Kipps, is an adult competent individual residing at R.R. #1, Box 80-Kr Unionda1er Pennsy1 vania r 18470. 2. The Defendants, George Brandt and Elaine J. Brandt, are adult competent individuals residing at 2225 Mt. Hope Laner Toms River, New Jersey. 08753. 3. Plaintiff is the owner of commercial realty situate at 4904 East Trind1e Road, Mechanicsburg, Cumberland County, Pennsylvania, 17055. 4. On or about August 16r 1995, Plaintiff leased the said Mechanicsburg property to Defendants. Attached hereto and marked as Exhibit 'A' is a copy of that lease. At all times relevant hereto the Defendants traded under the name "Country Daze" and executed said lease as the lessee using said trade name. COUNT 1 - BREACH OF CONTRACT , 5. Plaintiff incorporates paragraphs 1 through 4 of this Complaint as if the same were set forth more fully herein. 6. On or about April 22/ 1996r without the written consent of the Plaintiff, the Defendants subleased the premises at issue to William Dunkelberger and Valerie Dunkelbergerr the parties who now occupy the premises. 7. The subleasing of these premises without obtaining the written consent of the Plaintiff constitutes a breach of Article 1 (Use and Assignment) of Defendants' lease with Plaintiff, 8. As a result of this breach, there is due and owing the Plaintiff the amount of $11/000.00/ which amount represents the accelerated balance of the rent due under the lease in accordance with Paragraph 13 (Remedies of Lessor) of the lease, 9. Plaintiff has made demand on the Defendants for this sum but the Defendants have failed and refused and still fail and refuse to pay the sum or any part thereof, WHEREFORE/ Plaintiff demands judgment against the Defendants in the amount of $11/000.00: i,' COUNT II - INJURY TO PROPERTY - WASTE 10. Plaintiff incorporates by reference Paragraphs 1 through 9 of this Compluint as if the same were set forth herein at length. 11. In October and November of 1995r Defendants were in possession of the said property as tenants of the Plaintiff under the said lease. 12. On or about October or November of 1995, and on other occasions while they possessed the said property, defendants wrongfully, willfully and deliberately injured and damaged the said property by rewiring and reconfiguring the electrical circuitry serving the premises, leaving wires exposed and creating a hazardous conditionr all of which were done without the permission or consent of the Plaintiff. 13. The said damages and injuries amount in all to the sum of $2rBOO.00. 14. By reason of the aforesaidr the Plaintiff has been greatly injured in his reversionary estate in the said property to the extent of $2,800.00, and has requested the Defendants to pay him the said sumr but Defendants have refused to pay the sum or any part thereof. WHEREFORE, Plaintiff demands judgment against the Defendants in the amount of $2,800.00. COUNT III - INJURY TO PROPERTY - FAILURE TO MAIN~AIN 15. Plaintiff incorporates by reference Paragraphs 1 through 14 of this Complaint as if the same were set forth herein at length. 16. In September of 1995 , Defendants were in possession of the said property as tenants of the Plaintiff under the said lease. 17. On the said date, and on other occasions while they possessed the said property, defendants wrongfully and negligently permitted the premises to become blocked with debris to the extent that rainwater became diverted from its intended course and seeped into structure itselfr causing damage not only to the gutters but to the structure's eaves as well. 18. The said damages and injuries amount in all to the sum of $1r600,OO. 19. By reason of the aforesaid, the Plaintiff has been greatly injured in his reversionary estate in the said property to the extent of $1,600.00, and has requested the Defendants to pay him the said sumr but Defendants have refused to pay the Bum or any part thereof. WHEREFORE, Plaintiff demands judgment against the Defendants in the amount of $1,600.00. COUNT IV - BREACH OF CONTRACT - FAILURE TO PAY TAXES 20. Plaintiff incorporates by reference paragraphs 1 through 19 of this Complaint as if the same were set forth more fully herein. 21. Article 10 of thelease at issue requires Defendants, as tenantsr to pay all countYr school district and municipal real estate taxes assessed against the premises within thirty days of presentment by lessor tolessee of a copy of the bill for ,same. 22. On or about August 28, 1997, Plaintiff provided Defendants with a copy of the 1997 combined county and municipal and 1997 school tax bills. A copy of those bills is attached hereto and marked as Exhibit 'B', 23. Despite Plaintiff's insistence that these bills be paid, the Defendants have failed or refused to pay these tax bills, in violation of Article 10 of the lease, 24. The amount of combined county and municipal taxes and real estate taxes currently owed by the Defendants under the lease is $lr391.50, plus penalty of $223.00. The amount' of additional real estate taxes anticipated under the balance of the leasehold term is $lrlll.50. Kippsr the Plaintiff in the case captioned abover and respectfully represents to the court the following: 1. The Plaintiffr Ronald W. Kipps, is an adult competent individual residing at R.R. #1, Box 60-K, Uniondaler Pennsylvania, 16470. 2. The Defendants, George Brandt and Elaine J. Brandtr are adult competent individuals residing at 2225 Mt. !lope Lane, Toms River, New Jersey. 08753. 3. Plaintiff is the owner of commercial realty situate at 4904 East Trindle Road, Mechanicsburg, Cumberland County, , Pennsylvaniar 17055. 4. On or about August 16r 1995, Plaintiff leased the said Meohanicsburg property to Defendants. Attached hereto and marked as Exhibit 'A' is a copy of that lease. 5. Beginning on or about April 22r 1996, and on other occasions since thenr the Defendants have breached the terms of their lease with Plaintiff in the following respectsr to wit: (a) the Defendants subleased the premises at issue to the without first having obtained the permiRsion or consent of Plaintiffr as required by the terms of the lease; (b) the Defendants have failed or refused to pay the real estate taxes due and owing for the premises at issue, as required by the terms of the lease; (c) the Defendants have committed waste to the premises by causing dangerous alterations to the electrical system and allowing wiring to remain exposed; (d) the Defendants were negligent in maintaining the building's gutters and eaves, resulting in blockage and damage to same. 6. The fair and reasonable cost of repairing or replacing the damage to property described above is as follows: (a) $1,600.00 for damage to gutters and eaves; and (b) $2r800.00 for electrical repair; and 7. The amount of real estate taxes currently owed by the Defendants under the lease is $1,391.50, plus penalty of $223.00. The amount of additional real estate taxes anticipated under the balance of the leasehold term is. $1,111.50. 8. There is also due and owing the Plaintiff the amount of $11/000.00, which amount represents the accelerated balance of the rent due under the lease in accordance with Paragraph 13 (Remedies of Lessor) of the lease. 9. Plaintiff has made demand on the Defendants for these sums but the Defendants have failed and refused and still refuse to pay the same or any part thereof.
