Ruben, Esquire and states the following in support of its Complaint: I. The Plaintiff is Harris Savings Bank, formerly Harris Savings Association, a Corporation organized and existing under the laws of the Commonwealth of Pennsylvania and having its principal place of business at Second and Pine Streets, Harrisburg, Pennsylvania 171 0 t. 2. The Defendants are Leroy H. Ruff and Paulette M. Ruff, husband and wife, adult individuals whose current address is 35 Old Stonehouse Road, Silver Spring Township, Cumberland County, Carlisle, Pennsylvania 17013. 3. Defendants on August II, 1988 entered into a Mortgage loan indenture with Harris Savings Association now Harris Savings Bank, in the principal amount of Fifty Seven Thousand Six Hundred Dollars ($57,600.00), the terms of which loan are more specifically evidenced and set forth in the Mortgage dated August II, 1988, and recorded August 15, 1988, in the Cumberland County Recorder of Deeds Office in Mortgage Book 913 Page 662, a copy of which is attached hereto and incorporated herein by reference as Exhibit "A" which mortgage contains and is a lien upon the property ~ituate at 35 Old Stonehouse Road, Silver Springs Township, Cumberland County, Carlisle, Pennsylvania 17013. 4. A copy of the Convertible ARM Note is attached hereto and incorporated herein as Exhibit "B". 5. Plaintiff, in consideration of the said Mortgage and Note advanced to Leroy H. and Paulette M. Ruff the sum of Fifty Seven Thousand Six Hundred Twenty Dollars ($57,600.00). 6. The premises subject to said mortgage is more specifically set forth in Exhibit "A". 7. Leroy H. and Paulette M. Ruff are the sole owners of the said premises securing said mortgage. 8. Said Mortgage has not been assigned in whole or in part by the Plaintiff herein. 9. That said Mortgage is in default because Defendants herein have failed to pay a partial payment of $473.06 for April, 1997; and monthly payments of $543.06 for the months of May through September, 1997, plus late charges in the amount of $99.63. 10. The Plaintiff has given to the Defendants written notice of intention to foreclose on said Mortgage as required by law under Aet 6, dated July 24, 1997, a copy of which is attached hereto and incorporated herein as Exhibit "C". II. The Plaintiff has given written notice of default as required by the Homeowner's Emergency Assistance Act of 1983, dated July 24, 1997, a copy of which is attached hereto and incorporated herein as Exhibit "0". 12. That due to Defendants' default the entire principal amount of Fifty-Seven Thousand Six Hundred Dollars ($57,600.00) has become due and payable, together wiLIt interest at the current rate of 8.375% per annum, reasonable legal fees for collection of said sum in accordance with the terms of said mortgage less such sums as have been paid on account of principal of the said Mortgage and costs. 13. The Plaintiff believes and therefore avers that reasonable attorney's fees for collection of the debt is $2,745,00 and that it will incur such amounts. 14. The Dofendants are liable to the Plaintiff for interest at the rate of 8.375% per annum, late charges, property taxes and expenses as provided in the Mortgage documents that will accrue until distribution by the Sheriff of Cumberland County, Pennsylvania, to be computed at the time of judgment in these proceedings, in addition to the current balance. 15. The Defendants are liable to the Plaintiff for the following on said Mortgage loan: a. b. c. d. e. f. WHEREFORE, Plaintiff, lIarris Savings Bank demands Judgment in its favor and against Defendants Leroy H. Ruff and Paulette M. Ruff in the amount of $57,661.49 plus interest at the rste of 8.375% from October I, 1997 until paid, additional late charges and costs of preserving the collateral and costs of suit.
