5. I understand that I may lose rights concerning alimony, division of

THE MASTER: Today is Thursday, October 21,

This is the date set for a Master's hearing in the
"
above captioned divorce proceedings.
Present in the
hearing room are the Plaintiff, Connie Cless, and her
counsel Samuel L. Andes, and the Defendant, Kenneth Cless,
and his counsel Michael A. Scherer.
A divorce complaint was filed on December 1,
1997, raising grounds for divorce of irretrievable breakdown
of the marriage and indignities.
Counsel have provided the Master with
affidavits of consent and waivers of notice of intention to
request entry of divorce decree signed by both parties and
dated today.
The Master will file the affidavits and
waivers with the Prothonotary. The divorce will be
concluded under Section 3301(c) of the Domestic Relations
Code.
The complaint also raised the economic claim
of equitable distribution. No other economic claims were
raised in the proceedings,
The parties were married on November 14,
1992, and separated October I, 1997.
There were no
children born of this marriage.
The Master has been advised that after
extensive negotiations this morning the parties have reached
a settlement with respect to the claim of equitable
distribution. An agreement is going to be stated on the
record which will be considered the substantive agreement of
the parties, not subject any changes or modifications except
for correction of typographical errors which may be made
during the transcription, After the agreement has been
reviewed for typographical errors, the parties and counsel
will be asked to affix their signatures by way of
affirmation of the terms of the agreement,
It is specifically noted that when the
parties and counsel leave the hearing room today, even
though the agreement is not subsequently signed, they are
bound by the terms of the agreement as stated ,on the record.
Upon receipt by the Master of the signed
agreement, the Master will prepare an order vacating his
appointment and counsel can then file a praecipe
transmitting the record to the Court requesting a final
decree in divorce. Mr. Andes.
MR. ANDES, Mr. Elicker, the parties spent
the morning negotiating and exchanging information about
assets and they have agreed to resolve all of the economic
issues which they have raised or could have raised in this
action up to now on the t.ullo'<li.n') terms:
1. Wife will retain as her separate property free of
any claim by husband, the following assets:
a) Her retirement beneflts withln the retirement plan
operated by Heavy Duty Parts, The parties have agreed that
the marital portion of those benefits have a value of
$26,251.00.
b) The benefits within her retirement plan with
Alternate Solutions, Inc, The parties have agreed that the
marital portion of those benefits is worth $205,00.
c) Wife's individual retirement account with First
National Bank of Marysville. The parties have agreed that
the marital portion of that individual retirement account
has a value of $2,955.00.
d) The 1993 Chevrolet Blazer automobile currently
titled in both names. The parties will execute and deliver
any and all documents necessary to transfer title of that
vehicle to wife alone within 15 days of the date of this
agreement. The parties acknowledge that there is no lien
against the title to that vehicle and that it has a value
for purposes of this agreement of $7,000.00.

Husband shall receive as his sole and separate
the following items and wife hereby waives any
them.
a) His individual retirement ac~ount with the First
National Bank of Marysville. The parties agree that has a
value for purposes of this agreement of $9,263.00.
b) A savings account currently registered in the
names of both parties at the First National Bank of
Marysville. The parties will excecute and deliver any and
all docments necessary to tran~fer the balance in that
account to husband with 15 days of this agreement. The
parties agree that account has a value of $1,106.00
for proposes of this agreement,
c) A certificate of deposit currently registered in
the joint names of both parties with the First National Bank
of Marysville. The parties will execute and deliver any and
all documents necessary to transfer ownership of that asset
to husband's name alone '<Iithin 15 days of the date of this
agreement. The parties agree that, for purpose of this
agreement, that certificate of deposit has a value of
$5,000,00.
d) The 1996 Chevrolet 5-10 pickup truck currently
registered in both names. The parties will execute and
deliver all documents necessary to transfer that vehicle to
husband's name within 15 days of the date of this agreement.
The parties agree that the vehicle has a value for purposes
of this agreement of $9,500,00.
e) A Honda four-wheeler recreational vehicle which is
currently titled in hu~band's name alone, The parties
agree that for purposes of this agreement, that vehicle has
a value of $2,840.00.
3. Husband's attorney is holding in an interest
bearing escrow account the sum of $64,114.00 which
represents the proceeds of the sale of the residence
formerly owned by the parties in both names. Within ten
days of the date of this agreement, husband's attorney shall
disburse those funds as follows:
a) He shall disburse $22,000.00 of those funds to
husband.
b) He shall disburse $42,000.00 of those funds to
wife,
c) Any funds remaining in the account after such
disbursements shall be distributed so that wife receives 60%
of them and husband receives 40% of them.
Upon disbursement of these funds, the account
shall be closed.
4. Wife has a certificate of deposit with the First
National Bank of Marysvllle which is certificate No. 3054515
and which has a value at the present time of $15,000.00.
Both parties acknowledge that this is not marital property
and shall and remain the sole and separate property of wife
hereafter.
5. The parties currently hold in their joint names
the title to a 1957 Chevrolet automobile. The parties agree
that the vehicle will be transferred to husband's name alone
and the parties shall execute and deliver all necessary
documents to accomplish that transfer within 15 days of the
date of this agreement.
6. The parties also own a utility trailer and a John
Deere lawn tractor which shall be and remain the separate

