AND NOW, thiS~~y of ad. ,1997, upon presentation and consideration of the
within Petition, and upon finding that JOAN MARIE HORNER, a minor, now residing at 141
South 32"" Street, Camp Hill, Cumberland County, Pennsylvania, is in immediate and present
danger of abuse from the Respondent, FRANCIS MAY HORNER. the following Temporary
Order is entered.
Tne Respondent, FRANCIS MAY HORNER, now residing atl41 South 32"" Street,
Camp Hill, Cumberland County, Pennsylvania, is hereby enjoined from physically or verbally
abusing JOAN MARIE HORNER, 0(' placing her in fear of abuse and is ordered to stay away
from Joan Marie Homer, wherever she may reside, The Respondent is hereby notified that if she
goes to or resides in Joan Marie Homer's domicile contrary to this Order, she may be in indirect
criminal contempt which is punishable by a fine not to exceed $ I ,000,00 andlor by a sentence of
up to six months in jail and any other appropriate punishment. Resumption of co-residence on
the part of Joan Marie Homer and Respondent shall not nullify the provisions of the Court Order
directing the Respondent to refrain from abusing Joan Marie Homer.
The Respondent is ordered to refrain from having any contact with the minor including,
but not limited to, restraining the Respondent from harassing or stalking Joan Marie Homer and
from harassing and stalking the Petitioner and her family,
This Order shall remain in effect until a linal order is entered in this case. A hearing shall
be held on this mailer on the~ day of -.AI.~UtJi1l! 1997, at JI J6 P.m. in Courtroom
No, -i.. Cumberland County Courthouse, Carlisle, Pennsylvania.
The Petitioner may proceed in fonna pauperis pending a further order after the hearing.
The Cumberland County Sheriffs office shall allempt to make service at the Petitioner's
request, but service may be accomplished under any applicable rule of Civil Procedure.
The Mechanir.sburg Police Department will be provided with a copy of this Order by
allomeys for Petitioner. This Order shall be enforced by any law enforcement agency where a
violation occurs by arrest for indirect criminal contempt witho:lt warrant upon probable cause
that this Order has been violated, whether or not the violation is committed in the presence of the
police officer, In the event that an arrest is made under this section, the Respondent shall be
taken without unnecessary delay before the court that issued the Order. When that court is
unavailable, the Respondent shall be taken before the appropriate district justice (23 Pa. C,S.A. ~

TO THE HONORABLE, THE JUDGES OF SAID COURT:
AND NOW. this 27th day of October 1997, comes the Petitioner, Robin
Webber, Guardian ad litem on behalf of JOAN MARIE HORNER, a minor, by and through her
allomeys, the Law Finn of Baturin & Baturin, and files this Petition For Protective Order and
respectfully avers as follows:
1. The minor is JOAN MARIE HORNER, bom February 23, 1980, and is currently
residing at 141 South 32nd Street, Camp Hill, Cumberland County, Pennsylvania. Ms, Homer is
currently about five (5) months pregnant.
2, The Petitioner, Guardian ad litem on behalf of Joan Marie Homer, is Robin
Webber, an adult individual, sui juris, residing at 402 West Cresswood Drive, Camp Hill,
Cumberland County, Pennsylvania. Robin Webber is the Natural Mother of Ms. Homer's fiance,
Blair Ralph Howell, III.
3. The Respondent, FRANCES MAY HORNER, is an adult individual, suijuris,
residing at 141 South 32nd Street, Camp Hill. Cumberland County, Pennsylvania.

