COMPLAINT
AND NOW oomes the plaintiff, Noble produots, Ino.,
t/d/b/a 200 Piks International, by and through its attorneys,
Friedman and Friedman, P.c., and brings this cause of aotion
against the Defendant and avers as folloWSl
1. The Plaintiff, Noble Products, Inc., t/d/b/a 200
Pike International, is a Texas corporation with a business
address of 3809 Pipestone Road, Dallas, Texas 75212, and is
engaged in the business of selling plastic novelty items.
2. The Defendant, Gingerbread Man, Inc., is a
pennsylvania oorporation with a business address of 114 E. Allen
street, Mechanicsburg, Cumberland County, Pennsylvania 17055.
3. On or about December 7, 1993, the Plaintiff entered
into an oral contractual agreement with the Defendant, whereby
the Defendant agreed to purchase plastic stirrers and plastic
picks on an "ongoing" basis for. the Defendant's use in its
restaurant/bar businesses. A copy of the initial purchase order
from the 'Defendant to the Plaintiff is attached hereto, marked
Exhibit "A", and incorporated herein by reference.
4. on or about April 28, 1995, the Defendant did
order, and the plaintiff did ship, thirty-six (36) cases of
Gingerbreftd Man stirrers, and thirty-two (32) cases of
oingerbread Man picks, said shipment being made to the
Gingerbread Man, ATTNI Sherry, 114 E. Allen street,
Mechanicsburg, Pennsy1,vania 17055.
5. The total charge for the items purchased, which was
agreed to by the parties, was $7,378.92 for the stirrers ($204.97
per caso) and $8,832.00 for the picks ($276.00 per case).
6. Under the terms of the contractual agreement
between the parties, the Defendant agreed to pay shi.pping
charges, which were incurred in the amount of $389.58.
7. Under the terms of the contractual agreement
between the parties, as memorialized on the invoice form utilized
by the Plaintiff throughout the relationship between the parties,
the Defendant ~greed to a late payment charge of 2% per month or
the maximum amount allowed by pennsylvania state law, if less, to
be applied to the balanoe owed under the invoice when invoioe
becomes due. The invoice form is attached hereto, marked Exhibit
"B", and incorporated herein by reference,
8. Under the terms of the contractual agreement
between the parties, as memorialized on the invoice form utilized
by the Plaintiff throughout the relationship between the parties,
the D~fendant agreed to pay all of the Plaintiff's reasonable
attorney's fees incurred. in the collection of any amount owed
hereunder and not paid when due. The invoioe form is attaohed as
Exhibit "B".
9. An invoioe WIlS issued by the Plaintiff in the
above-referenoed transaotion on April 2B, 1995, terms net 15
days. See Exhibit "B".
10. subsequent to the issuanoe of the invoioe, payments'
were made by the Defendant to the Plaintiff in the following
mannerl

11. There remains due and owing by the Defendant to the
Plaintiff a principal amount of $11,029.00. .
12. Despite demands, the Defendant has refused, and
oontinuesto refuse, to make any further payment to plaintiff.
13. At no time has the Defendant raised any issue
regarding the quality of items reoeived from Plaintiff.
VERIFICATION
'I, Nathan Long, hereby aoknowlodge that I am an agent
for the Plaintiff in the foregoing aotion, that I have read the
foregoing complaint, and the faots stated therein are true and
correct to the best of my knowledge, infurmation and belief.
I understand that any false statements herein are made
subject to pen~lties of 18 Pa. c.S. seotion 4904, relating to
unsworn falsifioation to authorities.
