AND NOW, comes the Plaintiff. Five Way Partners. L.T,. by and through its attomeys.
James. Smith & Durkin. to petition this Court to lift the Supersedeas imposed by 68 Pa,C,S,
~250,513 and in support thereof aver the following:
I, PlaintilT. Five Way Partners. L.T,. is a Delaware Limited Partnership. with a
principal place of business at 1040 Boiling Springs Road M~'Chanicsburg.
Pennsylvania(hereafter"Five Way"),
2, Defendants. Chester and Kathy Deitch. are adult individuals residing at 1668 West
Lisbum Road. Mechanicsburg.Pennsylvania.17055 (hereafter called "Deitch"),
3, Robert B, Greegor and Carrie I. Greegor (hereafter "Greegor"). are Five Ways
predecessorin title to a 138,646 acre lann in Monroe Township. Cwnberland
County (hereafter called "the farm")
4, By lease agreement. dated December 1993. Greegor let unto Detich the farm for a
period of 3 years at a monthly rental of$I.400,OO(hereafter"the Lease"). a copy of
which is allached hereto as Exhihit""",
5, Five Way is a successurto {ireegor's interest in the lease allfe.:ment.
6, Deitch made one partial renl payment to Five Way in March of 1997. in the amount
of S 1.000,00 and has made no further payments,
7. By Notice of Judgment/TranscriptResidential Lease dated October 20. 1997.
DistrictJustice Ronald E, Klair entered judgment in favor of Five Way in the
amount ofS8.000,OOtogether with judgment costs in the amount of$ IllOOand
awarded Five Way possession of the farm, A copy of said judgment is attached
hereto as Exhibit "B",
8, By Notice of Appeal from District Justice Judgment. Deitch appeal~J the decision
of District Justice Klair. de novo. and filed a Praecipe to Enter Rule to File
Complaint and Rule to File on October 30. 1997. a .opy of which is attached hereto
as Exhibit "Cn,
9, On November 6. 1997, Five Way filed a Complaint in this matter to which. to date.
Deitch has not replied,
10, On October 30. 1997. Deitch placed in escrow with the Cumberland County
Prothonotary the sum of $4.200,00 toward the rental arrearages and later
supplemented that escrow by making an additional payment of$ I ,400,00 into the
escrow account on November 7. 1997,
II, Deitch has failed to make any additional rental payments into escrow as they have
become due under the tenns of the lease agreement attached hereto as Exhibit "An.
12, Pursuantto 68 Pa,C,S. ~250,513. payment into the escrow account held by the
Prothonotary is a prerequisite to the Supersedeas by which Deitch has retained
possession of the limn pending this appeal from the Notice of JudgmcnllTranscript
Residential Lease of District Justice Klair,
13, As Deitch has made payment into the escrow account held by the Prothonotary the
Supersedeas is lifted,
WHEREFORE, Plaintiff Five Way Partners respectfully requests that this Honorable Court
enter judgment in its favor and against the Defendants Deitch by granting Five Way
immediate possession of the farm and directing the Prothonotary to release all funds held in
escrow to Five Way,

5. Under the terms of the lease, part IV, Deitch agreed:
(bl. To keep and maintain the premises and its
improvements located thereon in good order and
repair and in a safe and clean condition as
received by tenant, (reasonable wear and tear
expected) .
6. As evidenced by the deed attached hereto as Exhibit "A",
the Partnership bought: the farm from Greegor on February
20, 1997.
7. The Partnership is a successor to Greegor's interest in
the lease agreement.
8. Deitch made one partial rent payment to the Partnership
in March of 1997, in the amount of $1,00.00
9. Despite both verbal and written demands, Deitch has not
made a payment of rent, in whole of partial since March
of 1997.
10. Deitch has had exclusive possession, use and enjoyment of
the farm without the Partnerships interruption since
March of 1997.
11. The partnership has performed all its obligations as
Greegor's successor under the lease agreement.
12. Deitch is in breach of the lease agreement as they have
not paid rent in the 8 months beginning April of 1997, as
it became due and, to date have not paid arrearages
totaling $11,200.00 as of this date.
13. Deitch has not maintained the farm as in the condition in
which they took possession of same.
14. Deitch is in breach of the lease agreement terms for
failure to maintain the physical plant of the farm.
WHEREFORE, Plaintiff respectfully request that this Honorable
Court enter judgment in their favor and against Defendants in the
amount of $11,200.00, together with rents which accrue and are
unpaid from the date of the Complaint and possession of the farm.

