. The Conciliator is of the view that the Mother's
allegations are somewhat vague and will not, under normal
circumstance, meri t a change in the custody arrangement.
However, the Mother desires a change and a hearing must be
scheduled.
