COMPI,AINT Plaintiffs, Victor and Gloria M. Shields, by Wld through their undersigned counsel, by way of Complaint against the defendants hereby state: I. Plaintiffs, Victor and Gloria M. Shields, are adult individuals residing at 1932 Rudy Road, Harrisburg, Pennsylvania, 17104. 2. Defendant, Concord Builders & Services, Co., Inc., hereinafter referred to as "Concord", is upon information and belief a corporation organized and existing under the laws of the Commonwcalth of Pennsylvania, with a principal place of business locatcd at the above-captioned address, 3. At all timcs relevant and material to this Complaint, defendant Concord was upon infonnation and bclief, a gencral contractor cngaged in thc business of constructing, installing, servicing, rcpairing, and inspecting roofs. 4. Defendant, Peter Bologna, is an adult individual who resides at 40 North Market Street, Duncannon, Pennsylvania, 17020. 5. At all times relevant and material to this Complaint, defendant Bologna was a self- employed subcontractor and was engaged in the business of installing, repairing, and servicing roofs. 6. On or about May 22, 1995, plaintiffs entered into a written contract with defendant Concord to install a completed rubber roof system to the mair. roofoftheir house. A true and correct copy of said contract is attached as Exhibit "A." 7. The above-mentioned contract warranted inter alia, that the roof would be installed by factory-trained Concord installers. 8. Subsequent to plaintiffs' contract with Concord, Concord subcontracted the installation of the above-mentioned roof to defendant Peter Bologna without plaintiffs' knowledge or consent. 9. On or about May 31,1995, defendant Bologna commcnced installation of the roof on plaintiffs' home. 10. After commencing work on the plaintiffs' roof, but before completing the installation, defendant Bologna left the job site, was injured, and did not return to finish his work. 11. Neither Bologna, nor Concord made arrangements to have the roof installation completed. b. negligently and carelessly hiring and/or selecting a subcontractor to install the roof; c. negligently and carelessly failing to properly and adequately supervise and/or train defendant Bologna in the installation of the roof; d. negligently and carelessly failing to arrange to complete the installation of the new roof when work was discontinued; e. negligently and carelessly failing to warn plaintiffs of the danger to their property from water damage due to the incomplete installation of the new roof; f. negligently and carelessly delaying in making repairs to said roof when plaintiffs' home was being damaged due to water leakage; g. negligently and careles~ly failing to follow codes, ordinances, and/or manufacturer's instructions with respect to the installation and repair of the roof at the premises; h. otherwise fai ling to exercise reasonable care under the circumstances. 19. As a direct and proximate result of the aforesaid negligence and/or other liability producing conduct of defendant Concord, plaintiffs sustained damage to their property in an amount not in excess of Fifty Thousand ($50,000.00) Dollars. WHEREFORE, plaintiffs demand judgment against defendant, Concord individually and/or jointly and seveIally, in an amount not in excess of Fifty Thousand ($50,000.00) Dollars, together with interest, cost of suit, reasonable attorney fees, delay damages, and such other relief as the Court deems appropriate under the circumstances. COUNT 11- BREACH OF WARRANTY PLAINTIFFS V. CONCORD BUII.DERS & SERVICES. CO.. INC. 20. Plaintiffs incorporate herein by reference paragraphs I through 19, as though the same were fully set forth at length. 21. In conjunction with the sale and inslallation of the new roof, defendant Concord expressly and impliedly warranted that the subject roof was of merchantable quality, fit for ordinary use and fit for the particular use for which it was purchased. 22. Defendant breached these warranties because the subject roofwas not ofmerchanlable quality, was unfit for ordinary use and/or was unfit for the particular use for which it was purchased. 23, In conjunction with the sale and installation of the subject roof, defendant expressly and impliedly warranted that it was constructed in a reasonably workman-like manner. 24. Defendant breached this warranty because the subject roofing system and/or its components, were not constructed in a reasonably workman-like manner. 25. Plaintiffs had and has perfonned all conditions precedent to recovery based upon such breaches. 