NOW THIS AGREEMENT WITNESSETH: That Contractor for and in consideration o( the
awarding to him by Owner of said contract as aforesaid, as well as lbe further consideration of One ($1.00)
Dollar to him paid at or before lbe ensealing and delivery 01 these presents, the receipt whereol is hereby
acknowledged, does hereby covenant, promise and agree that no mechanics' lien or claim or other lien or
claim o( any kind whatsoever shall be 61ed against the said building or buildings or the curtilage or curtibies
appurtenant thereto, by Contractor or by any sub-centractor, materialmen or laborers (or work done or
materials (urnished under said contract (or and about said building or buildings or any part thereof, or on
credit thereol, and that all sub.contractors, materialmen, and laborers on said work shall look to and hold
Contractor personally liable (or all sub-contracts, materials lurnished and work and labor done, so that
there shall not be any legal or lawful claim o( any kind whatever against Owner lor any work dome or
labor or materials lurnished under said contract (or and about the erection, construction and completion
of said buildings as aforesaid, or under any contracts lor extra work, or (or work supplemental thereto,
or olberwise
AND, in order to give the Owner lull power aDd authority to protect himsell and the lot or loll of
ground against any and all claims filed by the Contractor or anyone acting under or through him or It Ia
violation of lbe loregoing covenant, lbe said Contractor lor himself, themseives, Itsell, hereby irrevocably
authorizes and empowers any Attorney 01 any Court 01 Common Pleas 01 the Commonwealth of Penn-

ALL THAT CERTAIN piece or lot of land, together with improvements, situated
in Hampden Township, Cl.IIlberland County, Pennsylvania, and bounded and
described as follows:
BEGINNING at a point on the Eastern right-of-way line of David Drive (50.00
feet wide), said point being located at the Southwest corner of Lot No. 26
of Good Hope Farms South - Phase I; then along the Southern boundary line of
said Lot No. 26 NJrth 61 degrees 43 minutes 53 seconds East, for a distance
of 99.42 feet, to a point at the Southwest cor~er of Lot No. 27 of Good Hope
Farms South - phase I; then along the Southern boundary line of said Lot No.
27 North 88 degrees 53 minutes 50 seconds East, for a distance of 89.46

feet of land, has an address of 505 David Drive, Mechanicsburg, Pennsylvania
17055, and is known and numbered as Lot No. 300 on the Final Subdivision
Plan for Good Hope Farms South - Phase II, which is recorded in Cumberland
County in Plan Book 75, Page 26.
BEING A PART of the same pranises which Thomas W. Gaughen, d/b/a 'M Real
Estate Management Services, conveyed to The McNaughton Company, a
Pennsylvania Corporation, by deed dated October 5, 1994 and recorded in
Cumberland County in Record Book 112, Page 1058.
