S 5313 (b), the plaintiffs, Margaret E. and Robert M, Mentzer, by their attorneys, the Family Law Clinic, respectfully request that they be granted sole physical and legal custody of their grandchild, Jennifer Elaine Mae Mentzer, with reasonable noncustodial visitation by both parents. The following facts are averred in support thereof: 1. The plaintiffs are Margaret E. and Robert M. Mentzer, the paternal grandmother and grandfather of Jennifer Elaine Mae Mentzer, (the child), all of whom reside at 21 Evandale Court, Carlisle, Cumberland County, Pennsylvania, 17013. 2. The defendants are steven A. and Jessica M. Mentzer, the father and mother of the child. The father, Steven A. The relationship of the plaintiffs to the child is that of paternal grandmother and grandfather. Plaintiffs have not participated as parties or witnesses, or ill another capaoi ty, in other 11 tigation ooncerning the custody of the child in this or another court. However, a Custody Order was entered at docket I 95-7232, on January 3, 1996, giving both defendants shared legal and physical custody. The father was to have oustody during the week and the mother had custody on the weekends. A second custody Order was entered by agreement of the parents on September 11, 1997, to the same docket, which changed the physical custody to alternating weeks, .instead of the father having custody during all weeks. However, neither parent has followed the orders, and plaintiffs have been caring for the child. A true and correct copy of the Orders of January 3, 1996, and Sept~mber 11, 1997, are appended hereto and incorporated by reference. Plaintiffs have been notified by Cumberland County Children & Youth Services that a dependency petition hae been filed with this Court and that an emergency hearing will be held on that petition this date. Plaintiffs do not know of a person not a party to the proceedings who has physical custody of the children or claims to have custody or vis.itation rights with respect to the children. 7. The best interest and permanent welfare of the child will be served by granting the relief requested because: a) Plaintiffs are the primary caretakers of the child and have provided for the emotional and physical needs of the child since her birth. b) Neither parent is responsible enough to care for the child. 0) Neither parent has shown any long-term interest or oommitment to raising the child. d) Neither parent has a stable home environment. In taot, detendants are both only staying temporarily at their ourrent residences. 8. Each parent whose parental rights to the children have not been terminated and the person who has phyoicll,l custody ot the children have been named as parties to this action.