26. As a direct and proximate result of the aforesaid breaches on the part of Concord, plaintiffs sustained and incurred damage to their property and incurred additional expenses, in an amount not in excess of Filly Thousand ($50,000.00) Dollars. On October 6, 1997, Plaintiffs Victor Shields and Gloria M. Shields ("Plaintiffs") received a default judgment in district court against Defendants Concord Builders and Servicc:s, Co., Inc. ("Concord") and Peter Bologna in the amount of$3,929.31. Defendants appealed the district justice judgment to the Court of Common Pleas of Cumberland County. 2. Plaintiffs instituted the present action by complaint filed on or about December 10, 1997. 3. The instant action arose out of the negligence, breach of contract and breach of warranty of the Defendants concerning a contract by Defendant Concord to perfonn roofing services for the Plaintiffs at their home. 4. By letter dated June 26, 1998, Plaintiffs offered to settle the case for $2,200.00. See attached "Exhibit A." 5. By letter dated August 6, 1998, Defendant Concord accepted the PlaintitTs' settlement offer and agreed to settle the eause of action for $2,200.00. According to Defendant Concord's teUer, Defendant Concord would make an installment payment of $550.00 toward the settlement immediately after Labor Day 1998 and continue making installment payments of $550.00 every thirty days thereafter until the settlement was fully satisfied, See attached "Exhibit B." 6. To date, Defendant Concord has not tendered any amount of the seUlement to the Plaintiffs. 7. Since September of 1998, Plaintiffs have made numerous attempts through correspondence to Defendant Concord's counsel to collect the seulement. Despite these auempts, Defendant Concord has not tendered any part of the settlement amount to the Plaintiffs. 8. The authority of a court to enforce a settlement agreement is well established under Pennsylvania law. Kutchum v. Conneaut Companv. 309 Pa. 224,163 A.533 (1933); KR7An;aian v. New Envland Petroleum Co" 332 Pa. Super. 1,480 A.2d 1153 (1984). Further, where there is no evidence of a dispute concerning the existence of a seulement agreement, the court should enforce the settlement and no hearing is required to detennine the validity of seUler.lent agreement. Shields, by and through their attorneys, Post & Schell, P.C., respectfully request that this Ilonorable Court enforce the Settlement Agreement between plaintilTs and defendants, and in support thereof, aver as follows: 1. On October 6,1997, Plaintiffs Victor Shields and Gloria M. Shields ("Plaintiffs") received a default judgment in district court against Defendants Concord Builders and Services, Co., Inc. ("Concord") and Peter Bologna in the amount of $3,929.31. Defendants appealed the district justice judgment to the Court or Common Pleas orCumbcrland County. 2. PlaintilTs instituted the present action by complaint filed on or about December 10, 1997. 3. The instant action arose out of the negligence, breach of contract and breach of warranty of the Defendants concerning a contract by Defendant Concord to perfonn roofing services for the Plaintiffs at their home. 4. By letter dated June 26, 1998, Plaintiffs offered to settle the case for $2,200.00, See attached "Exhibit A." 5. By letter dated August 6, 1998, Defendant Concord accepted the Plaintiffs' settlement offer and agreed to settle the cause of act ion for $2,200.00. According to Defendant Concord's letter, Defendant Concord would make an installment payment of $550.00 toward the settlement immediately after Labor Day 1998 and continue making installment payments of $550.00 every thirty days thereafter until the settlement was fully satisfied. See attached "Exhibit B." 6. To date, Defendant Concord has not tendered any amount of the settlement to the Plaintiffs. 7. Since September of 1998, Plaintiffs have made numerous attempts through correspondence to Defendant Concord's counsclto collect the settlement. Despite these attempts, Defendant Concord has not tendered any part of the settlement amount to the Plaintiffs. 8. The authority of a court to enforce a settlement agreement is well established under Pennsylvania law. Kutchum v. Conneaut Company, 309 Pa. 224, 163 A.533 (1933); KA7J1nialan .'l....New Enllland Petroleum Co., 3321'a. Super. 1,480 A.2d 1153 (1984), Further, where there is no evidence of a dispute concerning the existence of a settlement agreement. the court should enforce the settlement and no hearing is required to detennine the validity of settlement agreement City of Carbondale v. Pennsylvania Insurance Guaranty Association, 431 I'a. Super. 317,636 A.2d (1994). 9. The Plaintiffs and IJefendant Concord reached a mutually agreeable settlement in this case that is enforeeable by this Court under Pennsylvania law. The settlement is clearly established by the correspondence of the parties. WHEREFORE, Plaintiffs Victor Shidds and Gloria M. Shields respectfully request that this Honorable Court enter an Order enforcing the settlement between tlle parties and compel Defendant Concord to make full payment of the $2,200.00 settlement amount.
