MARKET OPINION Novembcl' 9,1998 202 Hogestown Road Mechunlcsburg, Pennlt, 17055 1 personally prcvicwcd thc subject homc on Novembcr 6, 1998 for thc purpose of determining a valuc per the requcst of Annc Storms of Jack Gaughen Rcaltor, My inspection was limited to the first and sccond floors of thc homc becausc 1 could not look atthc basement due to the lack of electricity, My inspection revcalcd n detcriorating driveway in need of serious repair~ the roof over thc garage necds to be rcshingled and a great deal of the exterior (garage door, area adjaccnt to garagc, triml\round windows) need maintenance immcdiately, In addition, when entcring the home a substantial amount of painting is necessary in many of the rooms to make thc home attractivc to a potential buyer, Also, a general cleaning of the homc would improve the prescntation to a potential buyer, Hogestown Road has a great deal of consistenttrallic on a daily basis which impacts thc functional use and attractiveness of the subjcct home to a potential buyer. It is therefore my opinion that the asking price should bc adjusted to thc arca of $ 119,000, in order to attract a buyer in a reasonablc period of time, 1 do not have the cxpertise to determine what the cost to repair the exterior deficicncics but, I am of thc opinion that thc adjusted asking price may attract a buycr who has thc cxperience to repair thc deficiencies at a reasonable price, I have not attempted to address the "in-law quarters" since the other issues outweigh any functional benefit to the subject homc, When comparing the subject home to other homes that have sold and settled on the Hogestown Road (ranging from $104,000, to $134,00) all of the priccs of the homes werc adjusted downward trom the original price anywhcre front $6,000, to $25,000. prior to the homes selling in a reasonablc period of time, Thesc home sales were from May 1995 to Sept. 1998. Whcn reviewing the listing information, it is my opinion that these homcs were more attractivc to a potential buycr, even though the asking prices ofthc homes were both higher and lowcr when compared to the subjcct property(the MLS information on these homes is included in this report), The squarc footage on thc subjcct property is significantly higher than many of the comps, with thc cxception 01'26 Hogcstown Road, However, much of this space is not functionally supcrior to the smallcr comps, certainly not suflicient enough to impactthc valuc on a strictly size comparison basis, Thc size of the dwelling may have some appeal to a special buyer who values space and who is willing to perform cosmetic and deferred maintenance work, A prospective buyer for a home in the current price range of the subject home would be considered either a "move up" or a first time home buycr and the choices to a buyer in this general price range is substantial- 26 homes in the range 01'$120,000, to $145,000, which are locatcd in thc Cumbcrland Valley School District. Today is Friday, March 19, 1999. This is the date that we set for a pre-hearing conference. The Plaintiff, Rhonda L. Hanford, is on the speaker telephone listening to the Master's comments, and her counsel is present, William L. Grubb. Also present are the defendant, Keith A. Hanford and his counsel, Dawn Cutaia Watchilla. Did I say that close enough? MS. WATCHILLA: That's closs enough. THE MASTER: This action began with the filing or a divorce complaint on December 2, 1997, raising grounds for divorce of irretrievable breakdown of the marriage. An amended complaint was filed on April 14, 1998, raising additional grounds of adultery and indignities. The Master has beeu advised that the parties will sign and file affidavit~ of consent and waivers of notice of intention to request entry of divorce decree so the divorce can be concluded under Section 3301(c) of the Domestic Relations Code. The affidavits and waivers ., uhould be filed within 7 days of todny'n data by counsel. The complaint t"aiscd the economic claim of .:lquitable distribution, and tlw ilm(JIlded complaint l'aised the additional economic claims of aU.mony, alimony pendente lite and counsel fees and costs. The Master has been advised that the parties have reached a settlement with respect to the economic claims and that an agreement is going to be placed on the record in the presence of parties. The agreement, as placed on the record, will be considered the substantive agreement of the parties not subject to any changes or modifications except for con'ectiou of typographical errors, which may be made during the transcription. Consequently, that means when we leave this hee,d.ng room today, the parties will be bound by, the terms of the agreement that is being placed on the record, even though there will be no signature of the agreement, no signatures on the agreement affirming the terms of settlement. The parties were married on December 26, 1996 and separated on October 22, 1997. There was a minor child born of the marriage, Kerrie Rhiane Hanford, born February 20th, 1987. According to the attorney for husband, there is a pending custody action in Dauphin County which 2 has beon docketed to NUllilier 3240 S 1990. The husband in the plaintiff, und the wife is the de fondant in that custody actio.m. 'l'hat mattet. i13 not yet scheduled for a hearing pending the outcome of psychological evaluations. After the Master has been advised by counsel that the appropriate affidavits of consent and waivers have been filed, the Master will prepare an order vacating his appointment and attach a copy of the agreement which is being placed on the record at this time. The Court will enter an order vacating the Master's appointment, after which counsel can file a praecipe transmitting the record to the Court requesting a final decree in divorce. MS, WATCHILLA: Mrs. Hanford, I am going to state the agreement right now, and if you have any questions or if you don't understand anything, please feel free to speak up. I am going to start out with the parties' assets, and who is going to keep what. All possessions in the possession of wife will remain in the possession of wife, including Kerrie's bed and the appliances from the marital residence. Wife agrees to either return the Jennings 22 3 semJ.automat.i.c pistol to huohanci or to have that pistol's registration removed from husband's name within 30 days of today's date. MRS. WATCHILLA: All property .in the possession of husband he shall be entitled to keep in his possession including his pension. Wife waives her right to file any type of claim against husband's pension. WATCHILLA: There is also a pending personal injury lawsuit and wife waives her right to claim any amount of the settlement of that lawsuit should there be one. Husband agrees to pay the sewer bill; however, he is permitted to discharge that bill in bankruptcy, if he decides to file bankruptcy. 4 MS.