what the assets are and what they are worth?
MS. CLESS: Yes.
MR. ANDES: And are you satisfied with the
terms ot the settlement that we have reached with your
husband and his attorney at I just dictated it?

MR. ANDES: Are you willing to be bound by
it?

case and conclude a divorce on those terms?

MR, SCHERER: Ken, you've also been present
with me this morning and have reviewed the marital assets,
and are you comtortable that you have full knowledge of all
of the assets in this case?
MR, CLESS: Yes.
MR, SCHERER: And you've been present for the
agreement that Mr. Andes dictated; is that correct?
MR, CLESS: Yes.
MR, SCHERER: Do you understand it?

that agreement that was dictated by Mr. Andes?

cannot be changed in any way?

I acknowledge that I have read the above
stipulation and agreement, that I understand the terms of
settlement as set forth herein, and that by signing below I
ratify and affirm the agreement previously made and intend
to bind myself to the settlement as a contract obligating
myself to the terms of settlement and subjecting myself to
the methods and procedures of enforcement which may be
imposed by law and in particular Section 3105 of the
Domestic Relations Code.

dated October 23, 1998, the full-time Master has been appointed
in the above referenced divorce proceedings.
The motion for appointment of Master was signed by
attorney Andes, I am sending him a courtesy copy of this
letter. Mr, DeArmond is counsel of record; he has not filed a
praecipe withdrawing his representation of the Plaintiff nor has
Mr. Andes entered his appearance.
The divorce complaint was filed on December 1, 1997,
raising grounds for divorce of irretrievable breakdown of the
marriage and indignities. I am going to proceed on the basis
that the parties will either sign affidavits of consent or have
been separated for a period in excess of two years so that
grounds for divorce are not an issue. If I am incorrect in that

personal property which are now presently in the posses ion

equitable distribution of marital property, any claim to
alimony, alimony pendente lite or counsel fees and expenses,
9. Except as herein otherwise provided, each party
may dispose of his or her property in any way and each party
hereby waives and relinquishes any and all rights he or she
may now have or hereafter acquire under the present or
future laws of any jurisdiction to share in the property or
the estate of the ether as a result of the marital
relationship including without limitation, st~tutory
allowance, widow's allowance, right of intestacy, right to
take against the will of the other, aDd right to act as
administrator or executor in the other's estate. Each will
at the request of the other execute, acknowledge, and
deliver any and all instruments which may be necessary or
advisable to carry into effect this mutual waiver and
relinquishment of all such interest, rights, and claims.

with your husband and his attorney and exchanging
information about the essets of the parties; is that right?

Pres6nt for the Plaintiff, Connie Cless, is
Attorney Samuel L. Andes, and present for the Defendant,
Kenneth Cless, is Attorney Michael A. Scherer.
A divorce complaint was filed on December 1,
1997, raising grounde for divorce of irretrievable
breakdown and indignities. Counsel have indicated that
the parties will sign and file affidavits of consent and
waivers of notice of intention to request entry of divorce
decree prior to the hearing. The complaint aleo raised
the economic claim of equitable distribution. No other
economic claims were raised.
The parties were married on November 14, 1992,
and separated October 1, 1997. There are no children born
of this marriage, and neither party has any minor children
from any previous relationships.
Wife is 47 years of age and resides in the Enola
area with her parents. Her mailing address is P.O. Box
182, Enola, Pennsylvania 17025. She is a high school
graduate and works currently in an office doing office
work for Alternate solutions. Her net income every two
weeks is $732.60. She has not raised any health issues.
She is not receiving any alimony pendente lite or spousal
support from husband.
Husband is 42 years of age and resides at 1027
Valley Road, Enola, Pennsylvania, where he lives with a
female friend. Counsel have indicated that husband is
going to be moving out with his friend in the next couple
weeks, and wife will be returning to the marital
residence. Husband is a high school graduate, and is a
truck driver for Feesers. His gross annual income is
around $24,000.00.

