MARRIAGE SETTLEMENT AGREEMENT
THIS AGREEMENT made this l'~,nday of April, 1999 by and betwoen
RONALD S, SWIGERT, hereinafter referred to as "HUSBAND") and BRENDA L,
SWIGERT, (hereinafter referred to as 'WIFE").
WITNESSETH: WHEREAS, HUSBAND and WIFE were lawfully married on
Novamber21, 1971; and
WHEREAS, diverse, unhappy differences, disputes and difficulties have arisen
between the parties and It Is the Intention of HUSBAND and WIFE to live separate and
apart for tha rest of their nat\Jralllves, and the parties hereto are desirous of settling
fully and finally their respective financial and property rights and obligations as between
each other, Including, without limitation by specifIcatIon; the settling of all matters
between them relating to the ownership and equitable distribution of real and personal
property; the settling of all claims and possible claims by one against Ihe other or
against their respective estates and equitable distribution of property and alimony for
each party.
NOW, THEREFORE, In consideration of the promises and the mutual promlsss,
covanants and undertakings hereinafter set forth and for other good and valuable
consideration, receipt of which Is hereby acknowledged by each of the parties hersto,
HUSBAND and WIFE, each Intending to be legally bound, hereby covenant and agree
as follows:
1. The parties Intend to maintain separate and permanent domiciles and to
live apart from each other. It Is the Intenllon and purpose of this agreement to set forth
the respective rights and duties of the parties while they continue to live apart from
each other.
2. The parties have attempted to divide their matrimonial property In a
manner that conforms to a Just and right standard, with due regard to the rights of each
party. It Is the Intention of the parties that such division shall be final and shall forever
determine their respective rights. The division of eXisting marital property Is not
Intended by the parties to constitute In any way a sale or exchange of assets,
3, Further, the parties agree to continue living separately and apart from
each other at any placa or places that he or she may select. Neither party shall molest,
harass, annoy, Injure, threaten or Interfere with the other party In any manner
whatsoever. Each party may carry on and engage In any employment, profession,
business or other activity as he or she may deem advisable for his or her sole use and
benefit. Neither party shall Interfere with the uses, ownership, enjoyment or disposition
of any property now owned and not specified herein or property hereafter acquired by
the other.
4. The consideration for this contract and agreement Is the mutual benefits
to be obtained by both of the parties hareto and the covenants and agreements of each
of the parties to the other. The adequacy of the consideration for all agreements herein
contained Is stipulated, confessed, and admitted by the parties, and the parties Intend
to be legally bound hereby.
5. ,DEBTS: It Is further mutually agreed by and between the parties that the
debts be paid as follows:
A. The HUSBAND shall assume all liability for and pay and
I Indemnify the WIFE against any of his Individual debts.
B, The WIFE shall assuma all liability for and pay and
Indemnify the HUSBAND against any of her Individual debts and the parties Jolnl
mortgage obligation,
C, The parties agree Ihalthey have no 'other Joint obllgallons
other than the mortgage referred to above,
6, Except as herein provided, the parties agree that they have provlously
divided their personal property to their mutual setlsfactlon. No payment shall be made
by either party to the other as a result of the division of property contained herein, Tho
parties agree that this division Is fair and equitable, and Is voluntary and mode without
duress by or upon either party. The parties further agree that henceforth, each of the
parties shall own, have and enjoy Independently of any claim or right of the othor party,
all Items of personal property of every kind, nature and description and wherever
situated, which are now owned or held by or which may hereafter belong to the
HUSBAND or WIFE, with full power to the HUSBAND or the WIFE to dlsposo of seme
as fully and effectually, In all respects and for all purposes as If he or she were
unmarried. The fOllowing division of spfilclfic Items of personal and real property will be
equitably distributed as follows:
A, REAL ESTATE: HUSBAND agrees to release to WIFE his Interest
In the marital home at 217 Maple Lane, Mechanlcsburg, Cumberland County,
~ennsylvanla 17055 and shall execute a deed conveying his Interent thereon to
WIFE, Said deed shall be held In escrow by HUSBAND's attorney until such
time as WIFE obtains either refinancing of the parties' Joint mortgage or
HUSBAND's release by the lender from all obligations thereunder.
B. PERSONAL PROPERty:
1.) Motor Vehicles - The HUSBAND hereby releases to WIFE
the 1990 Ford Taurus and WIFE hereby releases to HUSBAND the 1988
, Ford Bronco and the 1978 Ford pick-up truck.
2,) Bank Accounts - Each party shall retain their respective
Individually held checking and saVings accounts free of any olalm by the
other party,
3.) Employee Benefit and Retirement Plans - Except as
provided elsewhere In this agreement, each party shall retain all of theIr
own employee benefit, savings and/or retirement plans, annuity accounts,
401K's and IRA's and the proceeds thereof, free of any claim by the other
party ,
4.) Other personal property. The parties agree that they have
divided all of their remaining personal property, Including, but not limited
to furniture, household goods, appliances and personal belongings to their
m~tual satisfaction and each release to the other all such personal '
property as now divided, except that WIFE agrees that HUSBAND shall
also be entitled to those Items listed In the attached Exhibit "A",
Incorporated herein by reference.
7. CASH PAYMENT: In consideration of the division of assets and debts as
contained In this agreement, and in order to provide a more equitable division thereof to
WIFE, HUSBAND agrees to pay to WIFE the sum of $19,734.71, said sum to be
transferred to WIFE by means of a non-taxable rollover from HUSBAND's Quick &
Reilly IRA to WIFE's IRA pursuant to a Qualified Domestic Relations Order (QDRO), If
necessary, said QDRO to be prepared by WIFE's attorney at WIFE's expense.
HUSBAND will cooperate by promptly providing any and all Information required to
prepare the QDRO or authorizing WIFE's attorney to obtain such Information, In the
event that a non-taxable rollover from this account to WIFE's account can be
accomplished without a QDRO, HUSBAND will cooperate In signing whatever
documents are required to effect the transfer.
8. INCOME !AX ~ETURNS: All Income tax returns for tax years 1998 and
beyond will be flied separately and the parties will each retain any refund due to them.
9. SUPPORT AN.Q ALIMONY: 80th parties hereby waive and forego l'lll
financial and material spousal support from each other and agree not to request or seek

