Complaint against De,endant, Ford Motor Company, pursuant to Pennsylvania's
Automollve lemon law, 73 p,S, Section 1951, el. sea" as follows:
1, The Plaintiff, Greg L. Keller (hereinafter "Keller"), Is an adult Individual
residing at 1200 Claremont Road, Carlisle, Cumberland County, Pennsylvania,
2. The De,endant, Ford Motor Company (herelnaftar "Ford"), manufactures
automobiles, and particularly Ford F350 Pick Up Trucks, which are sold In
Pennsylvania, and has lis principal place of business In Detroit, Michigan,
3, The Defendant, Maguire's Ford (hereinafter "Maguire"), Is a Pennsylvania
business corporation doing business at South Main Street, P. 0, Box 39, Duncannorl,
. Perry County, Pennsylvania 17020,
4. On or about November 20, 1995, Keller purchased a new 1995 Ford F350
Pick Up Truck VIN 2FiHF36GBSCA794B4 (hereinafter "Vehicle") from Maguire's Ford,
for a total purchase price of $24,251,00 Including lax and tags, A true and correct copy

marked as Exhibit "A",
5, On or about January 30, 1996, Keller returned the Vehicle to Maguire's
Ford for repair of the transmission. A true and correct copy of the Service Oepartmant
form datlld January 30, 1996, Is allached hereto and made a part hereof and m.ar~ed
as Exhibit "B",
6, On the date of purchase the odometer In t,he Vehicle Indicated 60 miles,
7, On or about January 30, 1996, the odometer In the vehlclalndlcated 1335
miles,

8, The repair allempt on January 30, 1996, did not correct the defect In the
transmission,
9, On or about April 2, 1996, the Vehicle was returned to Maguire's Ford for
a second allempt to repair the transmission, A true and correct copy of the Service
Department form. dated April 2, 1996, Is aUached hereto and made a part hereof and
marked as Exhibit "C",
1 0, On or about April 11, 1996, the Vehicle was returned to Maguire's Ford
for a third aUemptto repair the transmission, A true and correct copy of the Dealer
Registration Plate permit for the rental vehicle Issued to Keller dated April 11 i 1996, Is
allached hereto and made a part hereof and marked as Exhibit "0",
11, On or about April 20, 1996, the Vehicle Was returned to Maguire's Ford
for a fourth allempt to repair the transmission, A true and correct copy of the Dealer
Registration Plate Permit for the rental vehicle Issued to Keller dated April 20, 1996, Is

12, On or about May 23, 1996, the Vehicle was returned to Maguire's Ford for
a fifth attempt to repair the transmission, A true and correct copy of the Service
Pepartment form dated May 23, 1996 Is allached hereto and /)'lade a part hereof and
marked as Exhibit "F",
13, On or about June 12, 1996, Keller submitted a claim to the BBa Auto Line
seeking the repurchase of the Vehicle by Ford.
14, Ford refused to repurchase the Vehicle.
15, Keller has exhausted his remedies available under Ford's Customer

16, The Vehicle's condition substantially Impairs Its use, value or safety and
does not conform to Ford's express warranty,
17. Keller has engaged the services of an allorney In the pursuit of his claim

20, Keller has, on numerous occasions, attempted to return the Vehicle to
Ford,
21, Ford refused to acceptlhe return of the Vehicle, notwithstanding, Ford's
,allure to correct the defect constitutes unfair and bad faith conduct.
WHEREFORE, Plaintiff, Greg L. Keller, demands judgment against Ford Motor
Company, as follows:

23, Defendant Ford Motor Company used unfair deceptive acts or practices
I1S defined In the Unfair Trade Pracllces and Consumer Protection Law (hereinafter
"UTPCPL"), Secllon 201 et seq" with reference to the Intentlona,l and fraudulent
misrepresentations and knowing violations of the warranty as set forth above,
24, Defendant Ford Motor Company Is In violation of tha UTPCPL, Section
201 et seq, by usln9 unfair and deceptive acts or practices as set forth above,

25, Plaintiff purchased the Vehicle relying on De,endant Ford Motor
Oompany's repres~ntatlons thatlhe vehicle was free from defects and was 0' the
qualIty standard generally expected of a newly purchased vehicle,
26, Said vehicle was not, In fact, free frQm defects, and thus was not of the
quality slllndard represented to the Plalntl1f by the Defendant.
27, Defendant's mlsrepresentallons regerdlng the condition and quality of the
automobile and Its failure to honor Its warranties constitute unfair and deceptive acts
and practice and, as such, are a Violation of the UTPCPL, Section 201 et seq.
28, As a direct result and proximate result of Defendant Ford Motor
Company's use of unfair and deceptive acts and practices, Plaintiff has sustained
damages In the amount of TWENTY-FOUR THOUSAND TWO HUNDRED FIFTY-ONE
. ($24,251.00).
WHEREFORE, Plaintiff respectfully requests Judgment against Defl1ndant Ford
Motor Company for treble damages In the amount of Seventy-two Thousand Seven
Hundred Flny-three Dollars and 00/100 ($72,753,00) pius attorney's fees pursuant to
Section 201-9,2 of UTPCPL, together with Interest thereon, and the costs of suit.
