Pierce, Cumberland County Co Mr. Chad Billy . , I , to rent apartment 60 College Park Apartments, Shippensburg, PA, Building "0" for term commencing May 17, 1997 and ending on the earlier of (il May 15, 1998 or (iil the date of May 1998 Shippensburg University graduation. The rent for the term was $8,280.00 payable quarterly at the rate of $2,070.00 with a one month security deposit. A copy of said lease is attached hereto, marked Exhibit "A" and made a part hereof by reference thereto. 4. By addendum dated May 7, 1997 your Defendant, Chad Billy, fully agreed to replace Scott Strum on the lease to apartment number 60 and fully agreed to the terms and conditions 5. By virtue of the provisions of said lease the tenants, of said lease. A copy of said addendum is attached hereto, marked Exhibit "B" and made a part hereof by reference thereto. your Plaintiffs and the Defendant, would be responsible for all utilities with the exception of water, sewer and trash removal. 6. The Defendant never moved into the apartment and never made any attempt to pay his rent which only came to the knowledge of your Plaintiffs due to a notice given September 16, 1997. A copy of said notice is attached hereto marked Exhibit "C. and made a part hereof by reference thereto. 7. By letter dated October 3, 1997, your Plaintiffs sent notice to the Defendant, Chad Billy, with regards to his back due rent, security deposit and the late fee. A copy of aaid letter is attached hereto, marked Exhibit "D", and made a part hereof by reference thereto. 8. Despite repeated demands from Plaintiffs and from landlord, your Defendant failed and refused and continues to fail and refuee to accept any responsibility for rent p~rsuant to the lease or for any utilities incurred by the three remaining tenants, your Plaintiffs herein. 9. The total rent due by your Defendant is $172.50 per month to date. Your Defendant paid the first quarter rent of $517.50 however, he has not paid the second quarter rent due August 1, 1997 nor the third quarter rent due November 1, 1997 and your Plaintiffs believe and aver that Defendant will not pay his fourth quarter rent due February 1, 1998 in the amount of $517.50. Your Defendant thus at present owes $1,035.00 for the second and third quarter rent plus and will owe an additional $517.50 for the fourth quarter rent due February 1, 1998. 10. Your Plaintiffs have been assessed and have paid a late fee of $50.00 due to Defendants failure to pay the second quarter rent due August 1, 1997 which your Plaintiffs have paid on behalf of your Defendant in addition to the security deposit of $172.50 which they have also paid on behalf of your Defendant. 11. Your Defendant has also not reimbursed your Plaintiffs for the utilities for electric, telephone and for cable at the rate of $53.97 per month based on the lowest monthly bills and connection fees as more fully set forth on the attached schedule marked Exhib~t "En and made a part hereof by reference thereto. 12. Despite repeated demands from the Plaintiffs your Defendant failed and refused and continues to fail and refuse to pay any additional sum either to the Plaintiffs or to the landlord thus obligating your Plaintiffs to the landlord for said sums. The Defendant in July of 1997 was advised by Shippensburg University that his application for admission was rejected, Immediately upon receiving notice of his rejection, Defendant told the Plaintiff, Brad Krajsa, that he would not be attending Shippensburg University and therefore, he would not be moving into the apartment leased by the Plaintiffs and Defendant. He advised the Plaintiff Krajsa that he would attempt to find another tenant to take his place on the lease, 7, Admitted in part and denied in part. It is admitted that the Plaintiffg forwarded the October 3, 1997 letter to the Defendant. The Defendant denies that he was obligated to pay the rental and late fee charges as set forth in the said letter for the reasons more fully explained in Defendant's New Matter. S, Admitted in part and denied in part. It is admitted that the Plaintiffs have made demand upon the Defendant for the payment of rental. It is denied that the Defendant is responsible for the payment of the rent and utilities as alleged by the Plaintiffs, As more fully set forth in the following New Matter, the Defendant avers that he is nol responsible for the payment of the rent in that the Plaintiffs failed to mitigate their damages, 9, Admitted in part and denied in part. It is admitted that the Defendant paid the first quarter rental but it is denied that the Defendant is obligated to pay rent for thl; remainder of the rental tenn as more fully explained in Defendant's New Matter. 10, Denied. After reasonable investigation, the Defendant is without knowledge or information sufficient to fonn a belief as to the truth of the avennents of paragraph ten (10) and proof thereof is demanded at trial. 2 II. Venied, The Defendant denies that he is mponsible for the payment of the utilities as alleged by the Plaintiffs in paragraph eleven (II) for the reasons set forth in the following New Matter, 12, Denied. The Defendant denies that he IS responsible for the payment of any rental or utility charges as alleged by the Plaintiffs for the reasons set forth in the following New Matter, NEW MA TIER 13, The avennents contained in paragraphs one (I) through twelve (12) of this Answer are incorporaled herein by reference thereto, 14, The Defendant in July of 1997 was advised by Shippensburg University of the rejection of his application for admission to the university. IS, The Defendant, immediately upon receiving the notice from Shippensburg University, notified the Plaintiffs that he would not reside with them at 60 College Park, Shippensburg, Pennsylvania during the .1997-98 school year. 16, The Defendant in July, 1997 contacted the manager and rental agent for JAL College Associates (the Landlord) and advised the manager that he would not be attending Shippensburg University and therefore, he would not be residing with the Plaintiffs at 60 College Park, Shippensburg, Pennsylvania, 17. The Defendant was advised by the manager of JAL College Associates that it was his obligation to obtain a substitute tenant. 