to obtain alimony, alimony pendente lite or spousal support before or after any divorce
which may be granted. WIFE agrees that HUSBAND's current spousal support
obligation shall be and Is hereby terminated by the execution of this agreement and
agrees to Immediately notify the Cumberland County Domestic Relations Office to
terminate the existing spousal support order. Any arrears on 8pr;l~lll1'1 support ~,n.,l#
be paid in the same amount as the pr.esent Support order until 'V~
paid in full.
10. DIVORCE: The parties both agree to cooperate with each other In
obtaining a final divorce of the marriage. It Is agreed that the marriage Is Irretrievably
broken and that more than ninety days has expired since the date of service of the
divorce complaint. Accordingly, simUltaneously with the execution of this agreement,
the parties will execute and file the consents and waivers necessary to obtain the
divorce, WIFE's attorney will file all necessary final documents, together with ~
praecipe to transmit the record, In a timely manner, Both parties will be responsible for
their own legal costs and fees Incurred In this divorce.
11. BREACH: In the event of the breach of this agreement by either party,
the non breaching party shalll'!ave the right to seek monetar') damages for such breach,
where such damages are ascertainable, and/or to seek specific performance of the
terms of this agreement, where such damages are not ascertainable. All costs,
expenses and reasonable attorney fees Incurred by the sucoessful party In any litigation

to obtain monetary damages and/or speolno performance of this agreement shall be
recoverable as part qf the judgment entered by the court.
12, ADDITIONAL INSTRUMENTS: Each of the parties shall from time to
time, at the request of the other, execute, acknowledge and deliver to the other party
any and all further Instruments that may be reasonably required to give full force and
effect to the provisions of this agreement.
13. VOLUNTARY EXECUTION: The provisions of this agreement and their
legal effect have been fully explained to the parties and Its provisions are fully
understood. Both parties agree that they are executing this agreement freely and
voluntarily. HUSBAND's legal counsel Is Harold S, Irwin, III, Esquire. WIFE's legal
counsel Is Carol J, Lindsay, Esquire.
14, ENTIRE AGREEMENT: This agreement contains the entire
understanding of the parties and there are no representations, warranties, covenants, or
undertakings other than those expressly set forth herein.
15. APPLlCABLE.LAW: This agreement shall be construed under the laws
of the Commonwealth of Pennsylvania,
16. PRIOR AGREEMENTS: It Is understood and agreed that any and all'
property sattlement agreements which mayor have been executed or verbally
discussed prior to the date and time of this agreement are null and void and of no
effect.
17. WAIVER QE CL.~IMS AGAINST IHE ESTATES: Except as otherwise
provided herein, each party may dispose of his or her property In any way, and each '
party hereby waives and relinquishes any and all rights he or she may now have or
hereafter acquire, under the present or future laws of any JUrisdlcllon, to share In tho
property or the estate of the other as a result of the marital relallonshlp, Including
wlthoutllmltallon. dower. curtesy, statutory allowance, wldow's allowance, right to take
In Intestacy, right to take against the Will of the other, and right to act as administrator
or executor of the other's estate, and each will, at the request of the other, execute,
acknowledge and deliver any and all Instruments which may be necessary or advisable
to carry Into effect this mutual waiver and relinquishment of all such Interests, rights and
claims.

