PRELIMINARY OBJECTIONS TO MECHANJ<:S' LIEN CLAIM
AND NOW comes the Defendant Deborah M. Lessard, by her attorneys,
Purcell, Krug BE HaUer, who file Preliminary Objections to the Mechanics Lien Claim in
accordance with the Mechanics Lien Law of 1963, 49 P.s. 1101, et seq., as follows:
MOTION FOR A MORE SPECIFIC PLEADING
1. !i1502 of the Mechanics Lien Law requires that the Claimant file his claim
within four months after the completion of his work.
2. !i1503 of the Mechanics Lien Law requires that the contents of the claim
include the date of completion of the Claimant's work.

3. Paragraph 9 of the Claimant's claim indicates that the work was not
completed because he was notified to cease work In "late July 1997", without a
specific date.
4. Because of the time that the claim was filed, It Is Imperative that the
Claimant be speCific as to the date that the last work was completed, In order to file a
valid Mechanics Claim under the terms of the statute.
5. g1503 of the Act also requires that the party Claimant state whether he files
as a contractor or subcontractor, something that the Claimant has not done.
MOTION TO STroKE
6. The Claimant's claim Is based on a contract to provide labor and material to
the property owned by the Defendant, in return for an ownership Interest In the
premises.
7. The Claimant's claim Is not based on a contract to perform labor and
material to the Defendant's premises In return for a specific sum of money.
8. The Claimant's claim Is for the value of his services, and not for the failure to
pay an agreed upon sum.
9. As such, Claimant's claim Is not based on a contract, but Is based on a
quantum mer..ut claim. Claimant cannot base a Mechanics' Lien Claim on the
quantum meriut claim.
10. The Plaintiff's claim Is based on an orai contract to transfer real estate,
which Is barred by the applicable Statute of Frauds.
WHEREFORE, the Defendant requests this Honorable Court to strike the
Claimant's claim, or in the alternative to require a more specific claim for the reasons
set forth above.

MECHANICS' LIEN CLAIM
Claimant David S. Kretzing, by his attorneys. files this claim against the improvements
and property at 79 Green Ridge Road, Silver Spring Township, Cumberland County,
Pennsylvania, for the payment of a debt due to claimant for labor and materials furnished by
claimant in the alteration and repair of the improvements situate on said property, and in
support thereof, states as follows:
J. Clllimant is David S. Kretzig who resides at 6940 Carllisle Pike,
Mechanicsburg, PA 17055 (Mail address: P.O. Box 92, New Kingstown. PA 17072).
2. The owner of the property is Deborah M, Lessard, an adult individual, who
resides on the subject premises at the above address and more particularly hereinafter
descri bed.
3. The improvements in the property which are subject to this claim consist of a
dwelling house, bam, outbuildings and surrounding grounds, situated at 79 Green Ridge Road,
Silver Spring Township, Cumberland County, Pennsylvania (Post Office: Mechanicsburg, PA
17055). as more particularly described in the deed of Dauphin Deposit Bank and Trust
Company, Executor of the Estate of Albert R. Mumma, Deceased, Grantor, to Deborah M.
Lessard, the Grantee and owner herein, dated October 6, 1995, and recorded in Cumberland
County Deed Book 129, Page 55 I. which deed and the description therein contained are
incorporated by reference,
4. The labor and materials for which the debt is due were furnished pursuant to an
oral agreement between claimant and owner whereby claimant would furnish the labor and
materials in reliance upon, and with the understanding that, owner would at a mutually
agreeable future time permit claimant to become a permanent resident at the premises, and
that owner would at or about such time, convey to claimant an undivided percentage
ownership interest in the premises in such amount or degree as would fairly compensate
claimant for his labor and materials. but in any event, not to exceed a 50% undivided
ownership interest.
5. The labor furnished. and a description of the nature and extent of the
remodeling and/or maintenance services thus provided are sct forth in detail in Exhibit "A",
which is incorporated by reference.
6. The total fair value of Plaintiffs labor which was necessary to pcrformance of
the agreement, and which is computed in accordance with the fair and reasonable standards
prevailing in the construction industry, was in the sum of $11,880.00.
7. The total fair market value of the materials provided in performance of the
agreement, which materials were necessary to the work performed. and which fair market
value represents claimant's out of pocket disbursements for acquisition and delivery of same
to the premiscs. was $4655.08, of which $1761.54 was disbursed in 1996 and $2893.54 was
disbursed in 1997.

8. The totlll value of this claim for labor and materials is therefore in the sum of
$16,535.08.
9. The work contemplated by the agreement has not been completed because
Owner notified claimant to cease work on or about late July, 1997, and concurrently advised

claimant that she would never permit him to take up permanent residence at the premises, nor
give him an ownership interest therein.
WHEREFORE, Claimant David S. Kretzing files this claim to recover the fair value of
the labor and materials thus far furnished to Owner, and which have greatly benefitted Owner
and which have substantially increased the market value of the premises.