18, The Defendant placed an advertisement in the News-Chronicle, a newspaper 3 of general circulation in the Shippensburg, Pennsylvania area, on Augusl 4, 1997 and August 7, 1997 advertising the availability of a rental opening of the Plaintiffs' apartment located at 60 College Park, Shippensburg, Pennsylvania, A copy of Ihe invoice of said advertisement in the News-Chronicle is attached hereto as Defendant's Exhibit" A" and incorporated herein by reference thereto, 19, The Defenciant avers that on or about August 5, 1997 or August 6, 1997, he received a response to the advertisement from a Mr. David Melling who advised the Defendant that he was interested in replacing the Defendant on the lease to apartment nwnber 60, 20. The Defendanl provided Mr. David Melling with the telephone nwnber and names and addresses of the Plaintiffs and advised Mr, Melling to contact them, 21. On or about Augusl 7, 1997 or August 8, 1997, Defendant was advised by David Melling that he had spoken with the Plaintiff, Chris Gormley, and that he was assured that he could move into the apartment. 22. The Defendant avers that on or aboul August 7 or 8, 1997, he was advised by David Melling 10 send a letter to the landlord advising the landlord that Mr. Melling was going to take over Defendant's responsibility on the lease. The Defendant immediately forwarded a letter to Valerie Griffin dated August 1 I. 1997, A copy of said letter is attached hereto as Defendant's Exhibit "8" and incorporated herein by reference thereto. David Melling also advised the Defendant that Chris Gormley and the other Plaintiffs were going to send letters to the landlord advising the landlord that David Melling was 4 taking over the Defendant's responsibility under the teons of the; lease. 23, The Defendant avers that subsequently the Plaintiffs, without notifying the [)l:fr.ndant, advised Mr, Mel1illg that they would not rent the vacancy to him, 24, The Defendant avers that he was never advised by any of the Plaintiffs thai they had not rented the vacancy to Mr, David Melling. In August and September, 1997, the Defendant was under the assumption that he was no longer responsible for the lease in that his vacancy had been rented to David Melling. 25, The Defendant avers that the Plaintiffs did not notify him that the property was not rented to David Melling. The Defendant only discovered this fact when he received a telephone call from the Plaintiffs during the week of September 1 {i, 1997, and the subsequent letter of Plaintiffs dated October 3, 1997 which is referred to in paragraph seven (7) of Plaintiffs' Complaint and attached to Plaintiffs' Complaint as Exhibit "0". 26, The Defendant avers that the apartment at 60 College Park, Shippensburg, Pennsylvania is a three bedroom apartment. 27, The Defendant received a telephone call from the Plaintiffs during the week of September 16, 1997 advising him that they had received a notice to quit and that the Plaintiffs had not pennitted David Melling to rent the apartment. The Defendant avers that this was the first time that he was advised that the Plaintiffs had refused to rent the property to David Melling, even though the Plaintiffs on previous occasions had ample opportunity 10 contact the Defendant and advise him that they did not accept David Melling as a tenant. 5 28, The Defendant avers and believes that he is not liable for the rental and utility charges for the second, third and fourth quarters because he had obtained a party to assume his vacancy and responsibility under the lenns of the lease ab'Teement. 29, The Defendant avers that Plaintiffs are solely responsible for the payment of the rental under the tenns of the lease agreement because they failed to mitigate their damages by accepting David Melling as a tenant. 30, The Defendant avers that the Plaintiffs would have incurred no damages if they would have rented the vacancy 10 David Melling, WHEREFORE, Defendant requests that Plaintiffs' Complaint be dismissed. Plaintiffs admit that they called Defendant sometime around the week of September 16, 1997 advising him that they had received a notice to quit and that the Plaintiffs had not permitted David Melling tG rent the apartment due to Mr, Mellings refusal to share proportionately the expenses of the 6 apartment, With respect to the remaining averments, Plaintiffs specifically deny that this was the first time that Defendant was advised that the Plaintiffs could not rent the property to David Melling due to his request to be given a partial free ride and Plaintiffs specifically deny that they had ample opportunity to contact the Defendant advising that they did not accept David Melling as a tenant, By way of further answer, Plaintiffs aver that it was the Defendant's responsibility to keep himself apprised of the lease situation, since he was the one who had signed the lease and he was the one who needed relief. 28. Plaintiffs specifically deny that Defendant is not liable for the rental and utility charges for the second, third, and fourth quarters because he had obtained a party to assume his vacancy and responsibilities on the terms of the lease agreem~nt.
