CaG'LAINT
1. Plaintiff is Pennsylvania Dutch Company, Inc., a
Pennsylvania Corporation doing business as Pennsylvania Dutch
Candies, with its principal place of business at 408 North
Baltimore Street, Mt. Holly Springs, Pennsylvania, 17065.
2. Defendant is Richard Picken doing business as Allwood
Products at 257 Roxbury Road, Newville, Pennsylvania, 17241.
3. On or about August 1, 1996, Richard Picken agreed to
make a pine hutch, (sample) for Pennsylvania Dutch Candies which
he delivered on September 26, 1996.
4. Pennsylvania Dutch Candies paid $320 but would receive a
credit of $90. on placement of an order for 30 or more hutches.
See Exhibit "1" attached hereto.
5. On November 6, 1996, Pennsylvania Dutch Candies placed
an order with Richard Picken for 30 cupboards to be the same as
the cupboard that was previously ordered and delivered.
*96110706 is attached hereto as Exhibit "2".
Order
6. The purchase order required delivery of the cabinets for
January 10, 1997 and a deposit of $3,450 was advanced. Copy of
check is attached hereto as Exhibit "3".
7. Plaintiff, in addition to the deposit of $3,450, had a
credit of $90 for overpayment on the original order. See Exhibit
"1".
B. The cupboards were never delivered and the deposit has
not been returned.
9. Defendant Richard Picken has returned to Plaintiff
$1,500 but has failed to repay the balance.
10. Defendant owes Plaintiff $2,103.50 calculated as
follows:
Deposit $ 3,450.00
Credit 90.00
Reimbursed 1,500.00
Court costs 63.50
Total due 2,103.50
WHEREFORE, Plaintiff requests judgment in the amount of

Dear Richard:
This letter serves as confirmation of our phone conversation regarding repayment of
the $3405 deposit made on November 7, 1996 check number 330701, for materials for
Pennsylvania Dutch Candles cupboard fixtures that Allwood Products was unable to
deliver.
On March 25, 1997 I racelved the first Installment of repayment In the amount of $1000.
The remaining $2405 is to be repaid with a $1000 Installment on April 9, 1997, and the
balance $1405 to be repaid by April 18, 1997,
Pennsylvania Dutch Candles has operated in good faith in establishing a repayment
schedule of these moneys owed, I expect that Allwood Products will abide by the
agreement to repay the balance of the moneys on the agreed upon dates.

COMES NOW, Defendant, RICHARD PICKEN, d/b/a ALLWOOD
PRODUCES and Answers and Counterclaims as follows.

5. Admitted in part and Denied in part. Plaintiff changed the specifications from
the original prototype in that the Plaintiff changed the size of the openings and added an
extra shelf on two, which increased the price and the co~ts. Plaintiff also asked for silk
screening which was beyond Defendant's capability. Plaintiff also asked for delivery, but
Defendant specifically rejected and indicated the Plaintiff would have to pick the items up
himself.
6. Admitted in part Denied in part. It is denied that the cabinets were to be
delivered,
7. Defendant has no direct recall concerning allegation and demands specific proof
at trial.
8. Denied. Defendant had no obligation to deliver an in fact did return 51,SOO.OO
of the deposit when Plaintiff failed to pick up the materials Plaintiff had ordered.
9. Denied. See above.
10. Denied. Defendant denies that he owes Plaintiff anything since Defendant was
stuck with the materials he had purchased for which he had no use, and he was out of
pocket approximately $2,178.00 for pine lumber, pegboard, Juan and door hardware
which Plaintiff was asked to pick up, but Plaintiff failed to appear when scheduled to pick
up these items, on two separate occasions.
COUNTERCLAIM
11. Plaintiff also requested that the pine I:Jmber be planed so that Plaintiff could
pick it up. Defendant spent a full 8 hour day doing this at a rate of 530.00 per hour for
which he has not been paid in the sum of$240,OO.
12, Defendant counterclaims for the 52,178.00 (see 10 above) plus the $240.00
for labor in the total sum of $2,218.00
WHEREFORE. Defendant demands the sum of two thousand, two hundred and
eighteen ($2,218.00) dollars.