Mr. Scherer is going to file an income statement
within the next month showing Mr, Cless's income. He
shall provide Mr, Andes a copy of his client's 1998 income
tax return, Mr, Cless has not raised any health issues.
The partiee own jointly real estate at 1026
Valley Road, Enola, Pennsylvania. The property was
previously owned by wife ar.d then a week or so after the
parties married was titled in joint names, The issue with
respect to this property can be related to the factor
dealing with wife's contribution to the marital estate,
and Mr. Andes is going to attempt to establish a value for
the property at the time of marriage (which is close to
the time of the transfer to joint names), and also provide
any payoff on any liens which were against the property at
that time to help us establish an equity value.
Currently counsel have suggested values for the
property, wife suggesting $110,000.00, and husband
$120,000.00. The property is subject to a mortgage with a
payoff of around $47,000.00.
The parties own a 1996 Chevrolet pickup truck,
which husband uses, and a 1993 Blazer, which wife uses,
Those vehicles are to be valued. The parties also own a
1994 Honda four-wheeler R.V., and we need to establish a
value for that vehicle, Husband claims that he bought
this vehicle with moneys that he received from sale of
land in Perry County, which he owned prior to the
marriage. There is a dispute as to exactly what the
source of these funds were, particularly since the parties
went through a number of refinancings on the real estate
and paid off certain debts and purchased certain items
from those funds.
The pre-trial statement also shows a utility
trailer and John Deere tractor. The utility trailer
replaced a utility trailer which husband brought into the
marriage; the John Deere tractor husband claims was his
tractor prior to the marriage. Wife's attorney states
that wife also had a yard tractor, and she disposed of her
tractor. The parties retained husband's tractor,
Wife has a 1976 Corvette, which she had prior to
the marriage, and the issue with that vehicle will be
whether or not there has been any increase in value from
the date of marriage to the date of separation, Husband's
mother gave both parties, and titled in both parties'
names, a 1957 Chevrolet in 1997. This vehicle will have

to be appraised,
The following accounts and financial interests
of the parties are g~ing to be reviewed by counsel and
documentation, if required, will be provided to establish
marital values or increase in value of the accounts, if
the accounts were in effect prior to the marriage:
Wife's Alternate Solutions savings plan
(Mr, Andee is going to provide a letter
showing the value)
Husband's pension plan with Feesers
(Mr, Scherer is going to provide a letter
from Feesers showing that husband had no
interest in a pension plan at Feesers at
the time of seperation)
Husband's roll-over from Dickinson College
retirement plan (husband worked for
Dickinson College for a number of years
prior to the marriage, and counsel need to
establish the marital value. Mr, Andes
suggested obtaining a statement of the
plan at the time of marriage so counsel
can do the math to determine the marital
portion)
Wife's Heavy Duty Parts retirement plan
(documentation needs to be provided
showing the increase in value)
First National Bank of Marysville I.R,A,
account and savings account, which were
owned by wife prior to marriage (Mr. Andes
has provided these statements to Mr. Scherer)
Mr, Andes also supplemented his pre-trial
statement with a letter indicating that there were three
marital accounts at the time of separation, namely, a
certificate of deposit worth $5,000.00, a savings account
worth $500.00, and a checking account worth $600.00. The
accounts are held at the First National Bank of
Marysville.
With respect to the household tangible personal
property, husband's attorney indicated that at the time of
separation, wife removed a large number of items from the
house, and has them in storage, and has them insured for

$30,000,00, There is remaining property in the house, and
counsel are going to have to determine whether or not they
can agree that each party will retain what he or she
currently has or what is removed subsequently by husband
when he leaves the premises as a final resolution of thie
issue,
We also will need to determine whether we have
to establish values for the property in the equitable
distribution computation,
Mr. Andes has a list which his client would lika
to have remain in the house: the washer and dryer, the
newer of the two refrigerators, and the following
fixtures -- metal shelving in the basement, cabinets
installed in basement and wood stove, and peg board in the
garage.
Aside from the mortgage on the home there is no
marital debt to be allocated.
Mr. Scherer has indicated that his client
improved the marital residence by doing certain things
using his own labor while the parties were living
together. Mr. Scherer has a list which he would like to
state on the record of work that has been performed on the
property for which he feels h~ should be given some
consideration in the ultimate distribution. Husband does
acknowledge that the materials were purchased with joint
funds, but the claim is that he performed the labor for
the following: installation of outside cellar entrance to
the basement, construction of a chimney, installation of a
wood stove, drywall and carpet in the basement area of
approximately 28 by 48 feet, installation of a downstairs
bathroom, added kitchen cabinets, installation of a
storage shed in the yard, and peg board in the garage.

5. Income:
Husband is employed at Feeser's, Inc., as a truck driver, He delivers food items
for Feeser's in the Central Pennsylvania area and beyond. His gross wages for 1997
were $23,367.34, although this does not represent a full years' wages because he was
hired January 20,1997. Husband will supply a 1998 W-2 when it is furnished to him.
Husband has medical insurance through his employer but he is not eligible to
participate in the employers pension program at this time.

