Present for the Plaintiff, Jason Allgyer is
attorney Austin F. Grogan, and present for the Defendant,
Jacalyn Allgyer, is attorney Wayne F. Shade.
A divorce complaint was filed on November 19, 1997,
raising grounds for divorce of ir.retrievable breakdown of the
marriage. The parties will sign affidavits of oonsent and
waivers of notice of intention to request entry of divorce
decree so that the divorce can be concluded under section
3301(c) of the Domestic Relations Code.
On June 5, 1998, the Plaintiff filed an amended
complaint raising the economic claim of equitable distribution.
No other economic issues have been raised.
The parties were married on January 7, 1995, and
separated, according to husband, in. early November and according
to wife, in mid-November 1995. They are the natural parents of
one child, Kaitlyn, born April 30, 1995. The parties share
joint physical custody of the child.
Husban~ is 25 years of age and resides at 1428
Bradley Drive, J212, Carlisle, Pennsylvania, where he lives
alone. He has a Bachelor of Science Degree from Penn State
University and is a manager at a ponderosa Steak House, a
subsidiary of Mid-Atlantic Restaurants, Inc. He started working
full-time for the restaurant in the summer of 1995 following
graduation from college. His income, based on the support order
entered February 22, 1998, is $1,466.58 net monthly. He is
currently paying child support in the amount of $150.00 per
month and alimony pendente lite in the amount of $173.00 per
month. Husband has not raised any health issues.
Wife is 23 years of age and resides at 379 Whiskey
Run Road, Newville, Pennsylvania, where she lives with her
sister.. Wife is a high school graduate and works in retail
sales. She had a job with Fashion Bug and counsel are of the
opinion that she may be changing jobs and going into a
telemarketing position. In any event, the support office
computed her net monthly income on February 22, 1998, at
$741.60. Wife has not raised any health issues.
The parties own a condominium at 428 Bradley Drive,
J212, carlisle, Pennsylvania. Husband has provided an appraisal
from Reynold R. Woof, Jr., dated May 8, 1998, showing a market
value of $49,500.00. Mr. Shade, on behalf of wife, has provided
an appraisal by Larry Foote as of August 12, 1998, showing a
market value of $53,600.00. The Master has advised the parties
that his rule of thumb, if the deviation between the appraisals
is 5% or less, is that he will average the two appraisals. The
property is subject to a mortgage in favor of Financial Trust.
The mortgage payoff is around $49,000.00. One of Mr. Shade's
conditions in settling the case is that wife be removed from the
obligation on the mortgage.
Husband apparently is participating as a result of
his employment with Mid-Atlantic Restaurants, Inc., in a pension
and deferred savings plan. According to Mr. Grogan, his
client's participation in these plans would not have begun until
a year following his full-time employment which started in the
summer of 1995. In any event, Mr. Shade has requested a copy of
the statements of the plans showing when the participation began
and showing the value, if any, around the time of the
separation. Also, Mr. Shade has requested information, if any,
on any IRAs which husband may have.
At the time of separation, husband had a checking
account with Financial. Trust company and Mr. Grogan is going to
provide a copy of that statement so we can determine the amount
of money in that account in November 1998. Wife had an account
at Members 1st Federal Credit Union and counsel have stipulated
that the value in that account, around the time of separation,
was $3,000.00. We note that because the parties have a
different version of the exact time of separation we may have to
adjust the value in the accounts, which is how counsel arrived
at the stipulation on wife's Members 1st account.
The parties received three shares of McDonald's
Corporation stock as a wedding gift and the value of that stock
would be marital and subject to distribution. Counsel can
provide the updated value of those shares at the time of the
hearing.
Both of the vehicles involved in this case are
nonmarital. Mr. Shade has pointed out that he believes that
husband has a new Jeep Grand Cherokee vehicle which is free and

7. Divorce Is Bought pursuant to the provisions of the Divorce Code, Sections
3301(c) and 3301(d), in that:
a) The marriage is Irretrievably broken;
b) Plaintiff 11IId Defendant have lived separate mId apart since November
1995 and continue to do so.

hereof shall be the sole and separate property of Wife. Each of the parties does hereby
specifically waive, release, renounce and forever abandon whatever claims, if any, he or she
may have to the sole and separate property of the other.
