STIPULATION AGAINST LIENS
THIS AGRBEMBNT made the ) Ii J~ day of October. 1997, by and
between NEWVILLB SBRVICBMBN'S CLUB, hereinafter referred to as
CONTRACTOR,
and
NEWVILLB SBRVICEMBN'S CLUB, hereinafter reierred to as OWNERS
whereby the former undertook and agreed to erect and construct
improvements to a building on the certain lot of ground sit~\ate in
Newville Borough, Cumberland County, Pennsylvania, more fully
bounded and described on the attached Exhibit "AU.
NOW THEREFORE, THIS AGRBEMENT WITNESSBTHI That the said
CONTRACTOR. for and in consideration of the sum of ($_~. 00) Dollar
to them ill hand paid by OWNER, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for themselves and their subcontractors, and
all parties acting through or under them, covenant and agree that
no mechanic's liens or claims shall be filed or maintained by them
or any of them against the said buildings and the lot of ground
appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise,
for, towards, in, or about the erection and construction of the
said buildings on the lot above described, and the said CONTRACTOR,
for themselves, their subcontrnctors and others under them hereby
expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said real
estate and/or buildings or any of them, and agree that this
instrument, waiving the right of lien, shall be an independent
covenant.

who acknowledged himself to be the President of NEWVILLE
SERVICEMEN'S CLUB, a corporation, and that he as such President,
being authorized to do so, executed the foregoing instrument for
the purposes therein contained by signing the name of the
corporation by himself as President.

ALL those certain tracts uf land with the improvements
thereon erected Elituate in the Borough of Newvi lle,
County of Cumberland, Commonwealth of Pennsylvania, more
particularly bounded and described as follows:
TRACT....lJ. BEGINNING at a polnt on the Southern side of
Carlisle Avenue on the dividing line between Lots Nos. 51
and 52 of the hereinafter mentioned Plan of l,ots; thence
in a Southerly dlrection by said dividing line 122 feet
to a point on the Northern side of an alley 10 feet wide;
thence in a Westerly direction along the Northern side of
said alley, 130 feet to a point; thence in a Northerly
direction by a line parallel to and 10 feet in a perpen-
dicular distance to Westward from the Western line of Lot
No. 48 of said plan of Lots, 122 feet to a point on the
Southern side of Carlisle Avenue; thence in an Easterly
direction along the Southern side of Carlisle Avenue, 130
feet to the place of BEGINNING.
BEING the F.astern 10 feet of Lot No. 47 and all of Lots
Nos. 48 and 51 inclusive of Block No. 3 of the Plan of
Lots known as Wolford's Addition to the Borough of New-
ville as recorded in the Office of the Recorder of Deeds
for Cumberland County in plan Book No.1, Page 88.
~CT 21 BEGINNING at a point on the Northern side of
Westminster Avenue, on the dividing line between Lots
Nos. 17 and 18 of the hereinafter mentioned Plan of Lots;
thence in a Northerly direction by s,id dividing line 122
feet to a point on the Southern side of an alley 10 feet
wide; thence in an Easterly direction along the Southern
side of said alley, 330 feet to a point; thence in a
Southerly di rection by the dividing line between Lots
Nos. 28 and 29 of said Plan of Lots, 122 feet to a point
on the Northern side of Westminster Avenue; thence in a
Westerly direction along the Northern side of Westminster
Avenue, 330 feet to the place of BEGINNING.
BEING Lots Nos. 18 to 28 inclusive of Block No.3 of the
Plan of Lots known as Wolford's Addition to the Borough
of Newville, hereinabove referred to.
TOGETHER with a right-of-way for street purposes over
Lots 29 and 52 of Block No. 3 of said Plan of Lots, in
common with others now or hereafter thereunto lawfully
entitled.
BEING THB SAMR REAL ESTATB WHICH WILLIAM BOLDOSSER, HARRY
E. KILLIAN, and CHARLES GEORGE, Trustees for Newville
Servicemen's Club, by deed dated February 27, 1976, and
recorded in the Office of the Recorder of Deeds in and
for Cumberland County in Deed Book M-26, Page 70, granted
and conveyed to NEWVILLE SERVICEMEN'S CLUB, a
Pennsylvania Corporation.