The Plaintiff, being duly sworn according to law, deposes and says:
1. I have been advised of the availability of marriage counseling and
understand that I may request that the court require that my spouse and I participate In
counseling.
2. I understand that the court maintains a list of marriage counselors In the
Prothonotary's Office, which list Is available to me upon request.
3. Being so advised, I do not request that the court require that my spouse
and I participate In counseling prior to a divorce decree being handed down.
I verify that the statements made In this affidavit are true and correct. I understand that
false statements herein are made subject to the penalties of 18 Pa. C.S. Section 4904

grounds upon which this action Is based that the defendant Is the Injured spouse and
that the plaintiff has offered such Indignities to defendant as to render defendant's

4. EXHIBITSt The appraisals, statements and other documentation
attached hereto will be offered as evidence by the defendant..
6. GROSS 'NCOMEl Defendant Is employed by the U.S. Postal Service
and Is a part-time carrier out of the Mechanlcsburg post office. He elso receives
retirement Income from his previous employment at Carlisle Tire & Rubber. His
combined monthly net Income Is approximately $1,826,00 on an average basis.
Howaver, defendant will malntElln that once his pension Is considered an asset for
equitable distribution, at such time as the distribution takes place, his retlr~ment Incoma
should no longer be considered as part of In monthly Income.
6. EXPENSES: Defendant will provide the Master and the plaintiff with an
Itemized expense statement at the hearing In this matler, If necessary. However,
defendant will maintain that due to the expected equitable distribution to plaintiff and
her obvious ability to Incur and pay all expenses related to this litigation to date, any
claims by plaintiff for costs and expenses are unwarranted.

7. PENSIQH:. Defendant has pension or retirement benefits through his
employment. A copy of the evaluation has been provided.
8. COUNSEL FEES: Plaintiff has requested, among other things, an
award of counsel fees. However, defendant will maintain that due to the expected
equitable distribution to plaintiff and her obvious ability to obtain and pay legal counsel
to date, any claims by plaintiff for attorney fees ara unwarranted,
9. DISPUTED PERSONAL PROPERTY: Defendant Is unaware of any
dispute as to any Items of personal property, although It Is believed that plaintiff
maintains possession of a variety of miscellaneous personal property and effects that
should ,be turned over to defendant.
10. MARITAL DE.BI.Sl The parties' have no marital debts to confllder In
this matter except for the mortgage on the marital home, the balance of whloh Is as
stated In the attached Inventory and appraisement. Plaintiff Is residing In the marital
home and appears to Intend to remain there. Defendant contends therefo~ that plaintiff
should assume responsibility for this obligation.
11. PROPOSED RI;SOLUTION:
A. Assets. Defendant proposes that all assets be divided 55% to
plaintiff and 45% to defendant. This percentage Is based upon the faot that by
,
receiving distribution of the marital home, plaintiff will have Immediate access to
that value, while the primary asset retained by defendant will be his 401K and
retirement that are not only not Immediately available to him without substantial
losses, taxes and penalties, but will be eventually received by him only on a
monthly basis. Based on the figures on the attached Inventory and
appraisement, showing net total marital assets of $223,396,00, such a division
would result In a net amount due to plaintiff In the amount of $13,191.80.
Defendant proposes that the parties enter Into a QDRO providing that his
monthly pension amount of $372.21 be made payable directly to plaintiff for a
period of 36 months, after which all future pension payments would revert to the
defendant. This would result In a total payment to plaintiff In the amount of
$13,399.56. This proposal Is based upon the fact that the defendant has no
other resources from which to pay a lump sum amount to plaintiff except his
401K, withdrawals from which would result In substantial tax penalties and
taxable capital gains, as well as require him to liquidate assets during a period In
which the stock market has been depressed, Conversely, defendant would be
willing to make such a lump sum payment from his 401K, provided that such
. payment 15 reduced by the amount of penalties rasultlng from the early
withdrawal from the 4011<. plus the amount of any Income taxes that he will Incur
on any capital gains,

