HomeMy WebLinkAbout03-0222 STIPULATION AGAINST LIENS THIS AGREEMENT made this /~ day of ~.~, -- 2002, by and between CUMBERLAND DESIGN & BUILDING COMPAN~ INC., a Pennsylvania Corporation, hereinafter referred to as Contractor, HOPE KOREAN UNITED METHODIST MISSION CHURCH, hereinafter referred to as Owner, whereby the contractor undertook and agreed to erected and construct a dwelling on the certain lot of ground situate in Cumberland County, Commonwealth of Pennsylvania, and more fully described in Exhibit "A" which is attached hereto and made a part hereof known as 321 S. Sporting Hill Road, Mechanicsburg, PA 17324. NOW THEREFORE, THIS AGREEF~NT WITNESSETH: That the said Contractor, for an in consideration of the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for itself, himself or themselves and its, his or their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic,s liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or' '0n account of any work done or materials fuL~nished by them 0r any 0f them under said contract or otherwise, for, towards, in, or abbu t~e erection and construction of th .... ~ ...... · ' t ~ ~escrl~ed, and the said Contra~t~uf~l~ln~ on. the lot ~=,,,sezves, 1ES, his or th=~ ~..m-^-=-- ~ ' u~.znse±z, himself or hereby expressly waive and relinquish the right to have, file, and ~ o~=u~uzacuors anG others under them, maintain any mechanic,s liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. Weitzel and/da M. Weitzel, his mother; thence along said land, North 89 degrees 45 minutes East, three hundred (300) feet to a post; thence by land now or formerly of Harry M. Weitzel and Mildred E. Weitzel, his wife, South 0 degrees 17 minutes West, eighty-five (85) feet to a stake; thence by the same, South 89 degrees 45 minutes West, three hundred (300) feet to a point in the center of the aforesaid road; thence by the center line of said Road North 0 degrees 17 minutes East, eighty-five feet (85) to the place of Beginning, being improved with a 1 ½ story frame dwelling numbered and known as No. 301 Sporting Hill Road, Mechanicsburg, PA.
