AND NOW, comes Financial Trust Company, through its attorney, William A,
Duncan, Esquire, and files this Complaint in Mortgage Foreclosure, of which the following is a
statement:
I. Plaintiff is Financial Trust Company, a corporation organized and existing under
the laws of the Commonwealth of Pennsylvania with its main office and principal place of
business located at 1 West High Street, Carlisle, Cumberland County, Pennsylvania 17013,
2. Defendant, Robert J Jones, an adult individual, and Defendant, Jane M,
Kelly-Jones, an adult individual, are husband and wife, and reside at 30 Wagner Drive, Carlisle,
Cumberland County, Pennsylvania,
3. On or about January 30, 1995, Defendants made, executed and delivered to
Plamtiff a note and a real estate mortgage financing Twenty-one Thousand Eight Hundred
Sixty-six and 77/100 Dollars ($21,866,77), a copy of said note and said real estate mortgage
being attached hereto as Exhibits "A" and "B", respectively, and are incorporated herein by
reference as though fully set forth,
4, Said note and said real estate mortgage have not been assigned.
5. Robert J. Jones and Jane M. Kelly-Jones are the sole record owners in fee simple

of said premises subject to said mortgage, by virtue of a Deed dated November 9, 1992 and

6, Said note and said real estate mortgage are in default because Defendants herein

have failed to pay the payments that were due and owing for the months of June 1997. July
1997. August 1997, September 1997, October 1997 and November 1997.
7. The Plaintiff has given to the Defendants written notice of intention to foreclose on
said mortgage as required by law under Act 6, dated August 18, 1997, a copy of which is
marked Exhibits "D" and "E", and attached hereto and made a part hereof by reference,
8. The Plaintiff has given written notice of default as required by the Homeowner's
Emergency Assistance Act of 1983, dated August 18, 1997. a copy of which is marked
Exhibits "F" and "0", and attached hereto and made a part hereof by reference.
9. By reason of the aforesaid default, the entire principal balance of Nineteen
Thousand Five Hundred Seventy-eight and 92/100 ($19,578.92) Dollars, with interest thereon
at the rate of 9.75 % per annum computed from June 5, 1997, life insurance rebate and
attorney's fees in the amount of Nine Hundred Thirty Eight and 21/100 Dollars ($938,21) are
now due and payable,
10. The Defendant~ are liable to the Plaintiff for the following on said mortgage loan:

thereon, costs and all other amounts advanced by Plaintiff.

Duncan, Esquire, and files this Complaint in Mortgage Foreclosure, of which the following is a
statement:
I. Plaintiff is Financial Trust Company, a corporation organized and existing under
the laws of the Commonwealth of Pennsylvania with its main office and principal place of

2, Defendant, Robert 1. Jones, an adult individual, and Defendant, Jane M.
Kelly-Jones, an adult individual, are husband and wife, and reside at 30 Wagner Drive, Carlisle,
Cumberland County, Pennsylvania,
3 On or about January 30, 1995, Defendants made, executed and delivered to
Plaintiff a note and a real estate mortgage financing Twenty-one Thousand Eight Hundred
Sixty-six and 77/100 Dollars ($21,86677), a copy of said note and said real estate mortgage
being attached hereto as Exhibits "A" and "B", respectively, and are incorporated herein by
reference as though fully set forth,
4, Said note and said real estate mortgage have not been assigned,
5 Robert 1. Jones and Jane M. Kelly-Jones are the sole record owners in fee simple
of said premises subject to said mortgage, by virtue of a Deed dated November 9, 1992 and
recorded in the Cumberland County Recorder's Office in Deed Book "Z", Volume 35, Page
181, more specifically set forth in E"hibit "e", anached hereto and made a part hereof by
reference,
6, Said note and said real estate mortgage are in default because Defendants herein

Emergency Assistance Act of 1983, dated August 18, 1997, a copy of which is marked