and Kathy Deitch's failure to pay rent as required under a
Lease Agreement by which they leased a farm in Monroe l'ownshlp,
Cumberland County, (hereafter 'the farm'), a copy of said
Complaint is attached heret0 a~ Exhibjt 'A').
2. At no time during this lease did Defendants actually I'esidp. at
the farm but, instead, they subleased the farmhouse as a rental
unit and used the fields and outbuildings as a farm operation.
3. On October 20, 1997, a hear~ng was held before District Justice
Ronald E. Klair, at the conclusion of which the Dlstrict
Justice awarded the Plaintiff rent arrearages and costs in the
amount of eight thousand One Hundred and Thirteen ($8,113. 00)
Dollars and possession of the farm. A copy of said order is
attached hereto as Exhibit "B".
4. Defendants have timely appealed the District Justice's
decision, de novo, to this honorable court by Notice of Appeal,
dated October 30, 1997.
5. The Defendants have neither deposited the amount of the
District Justice' s award in escrow with the Prothonotary nor
has the Defendant posted bond for same as required by 68 Pa.
C. S. ~ 250.513 and the appeal, therefore, does not act as a
Supersedeas to the District Justices award of possession.
6. The Defendants have entered upon the Plaintiff's farm,
possession of which was granted to the Plaintiff by District
Justice Klair's order of October 20, 1997, and have begun to
remove crops in the possession of the Plaintiff pursuant to
said order.
7. Defendants actions removing the crops from the Plaintiffs farm
is an act of waste to real property as contemplated under Pa.
R.C.P. ~ 1576 (Remedies in Pending Actions) .
8. The Plaintiffs will irreparable harmed if Defendants are
permitted to waste the real property, while the underlying
action is pending.
WHEREfORE, the Plaintiff respectfully request that this
Honorable Court enjoin the Defendant from entering upon the
Plaintiffs land and removing crops by the issuance of an injunction
pendente lite pursuant to Pa. R.C.P. ~ 1576 or ~ 1531.

5. On December 18, 1997 Five Way filed a petition to lift
the Supersedeas pursuant to 68 Pa. C.S. ~ 250.513.
6. On December 23. 1997, this Honorable Court issued a
Rule to Show Cause why the Petition to Lift Supersedeas
should not be granted, Rule returnable within fifteen
(15) days to be forwarded to the Chambers of the
Honorable Edgar B. Bayley.
7. On December 29, 1997 the Plaintiff's petition to Lift
Supersedeas was served upon Plaintiff's counsel Murrel R.
Walters. Esquire,
8. To date, Defendant Deitch has not responded to this
Honorable Court's Rule.
WHEREFORE, counsel for the Plaintiff, Five Way Partners,

AND NOW, come the defendants, Chester Deitch and Kathy Deitch
by their attorney, Murrel R. Walters, III, Esquire, who answer and
aver as follows:

that Deitch made a payment in March 1997

Denied.
In addition to the $1,000.00 in March 1997,
Deitch paid into the office of the Prothonotary of Cumberland
County in escrow $4,200.00 on October 30, 1997, $1,400.00 on
November 7, 1997, $1,400.00 on December 16, 1997, and $1,400.00 on
January 13, 1998.

