PETITION FOR APPROVAL OF A COMPROMISE
SETTLEMENT PURSUANT TO PA. R.C.P. 2039
AND NOW, comes Petitioner, Karen Martin, Guardian and Mother
of Lindsay M. Zeigler <,nd Erin E. Zeigler, minors, through her
attorneys, Purcell, Krug & Haller and petitions as follows:
1. Petitioner is Karen Martin, the parent and natural
guardian of the minor plaintiffs, Lindsay M. Zeigler and Erin E.
Zeigler, who reside with petitioner at 196 Spanglers Mill Road, New
Cumberland, Cumberland County, Pennsylvania.
2. Lindsay M. Zeigler is a 16 year old minor, born June
22, 1982.
3. Erin E. Zeigler is a 14 year old minor, born July 7,
1984.
4. petitioner is the sole custodial parent and natural
guardian of the children.
5. This matter ariEleEI out of a November. 22, 1995
automobile accident during which the vehicle operated by their
Mother, Karen Martin, was rear-ended by Defendant Matthew T.
Castner on Spanglers Mill Road, New Cumberland, Cumberland County,
Pennsylvania, the minors being pasElengers in that vehicle.
6. The applicable insurance policy provided for Limlted
Tort, the Declaration Sheet for which is attached hereto as Exhibit
IIAII.
7. Neither minor sustained any injury which would
constitute an exception to Limited Torti to wit, death, serious and
permanent disf igurement or serious impairment of bodily function.
8. Erin Zeigler sustained no injury whatsoever from the
subject accident.
See statement of Dr. Daly attached hereto as
Exhibit "B".
9. Lindsay M. Zeigler sustained slight soft tissue
injury from which she has fully recovered without any limitations,
as borne out by her continuous engagement in strenuous activities,
including soccer, cheerleading and a part-time job as a clerk in a
clothing store. See report of Dr. Daly attached hereto as Exhibit
"C".
10. Lindsay M. Zeigler was examined by Dr. William W.
DeMuth, who after a physical examination and MRI scan, determined

that her minor intermittent back dincom[ol.t if! a~,e relateel, not
p.:lthologic (from the accident), anel not Incapac.i.tat.in~J in any way,
opining that the si tuatlon would reElO 1 ve wi th t 1m!.! upon her
following a gentle stretching program prior to her performing
athletic activities.

11. Karen Martin sustained serious impairment of bodily
function as a result of the accident, as demonstrated by the
following injuries and symptoms:
A. Numbness in fingers and arms;
B. Severe lower back and neck pain;
C. A herniated disc in the cervical spine;
D.
reduction of physical activity,
complete abstinence from all sports;
A gross

E. Difficulty sleeping due to pain arising from
sleeping on her back or stomach.
12. A settlement has been tentatively reached wi th regard
solely to the injuries of Karen Martin, whereby the sum of
$40,000.00 would be paid to her as a result of her significant,
continuing injuries.
13. However, the Insurance carrier requires a full
Release and satisfaction of the action as to all parties, a copy of

the pt'oposed Releafle is attached hereto iHl ExhibIt "E".
14. Pursuant to t.he LimIted Tort prQvIsions of the
Pennsylvania Motor VehIcle FinancIal Responsibility Law, the minor
Plaintiffs cannot recover non-econom.i.c damages as a result of being
in the accident - they can recover only for unpaid wage loss and
medical expenses, which do not exist.
15. The fourteen (14) and sixteen (16) year old minor
Plaintiffs join in this Petition that the entire settlement sum be
paid to their mother for her injuries, that the existing action be
dismissed and the attached Release be signed.
16. It is requested that no hearing be held regarding
this Petition, owing to the unnecessary settlement delay, the
confirmatory attached medical reports, minor party joinder and
application of Limited Tort to this situation without exception
Ii .e., no death, scarring of any kind, and no impairment of bodily
function as to the mil~or Plaintiffs) .
WHEREFORE, Petitioner respectfully requests this Honorable
Court to:
A. Authori ze, wi thout <1 Hearing, the proposed
compromise settlement with the Defendants, as more
fully stated in this Petition, with all sums to be
paid to Karen Martin, individually;

Zeigler for several years.
Prior to the accident of Novemver 20, 1995, Lindsay M.
zeigler had scoliosis without back pain. Subsequent
to the accident. she has had Intermittent bacK pain
and occasional headaches: however, neither the back
pain nor the headaches have ever in any way limited
her activities wtllch include soccer, cheerleading,
and part-time sales and clerKing at The Limited.
She Is currently engaging in full activities.
As a resu I t of the accident on November 20, 1995,
Lindsay M. Zeigler remains a very active teenager
without serious bodily Impairment or serious,