MARRIAG); JETTLEMENT AGREEMENT
THIS AGREEMENT made this 1t,flday of ,April, 1999 by and between
RONALD S. SWIGERT, hereinafter referred to as "HUSBAND") and BRENDA L,
SWIGERT, (hereinafter referred 10 !'is 'WIFE").
WITNESSETH: WHEREAS, HUSBAND and WIFE were lawfully married on
November 21, 1971: and
WHEREAS, diverse, unhappy differences, disputes and difficulties have arisen
between the parties and It Is the Intention of HUSBAND and WIFE to live separate and

apart for the rest of their natural lives, and the parties hereto are desirous of settling
fully and finally their respective financial and property rights and obligations as between
each other, Including, without limitation by specification; the settling of all matters
between them relating to the ownership and equitable distribution of real and personal
property; the settling of all claims and possible claims by one against the other or
against their respective estates and equitable distribution of property and alimony for
each party.
NOW, THEREFORE, In consideration of the promises and the mutual promises,
covenants and undertakings hereinafter set forth and for other good and valuable
consideration. receipt of which Is hereby acknowledged by each of the parties hereto,
HUSBAND and WIFE, each Intending to be legally bound, hereby covenant Elnd agree
as follows:
1. The parties Intend to maintain separate and permanent domiciles and to
live apart from each other. It Is the Intention and purpose of this agreement to set forth
the respeotlve rights and duties of the parties while they continue to live apart from
eaoh other.
2. The parties have attempted 10 divide their matrimonial proporty In a
manner that conforms to a just and right otandard, with due regard to the rights of each
party. It Is the Intention of the partleo that such division shall be flnal and shall forever
determine their respective rights. The division of exlBtlng marital property Is not
Intended by the parties to constitute In any way a sale or exchange of assets.
3. Further, the parties agree to continue living oeparately and apart from
each other at any place or places that ha or she may select. Neither party shall molest,
harass, annoy, Injure, threaten or Interfere with the other party In any manner
whatsoever. Each party may carry on and engage In any employment, profession,
business or other activity as he or she may deem advisable for his or her sole Use and

benefit. Neither party shall Interfere with the uses, ownership, enjoyment or disposition
of any property now owned and not speclfled herein or property hereafter acquired by
the other.
4. The consideration for this contract and agreement Is the mutual benefits
to be obtained by both of the parties hereto and the covenants and agreements of each
of the parties to the other. The adequacy of the consideration for all agreements herein
contained Is stipulated, confessed, and admitted by the parties. and the parties Intend

to be legally bound hereby.
5. DEBTS: It Is further mutually agreed by and between the parties that the
debts be paid as follows:
A. The HUSBAND shall assume all liability for and pay and

Indemnify the WIFE against any of his Individual debts.
B, The WIFE shall assume all liability (or and pay and

C, The parties agree that they have no other JQlnt obligations

6. Except as herein provided, the parties agree lhatthey have previoUsly
divided their personal property to their mutual satisfaction. No payment shall be made
by either party to the other as a result o( the division of property contained herein. The
partleo agree that this division Is (air and equitable, and is voluntary and made without
duress by or upon either party. The parties (urther agree that henceforth, each of the
parties shall own, have and enjoy Independenl/y of any claim or right of the other party,
all Items of personal property of every kind, nature and description and wherever

situated, which are now owned or held by or which may hereafter belong to the
HUSBAND or WIFE, with full power to the HUSBAND or the WIFE to dispose of same
as fully and effectually, in all respects and for all purposes as if he or she were
unmarried. The following division of specific Items of personal and real property will be
equitably distributed as follows:
A. REAL ESTATE: HUSBAND agrees to release to WIFE his Interest
In the marital home a~ 217 Maple Lane, Mechanlcsburg, Cumberland County,
Pennsylvania 17055 and shall execute a deed conveying his Interast thereon to
WIFE. Said deed shall be held In escrow by HUSBAND's attorney until' such
time as WIFE obtains either refinancing of the parties' Joint mortgage or
HUSBAND's release by the lender (rom all obligations thereunder.
B.
PERSONAL PROPERTY:

1,) Motor Vehicles - The HUSBAND heraby releases to WIFE
the 1990 Ford TaUNO and WIFE hereby releases to HUSBAND the 1968
Ford Bronco and the 1978 Ford plok-up truok.
2.) Bank Accounts - Each party shall retain tholr respeotlve
Individually held checking and savings accounts free of any claim by the
other party.
3.) Employee Benefit and Retirement Plans. Except as
provided elsewhere In this agreement, each party shall retain all of their
own employee benofll, savings and/or retirement plans, annuity accounts,
401 K's and IRA's and the proceeds thereof, free of any claim by the other
party.

