Count I
AND NOW come Plaintiffs, by and through their counsel,
Martsolf & Bratton, and represent as follows:
1. Plaintiffs are Gary A. Stock and Susanna Stock, adult
individuals residing at 12 Appaloosa Way, Carlisle, Cumberland
County, Pennsylvania 17013.
2. Defendant is The Sherwin-Williams Company, an Ohio
corporation with a registered agent within the Commonwealth of
Pennsylvania c/o CT Corporation System, 1635 Market Street,
Philadelphia, Pennsylvania 19103.
3. In the spring and summer of 1996, Plaintiffs were in the
process of constructing a home located at 12 Appaloosa Way in
Carlisle, Cumberland County, Pennsylvania.
4. As part of the construction project, kitchen cabinetry
and other woodwork throughout the home was painted with a product
manufactured and produced by or on behalf of and under the label of
Defendant Sherwin-Williams, bearing Product No. P65W4, a primer.
5. The said primer was developed, produced, manufactured and
sold by or at the direction and as the product of Defendant
The Sherwin-Williams Company and was expressly and impliedly held
out to the consuming public and sold as being suitable for use as
a wood primer.
6. As a result of a defect in the production of the primer
product by the Defendant, all of the kitchen cabinetry and
extensive woodwork and other cabinetry within the Plaintiffs' home
then under construction was damaged in that, inter~, the said
primer product would not adhere to the wood surfaces or lost
adhesion to the wood surfaces, which said loss of adhesion occurred
after all of the wood cabinetry and woodwork within the home had
already been coated with final coats of finish paint and otherwise
damaged the wood surfaces to which the primer had been applied.
7. As a direct result of the defect in the Sherwin-Williams
product as heretofore alleged, all of the kitchen cabinetry,
woodwork and other cabinetry throughout the Plaintiffs' then-under-
construction home was required to be removed and replaced at great
expense and causing enormous delays in the completion of the
Plaintiffs' home.
8. The defect of the product constituted a breach of express
and/or implied warranties, including warranties of merchantability
and fitness for purpose.
9. As a direct and proximate result of the defect of
Sherwin-Williams Product No. P65W4, the completion of the
Plaintiffs' home was delayed by approximately 146 days, causing the
Plaintiffs to suffer the following losses and expenses:

(a) Additional construction loan interest expenses
of approximately $15,315.05;
(b) An additional three points on the additional
interest expense in the amount of $459.45;
(c) Additional mileage traveling to and from the
new residence of approximately 5,000 miles at the
U,S. Government reimbursement rate of $0.35 per mile, a
total of $1,750.00;
(d) Additional insurance premiums during the period
from June to November of 1996, equalling approximately
$227.00;
(e) Duplicate unavoidable utility charges in the
amount of approximately $1,620.63; and
(f) Attorneys' fees in an amount equalling
approximately $2,000.00.
WHEREFORE, Plaintiffs demand judgment in their favor and
against Defendant in the amount of $21,372.13, together with costs
of suit and reasonable attorneys' fees if available under
applicable Pennsylvania law.

10. Paragraphs 1 through 9 hereof are incorporated herein as
if set forth at length.
11, Plaintiffs believe and therefore aver that Defendant
Sherwin-Williams was aware or knew that its Product No. P65W4 was
defective and that such product was unsuitable as a wood primer and
knew that such product was primarily sold for personal, family or
household purposes.

12, Despite such knowledge, Defendant continued to sell such
goods as Sherwin-Williams products, holding such product out to be
of a high standard or quality grade and when Defendant knew that
such was not the case and otherwise made or failed to advise the
public and consumers of the product of the defect.
13. Plaintiffs believe and therefore aver that the
acts of nefendant

WHEREFORE, Plaintiffs demand judgment in their favor and
against Defendant in the amount of three times the actual damages
sustained by the Plaintiffs, $64,116.39, together with reasonable
attorneys' fees pursuant to 73 P.S. Section 201-9.2(a), and that
the Court order such other relief as is deemed necessary and
proper.
