YOU MAY BE ABLE TO PREVENT THIS SHERIFF'S SALE
To prevent this Sheriffs Sale you must take immediate action:

following Motion to Make Rule Absolute:
I. On April 6, 2000, the Plaintiff filed a Petition 10 Reassess Damages in the above-
captioned matter.
2. On April 14, 2000, a Rule to Show Cause Why Plaintiffs Petition to Reassess
Damages should not be granted was issued. A true and correct copy of the Rule is attached
hereto and made a part hereof as Exhibit "A".
3. On April 27, 2000 a copy of the Order indicating the Rule Returnable Date along with
a copy of the filed Petition was forwarded to the defendants via regular mail. A copy of the
Certificate of Service is attached hereto and made a part hereof as Exhibit "B".
4. According to the Order, the Respondents had until May 17,2000 to file an answer to
Ihe Order and hllllto this date not done 50.
WHEREFORE, Plainliff respectfully requests this Honorable Coun to enter an Order
Granling Reassessmenl of Damages including $46,979.80 plus escrow deficiency, late charges,
property inspection fees, interesllhrough 04/1/2000 at $9.65 per day and allomey fees and COSI5,
totaling $62,829.09.

1. On May 29, 1998, the Plaintiff filed a petition in the
above-captioned matter requesting an Order Amending Caption
Pursuant to Rule 1033,
2. On November 11, 1998, an Order was issued for Rule to

petitions this court under Pa.R.C.P. 1033 for leave to amend the
pleadings to change the name of Defendant, Gabriel I. Martinez, to
appear as "Gabriel L. Martinez a/k/a Gabriel L. Martinez, Jr." and in
support thereof represents the following:
1. Plaintiff filed a Complaint in Mortgage Foreclosure.
2. Subsequent to the filing of the complaint, Plaintiff
discovered that it had listed Defendant's middle initial incorrectly
as "I".
3. Plaintiff accordingly wishes to amend the caption of its
complaint and all subsequent pleadings to list the Plaintiff as
"Gabriel L. Martinez a/k/a Gabriel L. Martinez, Jr.". The Deed lists

1. First Nationwide Mortgage Partnership, LP fka Lomas
Mortgage Partnership, LP (hereinafter referred to as "Plaintiff")
is a National Banking Corporation, conducting business under the
laws of the Commonwealth of Pennsylvania and brings this action to
foreclose the Mortgage between Gabriel I. Martinez and Josephine A.
Martine;:, Mortgagor(s), hereinafter referred to as "Defendant(s)"
and itself as Mortgagee. Said Mortgage was dated February 1l, 1994
and is recorded in the Office of the Recorder of Deeds and
Mortgages in Cumberland County, Pennsylvania Book 1196 Page 162.
A copy of the Mortgage is attached hereto and made a part hereof as
Exhibit "A". The Mortgage was subsequently assigned to Lomas
Mortgage partnership, LP in Book 490, Page 40l and was recorded on
l-31-95. See Title Search attached hereto as Exhibit "B" which
references assignment information.
2. The Mortgage secures Defendants' Adjustable Rate Note
dated February ll, 1994 in the amount of $ 49234.00 payable to
Plaintiff in monthly installments with an adjustable rate. A copy
of the Note is attached hereto and made a part hereof as Exhibit
"C".
3. The land subject to the mortgage iSI
602 Third street, IDola, PA 17025.
Please see copy of the legal description attached hereto and
made a part hereof as Exhibit "D".
4. The Defendant(s), Gabriel I. Martinez and Josephine A.
Martinez is/are the real owner(s) of the land subject to the
mortgage and the Defendants' address is 602 Third Street, Enola, PA
l7025.
5. The Mortgage is now in default due to the failure of the
Defendants to make payments as they became due and owing. The
following amounts are duel

30, 1974, P.L. 13 No.6, Section 403 (41 P.S. 403), a Notice of
Intention to Foreclose Mortgage was mailed to the Mortgagors by
certified and regular mail on 08/05/97. A Notice of Homeownwer's
Emergency Mortgage Assistance is not required in said proceeding as
the Bame iB insured by the Federal Housing Administration under
Title I of the National Housing Act (l2 U.S.C.A. Section 1707-
1715z-1B). A copy of said Notice is attached hereto and made a
apart hereof as Exhibit "0". Defendants have not cured the default.
1fHERBrORB, Plaintiff requests the court enter Judgment in
Mortgage Foreclosure for the sale of the mortgage property in
Plaintiff's favor and against the Defendant (s), in the sum of