4, The Respondent is the Natural Mother of Ms, Horner,
5. Since about 1992, the Respondent has altempted to cause and has intentionallYI
knowingly, or recklessly caused bodily injury to Ms, Horner and through a course of conduct has
placed Ms,Horner in reasonable fear of imminent serious bodily injury, and has held her
imprisoned in her home. This has included but is not limited to the following acts of abuse:
a. From 1992 until 1995, Respondent has consistently smacked Ms. Horner,
in her face, hurting her and leaving red hand print marks on her face.
b, From 1992 until 1995, Respondent has consistently pulled Ms. Horner's
hair, causing her pain.
c, During the year of 1997, Respondent on numerous occasions has
threatened to punch Ms. Horner in the face,
d, During the year of 1997, the Respondent, on a daily basis, repeatedly,
walks up close to Ms. Horner's face and yells and screams at her and uses profanities for long
periods of time,
e, During the year of 1997, as the Respondent yells and screams at Ms.
Horner, she consistently raises her hand to Ms, Horner's head as if to smack Ms. Horner, causing
Ms, Horner to fear for her safety.
f. Respondent has on several occasions said to Ms. Horner; "I wish you were
dead" and "The sight of you makes me sick,"
g. The Respondent has told Ms, Horner that she will not take her to any more
doctor appointments and has refused to do so in connection with her pregnancy, Consequently,

Ms, Homer has missed one important amniocentesis appointment with her doctor.
h. The father of Ms. Homer's unborn child has a disease known as
Osteogenesis Imperfecta, which is hereditary. Respondent has on several occasions stated to Ms,
Homer "Why do you want to give birth to a crippled baby?" In addition, Respondent has also on
several occasions stated to Ms, Homer's fiance that she "will do everything to make sure the
baby is not born."
i. Respondent refused to let Ms, Homer attend school for five (5) days in
September, 1997, and kept her imprisoned at home.
j. On October 17, 1997, at about midnight (12:00 a.m.) . the Respondent
woke up Ms, Homer and told her to "pack your stuff and leave" and sent her out on the street in a
rainstonn, but then had the police bring her back.
k. The Respondent forces Ms, Homer to sleep on a mattress, which is not
good for her pregnancy.
6. Due to the Respondent's physical, verbal and emotional abuse, Ms. Homer has
lost weight, which she was told by her doctor was not good for her pregnancy,
7. Due to the physical, verbal and emotional abuse, Ms, Homer is afraid for her
physical safely and the safety of her unborn child. Ms. Homer is always sick, nervous and
scared. In addition, Ms. Homer missed an amniocentesis appointment, which is extremely
important and requested by her physician, for it will help her detect whether or not her unborn
child might have a birth defect, which would help detennine how the baby should be delivered,
Ms, Homer's doctor has infonned her that she should have this amniocentesis perfonned

promptly,
8, Ms, Homer and the Petitioner have attempted to seek help from a district,iustice
and from Children and Youth Services, but to no avail due to Ms, Homer's age and
circumstances.
WHEREFORE, pursuant to the provisions of the "Protection from Abuse Act" of October
7, 1976,23 P.S, ~6101 c1 acq., as amended, the Petitioner, Robin Webber, Guardian ad litem on
behalf of Joan Marie Homer, prays this Honorable Court to grant the following relief:
A, Grant a Temporary Order pursuant to the "Protection From Abuse Act"
\. Requiring the Respondent to refrain from physically and emotionally
abusiug Joan Marie Homer or placing her in fear of abuse,
2, Requiring the Respondent to refrain from having any contact with the Joan
Marie Homer, including, but not limited to, restraining the Respondent from harassing or
stalking Joan Marie Homer, and from harassing the Petitioner and her family,
3. Ordering the Respondent to stay away from the location where Joan Marie
Homer may reside.
4, Ordering the Respondent stay away from any residence Ms. Homer may in
the future establish for herself.
B, Schedule a hearing in accordance with the provisions of the "Protection from
Abuse Act," and, after such hearing, enter an Order to be in effect for a period of one (I) year:

1. A Protection From Abuse Action was tiled and a Temporary
Protective Order was signed on October 27, 1997.
2. A hearing was scheduled tor November 5, 1997.
3. The November 5th hearing was continued and the Temporary
Order was to remain in lull torce and eftect, until such time as
the parties could come to an agreement or until either party
requested another hearing.
4. The parties have come to an agreement. The Protection
From Abuse Action is to be dismissed without prejudice and the
Temporary Order vacated.
5. At the time ot the tiling ot the Protection Action, Joan
Horner was a minor. Therefore, the action was tiled by Robin
Webber as Guardian ad litem on behalf of Joan Horner.
6. Joan Horner is no longer a minor. She has reached the
age ot majority, is married and has a child. There is no further
need for Robin Webber to act as Guardian ad litem.
