Lerman, Esquire and Thomas B. Sponaugle, Esquire, and files this its Complaint against the Defendant, William Henry Pratt, whereof the following is a statement: 1. Plaintiff, Borough of Hummelstown, is a Pennsylvania municipality with a mailing address of 136 So~th Hanover Street, Hummelstown, Dauphin County, Pennsylvania. 2. Defendant, Willian Henry Pratt, is an adult individual residing at 918 River Road, Marysville, Perry County, Pennsylvania. 3. At all times relevant hereto, Plaintiff was the owner of a 1995 Ford Crown Victoria, with a Vehicle Identification No. 2FALP7lW5SX157473, Pennsylvania registration number 56567MG. 4. At all times relevant hereto, Defendant was the owner of a 1983 Ford F-l50 pick-Up truck with Pennsylvania registration plate number ZH72924. 5. On or about July 28, 1997, at approximately 2:55 a.m., on State Route 581, Segment Matter 72.1 - 0.3 mile, Plaintiff, acting in its official capacity as the Borough of Hununelstown Police Department, was in hot pursuit of Defendant in Hampden 1'ownship, Cumberland County, Pennsylvania, together with a member of the Township of Derry Police Department who was operating a Township of Derry police vehicle and by a member of the Swatara Township Police Department who was operating a swatara Township police vehicle, 6. At tbe above referenced time, date and place, Defendant stopped suddenly causing Defendant's vehicle to be rear ended by the Swatara Township police vehicle. 7, At the same time, date and place referenced above, the Township of Derry vehicle swerved into the right hand lane and slowed in front of the Borough of Hummelstown vehicle, causing the Borough of Hummelstown vehicle to rear end the Township of Derry vehicle. 8. The damages sustained to Plaintiff's vehicle were the sole, direct and proxImate result of the negligence, recklessness and carelessness of the Defendant and were due in no manner whatsoever to any act or failure to act on the part of the Plaintiff. 9, Defendant owed a duty to the Plaintiff and other drivers to exercise reasonable care in the operation of his vehicle. 10. The Defendant breached his duty to the Plaintiff by failing to exercIse reasonable care in the operation of his motor vehicle. 11, The negligence, recklessness and carelessness of the Defendant consisted, inter alia, of the following: a. failing to properly operate and control his motor vehicle; 2 b, failing to koep alert and maintain a proper lookout for the presence of othar motor vohiclas on the streets and highways I c, operating his motor vehicle while under the influenee of alcohol which rendered him incapable of safe driving in violation ot 75 Pa,C.S.A, ~ 3731; d. operating his motor vehIcle in wIllful or wanton disregard for the safoty of persons or property in vIolation of 75 Pa,C.S,A, ~ 373G; and, e, failIng or refusIng to brIng his motor vehicle to a stop or fleeing or attempting to elude a pursuing police officer, when given visible or audible signal to bring the vehicle to a stop In violatIon of 75 Pa.C.S.A. ~ 3733, 12. As the sole, direct and proximate result of the neglIgence, carelessness and recklessness of the Defendant as set forth hereInabove, Plaintiff's vehicle sU3tained damage In the amount of $14,039.78, A true and correct copy of the repair estimate Is attached hereto, Incorporated hereIn by reference and marked Exhibit "1". 13. Defendant remains owing an amount of $14,039,78 to the Plaintiff. 14. Plaintiff has demanded payment of the amount due from the Defendant, but Defendant has refused and continues to refuse to pay same or any part thereof. 15.