6. Expenses:
Husband has the customary maintenance expenses and no extraordinary
expenses. Husband has been paying Ihe mortgage on the marital residence since
January, 1998.
7. Value of pension:
Husband earned pension benefits from Dickinson College, a previous employer.
He was employed at Dickinson from the beginning of 1989 through the end of 1995.
He had a 401k with Dickinson which is now in an IRA account with the First National
Bank of Marysville. The account was reported to be worth approximately $9,000.00
recently, although a current statement is not attached but will be supplied when
available.
Wife earned pension benefits with a previous employer, Heavy Duty Parts. She
was employed there from 1976 unlil the end of 1996. She is believed to have some
type of retirement account at Heavy Duty Parts worth approximately $50,000.00.
8. Counsel fee claim:
Neither party has made a claim for counsel fees.
9. Tangible property:
Wife moved out of the marital residence on October 1, 1997, without any
advance notice to Husband. Wife hired a moving company to move most of the items
of tangible property from the marital residence upon her departure, and she continues
to be in control of these items. Undersigned counsel has not received an inventory of

these items and is not certain as to the value of these items, although Husband
understands that Wife insured these items for $30,000.00. A prior loan application to
the First National Bank of Marysville dated November 20, 1992 also listed the parties'
furniture and personal property as being worth $50,000.00.
10. Marital debts:
Aside from the indebtedness on the marital residence, none.
11, Proposed resolution:
Husband previously made a proposal to Wife when she was represented by
prior counsel. Wife's new counsel asked for a number of documents in order to
evaluate Husband's proposal, and Husband is awaitinq a response from Wife regarding
the possible resolulion of this matter.

PLAINTIFF'S PRE-TRIAL STATEMENT
Plaintiff, Connie Cless, by her attorney, Samuel L. Andes, flies this Pre-Trial
Statement in accordance with Pa. R,C.P, 1920.33(b):
1. ASSETS. Attached hereto and marked as Exhibit A Is a schedule of the
marital and non marital assets of the parties, as known to Plaintiff.
2. EXPERT WITNESSES. Plaintiff hop~s that the p~rtle's c~n agree upon the
value of the various marital assets without resort to expert testimony. In the event
they cannot, she would call the following expert witnesses:
A.) A real estate appraiser to establish the fair market value of
the residence,
6.) An appraiser of personal property to establish the value of the
household items in the possession of each of the parties and, possibly,
to establish the value of motor vehicles which the parties own.
3. FACT WITNESSES. At this point, Plaintiff would only expect to present
the testimony of herself and, perhaps, the Defendant by calling him as-on-cross
examination. Plaintiff reserves the right to call such additional witnesses as may be
necessary to respond to any evidence submitted by Defendant.
4. EXHIBITS. Plaintiff expects to present the usual exhibits regarding the
parties' Incomes, Including paycheck stubs and past tax returns and W-2
Statements. 1n addition, she will offer exhibits to verify the value of her non

marital property at the time of marriage and at the time of separation and various
other documents to establish the status of these Items as non marital property.
5, INCOME STATEMENT, Plaintiff Is employed by Alternate Solutions, Inc.
as an accounting clerk, She earns approximately $25,000.00 per year, before
taxes. Her bl-weekly Income Is set out on Exhibit C which Is attached hereto,
6. EXPENSE STATEMENT. Plaintiff's expenses currently exceed her
available net Income, A detailed statement of her living expenses will be produced
prior to the hearing.
7. PENSION INFORMATION. Plaintiff has benefits In the Heavy Duty Parts,
Inc. retirement plan which are a lump sum held in an account and can easily be

valued by a review of the plan statements. In addition to that, she has a small
balance In the Alternate Solutions savings plan which can be valued In the same
method. Because neither of these plans are defined benefit plans, It will not be
necessary to have them valued by an actuary or other expert.
8. COUNSEL FEES. Plaintiff has Incurred counsel fees to ha",e this matter
resolved and will present a detailed statement of those fees at the time of the
hearing, At the present time, Plaintiff estimates those fees to be between
$3,000.00 and $5,000,00 If a full hearing Is necessary.
9. PERSONAL PROPERTY. Plaintiff believes the parties have previously
divided their personal property and that a further distribution of that property Is not
necessary, Much of the personal property In Plaintiff's possession was owned by her
prior to the marriage and is not marital property. If the parties do not agree upon
the final division of those Items, Plaintiff proposes to have all of the marital personal
property appraised and to use those values for the hearing.
10. MARITAL DEBTS. The only significant marital debts known to Plaintiff
are set out In Exhibit A.
11, PROPOSED RESOLUTION OF ECONOMIC ISSUES. The marital
residence was owned by Plaintiff prior to the date of marriage. The parties made no