Admitted in part and denied in part.
It is admitted
that Deitch has had use of the fal~ since March 1997, but, due to
the deteriorating conditions of the d~elling and buildings situate
thereon, it is denied that they have been able to use and enjoy
the farm as the lease intended.
11. Denied. The lease, as placed into practical ef.fect by
Greegor over a three year two month timeframe, consisted of
periodic maintenance by landlord. The Partnership has not
performed any such maintenance since it became the owner.
12. Denied. Deitch did not breach the lease agreement but,
rather, the lease was breached by Partnership's refusal to perform
agreed upon repairs to the buildings.
13. Denied. The improvements on the farm are not in the
same condition they were when Deitch took possession thereof.
Major damage, which was not caused by Deitch, occurred to many of
the improvements. Greegors agreed to pay for the repairs of these
items as they were able to do so from the receipt of rent.
Partnership has failed to follow through with this arrangement as
established by Greegor.
14 . Denied. partnership breached the lease agreement when
it failed to make necessary repairs on the improvements.
NEW MATTER
15. Deitch incorporates by reference paragraphs 1 through 14
of this Answer as though fully set forth herein.
16. The original lease between Deitch and Greegor was
further defined in its pi:'actical application. Minor maintenance
was completed by Deitch, while major building damage was the
responsibility of Greegor. Greegor was be responsible for these
repairs, whether those funds came from insurance or from rent paid
by Deitch.
17. Deitch was never notified of any change in the agreement
between Greegor and themselves as a result of the sale of the
property to Partnership.
18. Deitch relied upon the representations of Greegor in
renewing the lease for the growing season of 1997. Deitch planted
crops on the land and committed themselves financially to farm the
land for the entire growing season, with cattle being raised in
the buildings for subsequent sale in the winter of 1997-1998.
19. The failure of Partnership to properly repair the
dwelling on the property as well as the farm buildings has
seriously decreased the value of the farm to Deitch. The house
became uninhabitable, which prevented Deitch from sUbletting the
residence to a third party. Damage to farm buildings limited the
usage as a farm operation.
20. After Deitch committed to the lease for the 1997 growing
season, they discovered that Partnership was not going to honor
Greegor's agreement to provide necessary repairs to the house and
farm buildings. This failure of Partnership is a breach of the
lease agreement.
21. While there is a value to the land and farm buildings
even without the agreed upon repairs, that value is far less than
the $1,400.00 per month contemplated under the December 1993
agreement.

Connelly, LLP to answer Defendant's New Matter as follows,
15, Denied, The avemlents in paragraph Iifteen (15) are conclusions of law to which no
respor.sive pleading is deemed necessary and strict proof thereof is demanded at trial
16, Denied, Pursuant to the tenns of the lease by and among Greegor and Deitch dated
December 1993, Deitch is obligated to. "to keep and maintain the premises and its
improvements located thereon in good order and repair and in a safe and clean
condition as received by tenant. (reasonable wear and tear expected)," After
reasonable investigation. Plaintilrs cannot verily the practical application of the lease
and strict proof thereof is demanded at trial.
17. Admitted, As there was no change in the lease agreement other than the Plaintiff
beeame the Greegor's successor ami assignee there under, Deitch was not notified of
any change,
18, Denied, After reasonable investigation. Plaintiff cannot confinn or deny what
representations may have been made 10 Deitch and strict proof thereof is demanded at
trial.
19, Denied, It is spccilically denied that the Plaintilf is ohligated to repair the dwelling on
the properly and the larm huildings, It is spccilkally denied that the house became
uninhabitable as the Deitch's had, in lact, suhletted the residence to a third party
through August of 1997, It is further deni..:d that damag..: to the fann buildings
limited the usage of th..: larm opcmtiun,
20, Denied, It is specilkally d..:nied thatther..: was any agreement by and among Deitch
and Greegor other than that set forth in the lease agreement. It is specifically denied
that the Plaintiff h1d breached the agreement for failure to maintain the farm house
and fann buildings ,md. conversely, the Deitch's breached the agreement for failure to
maintain the structures,
