8. During Ihe summer of 1994, Ihe Bullder, on behalf of its euslomer, plaintiffs,
purchased I1I1d inslalled 52 windows and/or sliding glass doors mlUlufactured by Windsor I1I1d
dislribuled by I1I1d Ihrough its agenl, Classic, Windsor's nuthorized local distributor.

II. Plaintlllil moved Into the home during July of 1995.
12, During December of 1995, pluintlllil discovered serious window problems,
Including, intcr alia, air leakage, ulrtlnl1ltration, wuter leakage, chipping and bubbling afthe
finish and sepurotion of Ihe mllcr Joints (hercinafier "window deficiencies").
13, Plaintiffs notll1eu Winusor in December of 1995 of the window deficiencies,
14, On February 27,1996, plalntiffil met with Mike Crook, National Sales Munager
for Windsor, allhe home to discuss the window deficiencies.
15. As a result, lIll additional, alternative wealher stripping was senlto plaintiffs to be
Inslalled in the windows by Windsor.
16. Plaintiffs ugain requested Windsor 10 fix the window deficiencies or replll\:e Ihe
windows,
17. As a result, Windsor conlacled Classic and requested Classic 10 install wealher
stripping on some of the plalntifTs' windows 10 detennlne if the weather stripping would repair

19. On June 13, 1996, Windsor sent Jeff Simpson, Producl Engineer, accompanied by

stripping.

indicates all of the air in this home musl be healed from the outdoor air

Infrared scanning and visual Inspection ofthls home revealed the following'
deficiencies In the thermal envelope:
l. Thc drywall Is not sealed to the top plates and somc plates are not
Instlllled In the attic, Tills results in cold lntcrfor walls, as well as
Increased heat loss. The heat loss 15 a direct cause of Ice problems on
the roof.
2, Two open plumbing chases from the attic resulting In increased air
infiltration,
3. Seven open soffits rcsulting In increased air infiltration.
4, Air infiltration through recessed lights In the attic,
5. r.:eakage from around window frames.
V. Conclusions and RecommendatlQns
To improve the overall comfort and energy efficiency of this home, the air
infiltration should be reduced and convective heat loss should b6 minimized. ThIs
can be accomplished by completing the following energy conservation measures:
A. Selll the top of all interior walls from the attic.
B. Box and seal all accessible recessed lights from the attic.
C. Modify or replace all windows to reduce air infiltration.
Completion of these measures will improve comfort plus provide a financial
payback period of under four years.

This letter is written as further to my prior correspondence concerning the ongoing
problems of Mr. and Mrs. PhllUps with their Windsor windows. Since your last remedlnl work
to the senls was completed In the spring of 1996, a need existed to review the perfonnance in
a more severe cUmate condition, This has now occurred,

An energy efficiency audit has been completed on the home by an entity known as EIC,
Inc. This audit Included a 'caUbrated blower door test (following ASTM procedures), infrared
scanning, and visual inspection. After making all other corrections which other construction
problems might have required, they still found that !be home had approximatefy ,42 natural air
changes per hour. this exceeds the ,35 rate recommended by the American Society of Heating,
Refrigeration and Air Conditioning Engineers, Their infrared scanning has depicted continued,
significant leakage at all windows in the house. The recommendation of this company is to
modify or replace all windows to reduce air infiltration,
In addition 10 air. leaks, problems with the seals continue to evidence itself by air-born
dirt and tanbark, Further, water has now begun to leak In at the windows In the kitchen and
family room, this has caused damage to the ceilings, which they had to have repaired by a
local builder. While an allempt to reseal the windows to prevent leaking was taken, the water
leakage continues.'
Finally, another problem with the windows has developed with J!1~, exterior finish and
miter joints. The paint Ls chipping and bubbling, as well as s~PQrating at miter joints, Sample
photographs of same are Included here,wlth for your review. This is extraordinary for windows
the age of the Phillips' home.

Defendant classic in that said allegations fail to set forth any
oontract between Plaintiffs and Defend~nt Classic and, therefore,

a cause of action under the Pennsylvania Unfair Trade Practice
