AND NOW, this day of November, 1997, comes the Plaintiff by its allomey, N.
Christopher Menges, and files the following Complaint:
I. The Plaintiff is American Firearms (AFI), Inc., a Florida Corporation, who is
authorized to do business in the Commonwealth of Pennsylvania. whose principal business
address is 2455 E. Sunrise Boulevard, Suite 916, Fl. Lauderdale, Florida 33304.
2. The Defendant is Mark Hughes, an adult individual, whose mailing address is P.O.
Box 1014, Mechanicsburg, Cumberland County, Pennsylvania who owned a business know as
Apple Archery located at 1559-8 East Canal Road. Dover, Pennsyvlallia 17315.
3. On or about January 2, 1996, the Defendant, Mark Hughes sold the company know
as Apple Archery, and signed an agreement to pay and be responsible for all debts of his existing
business and operation existing on the date of selllemenl. A copy of said provisions are allached
hereto, marked Exhibit "A". and incorporated herein by reference.
3. On or about September I, 1995. the Defendant did order and place a full page
advertisment in the September issue of American Firearms Industry at the price of 51,262.25.
4. The Defendant accepted the services of the Plaintitl" as being acceptable and in the
ordinary course of business with an express or implied promise to pay therefore.

3. On or about September I, 1995, the Defendant did order and place a full page

4. The Defendant accepted the services of the Plaintiff as being acceptable and in the
ordinary course of business with an express or implied promise to pay therefore,
5. The Plaintiff maintained books of account, keeping an accurate running account
of all debits and credits for the services provided to the Defendant.
6. The Defendant still owes the Plaintiff the amount of 51,262.25, plus interest at
J.5% per month on the past due balance on said account as shown by the invoice, a copy of
which is anached hereto, marked Exhibit "B" and incorporated herein by reference.
8. Demand for payment on this account has been made on several occassions the last
demand being June 16, t 997. In spite of the demands, the Defendant has refused to pay said
balance of 51,262.25, plus interest at 1.5% per month,
WHEREFORE, Plaintitl" demand judgment against the Defendant in the sum of $1,262.25
plus interest at 1.5% per month from September II, 1995, to date of payment together with costs
of suit and anomey fees. Pursuant to Pennsylvania Rule of Civil Procedure 1021(c) in counties
having rules governing compulsory arbitration the amount claimed does not exceed the
jurisdictional amount requiring arbitration referral by local rule of the county which this was
filed.