4.) Other personal property. The parties agree that they have
divided all of their remaining personal property, Including, but not limited
to furniture, household goods, appliances and personal belongings to their
mutual satisfaction and each release to the other all such personal
property as now divided, except that WIFE agrees that HUSBAND shall
also be entitled to those Items listed In the attached Exhibit "A",
In'corporated herein by reference.
7. CASH PAYMENT: In consideration of the division of assets and debts as
contained In this agreement, and In order to provide a more equitable division thereof to
WIFE, HUSBAND agrees to pay to WIFE the sum of $19,734.71, said sum to be
transferred to WIFE by means of a non-taxable rollover from HUSBAND's Quick &
Reilly IRA to WIFE's IRA pursuant to a Qualified Domestic Relations Order (QDRO), If
necessary, said QDRO to be prepared by WIFE's attorney at WIFE's expense,
HUSBAND will cooperate by promptly providing any and all information required to
prepare the QDRO or authorizing WIFE's attorney to obtain such Information. In the
event that a non-taxable rollover from thlo account to WIFE's account can be
accomplished wllhout a QDRO, HUSBAND will cooperate In signing whatever
documents are required to effect the transfer.
6. INCOME lAX RETURNS: All Income tax returns for tax years 1996 and
beyond will be med oeparately and the parties will each retain any refund due to them.
9. $UPPORT ANQ ALIMONY: Both partleB hereby waive and forego all
Ilnanclal and material spousal support from each other and agree not to request or seek
to obtain alimony, alimony pendente lite or spousal support before or after any divorce
which may be granted. WIFE agrees that HUSBAND's current spousal support
obligation shall be and Is hereby terminated by the execution of this agreement and
agrees to Immediately notify the Cumberland County Domestic Relations Office to

paid in full.
10. DIVORCE: The parties both agree to cooperate with each other In
obtaining a Ilnal divorce of the marriage. It Is agreed that the marriage Is Irretrievably

broken and that more than ninety days has expired since the date of service of the

divorce complaint. Accordingly, simultaneously with the execution of this agreement,
the parties will execute and Ille the consents and waivers necessary to obtain the
divorce. WIFE's attorney will me all necessary Ilnal documents, together with a
praecipe to transmit .the record, In a timely manner. Both parties will be responsible for
their own legal costs and fees Incurred In this divorce.
11. BREACH: In the event of the breach of this agreement by either party,
the nonbreachlng party shall have t~e right to seek monetary damages for such breach,
where such damages are ascertainable, and/or to seek speclllc performance of the

terms of this agreement, where sllch damages are not ascertainable. All costs,

expenses and reasonable attorney fees Incurrod by the successful party In any litigation
to obtain monetary damageo ond/or speclflc performance of this agreement shall be
recoverable as part of the Judgment entered by the court.

12. ADDITIONAL INSTRUMENTS: Each of the parties shall from time to
time, at the raquest of the othel', execute, acknowledge and deliver to the other party
any and all further Instruments that may be reasonably required to give full force and
effect to the provisions of this agreement.

13. VOLUNTARY EXECUTION: The provisions of this agreemel1t and their
legal effect have been fully expll:llned to the parties and Its provisions are fully
understood. Both. parties agree that they are executing this agreemont freely and
voluntarily. HUSBAND's legal counsel Is Harold S. Irwin, 1/1, Esquire. WIFE's legal
counsel Is Carol J. Lindsay, Esquire.
'14. ENTIRE AGREEMENT: This agreement contains the entire
understanding of the parties and there are no representations, warranties. covenants or
undertakings other than those expressly set forth herein.
15. APPLICABLE LAW: This agreement shall be construed under the laws
of the Commonwealth of Pennsylvania.
16. PRIOR AGREEMENTS: It Is understood and agreed that any and all
property settlement agreements which mayor have been executed or verbally
discussed prior to the date and time of this agreement are null and void and of no
effect.
17. . WAIVER .Qf CLAIMS AGAINST It:IE ESTATES: Except as otherwise
provided herein, each party may dispose of his or her property In any way, and each
party hereby waives and relinquishes any and all rights he or she may now have or
hereafter acquire, under the present or future laws of any Jurisdiction, to share In the
property or the estate of the other as a result of the marital relationship, Including
without limitation, dower, curtesy, statutory allowance, widow's allowance, right to take
In Intestacy, right to take against the Will of the other, and right to act as administrator
or executor of the other's estate, and each will, at the request of the other, execute,
acknowledge and deliver any and all Instruments which may be necessary or advisable
to carry Into effect this mutual waiver and relinquishment of all such Interests, rights and
claims.
