" .TIPULATION AND AGREEMENT THIS STIPULATION AND AGREEMENT entered Into this day of November, 1997, by end between B~IAN M. PECHART (hereinafter referred to as "father") and KIMBERJ,. V A, WAGGONER (herelnefter referred to as "Mother"), NOW THIS AGREEMENT WITNESSETH THAT: WHEREAS, the Father and Mother ere the natural perents of one (1) child, namely, Briana Marie Pechart (age 4, born October 13, 1993); and WHEREAS, the parties wish to enter Into an agreement relative \0 the custody, partial custody and support qf the child, NOW, THEREFORE, In consideration of the mutual covenants, promises and agreements as hereinafter set forth end Intending to be legally bound, the parties hereto agree as follows: I 1, The parties shall have joint legal custody of the child, r 2, The Mother shall have primary phYlllcal cUlltody of the child, subject to periods of pertlal or temporary physlcel cUlltody and visitation with the Father as the parties may mutually agree, Ilubjectto the condition that both parties maintain the child In & Ilmoke free environment due to her asthmatic condition and other health probiemll that the child has experienced In the past and that both partlell have adequate Illeeplng arrangementll for the child, It III the Intention of the parties that the Father have weekly . vlllllatlon with the child, 3, Both partlell agree that each party shall have reallonable telephone contact with the ch,ld While the child Is In the .other partY'1l cUlltody, , 4. The partie II will keep each other advllled Immediately relative to any emergenclell concerning the child and shall further take anY necessary steps to enSUI'a that the health, welfare and well being of the child Is protected, 6, . The partlell shall do nothing that may estrange the child from the other parent ':lr injure the opinion of the child as to the o.ther parent or which may hamper the free and natural development of the child's love or affection for the other parent. 6, Father shall pay to Mother the sum of $200,00 per month for the support of the child, effective NovElmber 1, 1997, Said amount shall be payable directly to , Mother rather than through a wage atlachment, so long as Father remains current in hill payments. If Father becomes more than thirty (30) day II delinquent In these payments, then Mother Ilhall be entltlEld to request the Cumberland County Domestic Relations Office enter an aUachment of the Father's wages to Ilecure such payment. In addition, so long all medical Insurance ,Ill provided for the child through the Mother's employer free of charge, Mother shall provide the child's medical Insurance, Father agrees to pay one-half of any uncovered medical expenses for the child, Including eye and dental care, 7, Any modlflcallon or waiver of any of the prOVisions of this agreament shall be effective only If made In wrlllng and only If executed with the same formality of this agreement. B. The parlles agree that In making this agreement there has been no fraud or concealment and that are entering Into this agreement of their own free and voluntary acl. Mother Is represented by Harold S. Irwin, III, Esquire, and Father has reviewed this agreement with Independent counsel of his choice. 9, Tha parties desire that this agreement be made an order of Court through the Court of Common Pleas of Cumbllrland County, and further acknowledge that the Court of Common Pleas of Cumberland County has jurlsdlcllon over the Issue of custody and support of the parties' minor child and shall retain such jurisdiction should circumstances change and either party desire further or require further modification of said Order, THIS SPACE INTENTIONALL V LEFT BLANK '.'--i" ", .
