1. The Plaintiff Nora E. Ll!pold Is an adult Individual with an address of 5029 East
Trlndle Road, Mechanlcsburg, Pennsylvania,
2, The Defendant Terry Eugene Chestnut Is an adult Individual with an address of
16 East Coover Street, Mechanlcsburg, Pennsylvania,
3, At all times relevant herein, the Plaintiff was the owner and operator of a certain
1993 Plymouth Voyager,
4, At all times relevant herein, the Defendant was a co-owner with Joan R,
Chestnut of a certain 1997 Chevrolet Astro,
5, On June 27, 1997, at or about 7:00 a,rTl" the Plaintiff was laWfully proceeding In
an easterly direction on Trlndle Road, Hampden Township. Cumberland County,
Pennsylvania, approaching the Intersection of Railroad Avenue and Trlndle Road,
6, On the aforesaid date and at the aforesaid time and location, the Defendant
who had been approaching Trlndle Road failed to yield the right of way coming out of a
stop sign for traffic on Railroad Avenue and drove Into the side of the Plaintiffs vehicle,

7. The oarelessnesfI, recklessness and negllgenoe of the Defendant was the sole
cause of the collision In that he failed to:
a) see the Plalntlffa vehicle as It was approaching the Interseotlon of Railroad
Avenue with Trlndle Road;
b) yield to the Plalntlffa vehicle which had the right of way as It approaohed the
Interaeotlon of Railroad Avenue with Trlndle Road;
c) avoid striking the Plalntlffa vehicle;
d) struck the Plaintiffs vehicle;
e) violated 75 Pa. C.SA ~ 3323; and
f) waa otherwise negligent.
B. Solely as a result of the carelessness, reckleasness and negligence of the
Defendant, the Plaintiff suffered severe and sundry Injuries to her person Including but not
limited to aggravation of a pre-existing temporomandibular Joint dysfunction (TMJ)
condition, concussion, post-concussion syndrome. soft tissue Injuries with bruising,

lacerations, and swelling,
9, Solely as a result of the carelessness, recklessness and negligence of the
Defendant, the Plaintiff has suffered the Jollowlng damages recoverable at law:
a) past and future pain and SUffering
b) past and future emotional distress
c) past and future loss of enjoyment of life
d) past and future wage loss

IN REI PRETRIAL CONFERENCE
A pretrial conference was held on Wednesday, January
13, 1999, before the Honorable Edward E. Guido, Judge. Present
for the Plaintiff was David W. Knauer, Esquire, and present for
the Defendant was Drew Gannon, Esquire.
This is an automobile accident in whioh the Defendant
has conoeded negligence. He has not oonceded that the
negligenoe is a oausal factor in bringing about the injuries
complained of by the plaintiff. This case should take two to
three days to try before a jury.
Defense counsel has raised the issue of lack of proper
notice with regard to the seizure disorder being olaimed by the
Plaintiff to have been caused by the accident. If the Plaintiff
proceeds to trial this term of court, she will be precluded from
eliciting any medical testimony with regard to the accident
having caused a seizure disorder.
If she wishes to present Buch testimony, this case
will be continued, at Plaintiff's option, to the March term of
court. ~n said event, Defendant will be given until Friday,
February 19, 1999, to conduct an IME and provide a copy of said

report to Plaint~ft within five days atter the IME is completed.
Plaihtiff shall notity this Court and defense counsel by Friday,
January 15, 1999, if she requests that this matter be continued
to the March term of court under theso conditions.
The parties have agreed that Defendant may conduct a
discovery deposition of Dr. Boaudry who will be appearing live
at trial. Plaintiff's counsel shall make arrangements with Dr.
Beaudry to make himself available for said discovery deposition
before Wednesday, January 27, 1999. Detense counsel shall also
make Defendant available for a deposition by said date.
The parties agree to stipulate as to the authenticity
of the medical records so that nobody need be brought from the
hospital to testify thereto. They reserve any objection to the
admissibility of any portion of the record on other evidentiary
grounds. The parties also stipulate to the admissibility of the
standard U.S. life tables contained in the standard jury
instruotions for the purposes contained therein.
The Plaintiff has demanded $100,000.00, The Defendant
has offered $10,000.00. Settlement is unlikely.

, STA TEMENT OF THE BASIC FACTS AS TO LIABILITY:
On June 27,1997 at or about 7:00 A,M" the Plaintiff Nora E, Lupoid was
proceeding In an easterly direction on Trlndle Road. Hampden Township, Cumberland
County, At the same time as the Plaintiff was traveling In a easterly direction on Trlndle
Road, the Defendant Terry Eugene Chestnut was traveling In a northerly direction on
Railroad Avenue, Hampden Township, Cumberland County,
At the Intersection of Trlndle Road and Railroad Avenue, the Defendant failed to
stop at the stop sign for traffic entering trlndle Road from Railroad Avenue and
broad sided the Plaintiffs vehicle, The force of the collision caused. the Plaintiffs vehicle
to roll over several times,
The Defendant has stipulated to liability,
STA TEMENT OF THE BASIC FACTS AS TO DAMAGES:
During the accident, the Plaintiff who was wearing her seat belt broke the,

windshield with her head which embedded glass Into her scalp, lost consciousness,

(5) By letter dated October 20, 1996, defense counsel requested the Plaintiff not
to list the case for trial because the Defendant wished to file summary Judgment motions;

(6) After the Defendant failed to file any motions for summary judgment, by letter
dated November 17, 1996 Plaintiffs counsel Informed defense counsel that If the

Defendant failed to file any motions for summary Judgment prior to December 7, 1996,
the last day to list the case for the January 1999 Term of Court, that the Plaintiff would
list the case for trial.
(7) The Defendant failed to file any motions for summary judgment and the
Plaintiffs counsel listed the case for the January 1999 Term of Court;
(6) For the first time, the Defendant at the call of the list objected on the basis that
the Plaintiff haa not answered the Defendant's discovery;
, (9) As aforesaid, the Defendant had Plaintiffs authorization to obtain her medical
records on or about April 15, 1999 and did In' fact obtain Plaintiffs medical records;
(10) Prior to the date of the pre-trial conference the Plaintiff has prOVided the

(1) The Defendant deposed the Plaintiff on March 25, 1998,
(2) The Defendant requested the Plaintiff to consent to execute medical releases
for the Defendsntto obtain her medical record,
(3) By lelter dated April 15, 1998, Plaintiffs counsel provided the executed

(4) By lelter dated May 11, 1998, Plaintiffs counsel Informed the Defendant that

personality and emotion,ll asscssmcnts.
Results from Scptcmber IS, 1997 neuropsychological evaluation Indicated a gencrally strong but
variable cognitive profilc that includcd a fcw, selcct areas of significant impairmcnt. Severe
impairments were found within perceptual organization (c.g.,'how the brain intcgratcs visual
detail into a mcaningful wholc) and logical dcduction (c.g" the ability to Icarn and problcm.solve
in a new silliation with fcedback). Mild impairmcnts werc found within complcx visuulmemory
(e.g., rcmembering non.verbal information sueh as geomctric figures after a 30.minute delay)
and semantic verbal fluency (e.g., the ability to gcncratc words that belong to a certain category
such as "animals" within a one.minutc time frame).
Areas of low average performance wcre also identificd in parallel processing speed (e.!!., the
ability to prucess multiple bits of information in an efficient manner), auditory and visual

estimated to be in avcragc ranges. Inforn]l\lion rcgardlng mcdicul, academic, und psychosocial
histories would not aCCOlll1l for the discrepuncies inncurocognitivc pcrformancc. Information
obtaincd regarding thc accident such us dazing and dizziness immediutcly lifter the accldcnt, a
obvious striking of the head (e.g., "hole" in thc windshield), contusion to left frontal region of
head. post-traumatic headache, post-traumatic cognitivc changcs, und thc nature of the accident
itsclf coupled with results lromthis cvaluation clcarly indicate that a mild traumlllic brain injury
was acquired and causally dne to Junc 27, 1997 motor vehiclc accident.
Rccommendntions for this individual includcd psychothcrupy and ncurobehuvioralmanagcmcJ11
for thc managcmcnt of pain. This would involvc individual wcekly scssions at one to two-hour
sessiOnS, for upproximatcly tWelVC wceks. Estimatcd cost for this service \vould rangc from
$1440.00 to $2880.00 based upon trcatment cost of$110.00 per hour.
Subsequent to managemcnt ofpai.n and depressiOn. participation in a cognitivc rchabilitation
program was rccommended, especially to addrcss visual dysfunction. This would involve
weekly sessions at one to two-hour sessions for'approximate1y cight weeks. Estimated cost for
this service would range from $960.00 to $1920.00 based upon treatment cost of $120.00 per
hour.
Other rccommendations includcd continued neurologic asscssment in order to rule-out post-
truumatic seizure disordcr. I am not aware of the cost of those neurologic services. That
inlormation would need to be obtained from Ms. Lupoid's ncurologist.
Prognosis regarding cognitivc and cmotional functioning appears favorablc givcn the patient's
