Plaintiffa ia attached hereto as "Exhibit A",
5. An invoioe waa Bent by Dofendant, dated 4/21/94, for work
performed by Defendant. A oopy of the .lnvoioe ia attaohed as
"Exhibit B".
6, W.lthin a few wlleka of the inatallation of the gutter,
Plaintiffa began to experience water damage in an upatairti bedroom
and the kitchen of their houae.
7. Upon inveatigationr Plaintiffa diacovered that the gutter
had been improperly i.natalled by Defendant and the drip edge on the
pre-exiating roof had been covered over with aluminum flashing to
facilitate the gutter inatallation.
8, The water leaka in the Plaintiffa' home were proximately
cauaed by the faulty inatallation of the gutter and flaohing, which
allowed water to seep under the roofing material, behind the
gutter, and through the fascia board into the houae,
9. As a reaul t of Defendant's faulty .installation of the
gutter ~nd poor workmanship, Plaintiffs have sustained damages in
an unliquidated amount, which amount is not expected to exceed the
jurisdictional limits requiring arbitration.

COUNT I - BREACJI OF CONTRACT
10, Paragrapho 1 through 9 are inoorporated her.ein by
reference.
11, Plaintiffs and Defendant entered into an express oral
contract whereby Defendant agreed to perform wor.k as specified in
its work proposal attached as "Exhibit A" hereto, and Plaintiffs
agreed to pay the price opecified in the proposal.
12. Defendant breached ita contract with Plaint!ffl.l by
failing to satisfactorily perform the work specified in the
proposal in that it:
A. Negligently andlor improperly mounted or hung the
replacement gutter as to prevent water from dripping behind the
gutter and leaking into the house;
B, Negligently andlor improperly installed or sealed
the aluminum fascia board as to prevent water from leaking past the
fascia boar.d into Plaintiffs' home;
c. Negligently andlor improperly covered the drip edge
on the pre-existing roof with aluminum flashing;
D. Negligently or improperly instructed or supervised
its workers and lor employees during the job on Plaintiffs' home;
E. Failsd to perform work in accordance with
manufacturer's recommendations andlor standard practices of thG
trade.

16. Defendant waD notified by Plaintiffs of the reourring
water problems and attempted unsuccessfully on approximately six
occasionB to correct the problems,
17. Defendant haB breached its expreoB warranty by failing to
perform a workmanlike job bYI
A. Improperly inBtalling the gutter and downspout;
B. Improperly installing or Bealing the aluminum fasoia
board to prevent water from leaking past the fascia board into
Plaintiffs' home;
C. Improperly covering the drlp edge on the pre-
existing roof with aluminum flashing; and
D. Failing to adequately make repairs to the roof and
gutter areas of. the home after being notified by Plaintiffo of the
problems wlth water leakage.
18. As a result of Defendant's breach of warranty, Plaintiffo
have sustained damages in an unliquidated amount,
WHEREFORE, Plaintiffs, William J. Kepner and Barbara Kepner,
reBpectfully request this Honorable Court to enter judgment in
their favor in the amount of $2,169.00, plus court costs and to

downspout on the rear of their houoe and to replace a faocia board
which had been damaged by lee and onow with an aluminum faocia
board. A oopy of the work proposal oubmitted by Defendant to
Plaintiffs is attached hereto ao "Exhibit A".
5. An invoice was sont by Dafendunt, dated 4/21/94, for work
performed by Defendant. A copy of the invoic:e is attached as
"Exhibit B".
6. within a few weeks of the installation of the gutter,
Plaintiffs began to experience water damage in an upstaira bedroom
and the kitchen of their house.
7. Upon investigation, Plaintiffs discovered that the gutter
had been improperly installed by Defendant and the drip edgo on the
pre-existing roof had been covered over with aluminum flashing to
facilitate the gutter installation.
e. The water leaks in the Plaintiffo' home were proximately
caused by the faulty installation of the gutter and flashing, which
allowed water to seep under the roofing material, behind the
gutter, and through the fascia board into the house.
9. As a result of Defendant's faulty installation of the
gutter and poor workmanship, Plaintiffs have sustained damages in
an unliquidated amount, which amount is not expected to exceed the
jurisdictional limits requiring arbitration.

reference.
11. Plaintiffs and Dcfendant cntered into all express oral
contract whereby Defendant agreed to perform work as specified in
its work proposal attached as "Exhibit A" hereto, and Plaintiffs
agreed to pay the price specified in the propoanl.
12. Defendant broached its contract with Plaintiffs by
failing to satisfactorily perform the work spacified in the
proposal in that it:
A. Negligently and/or impropcrly mounted or hung the
replacement guttcr as to prevent water from dripping behind the
gutter and leaking into the house;
B. Nagligently and/or improperly installed or sealed
the aluminum fascia board I1S to prevent water from leaking past the
fascia board into Plaintiffs' home;
c. Negligently and/or improperly covered the drip edge
on the pre-existin1 roof with aluminum flashing;
D. Negligently or improperly instructed or supervised
its workers and/or employees during the job on Plaintiffs' home;
E. Failed to perform work in accordance with
manufacturer's recommendations and/or standard practicEls of the
trade.

16. Defendant was notified by Plaintiffs Lf the reourring
water problems and attempted unsuccessfully on approximately six
occasions to correct the problems.
17. Defendant hao breached its express warranty by failing to
perform a workmanlike job by:
A. Improperly installing the gutter and downspoutl
B. Improperly installing or sealing the aluminum fascia
board to prevent water from leaking past the fascia board into
Plaintiffs' home;
C. Improperly covering the drip edge on the pre-
existing roof with aluminum flashing; and
D. Failing to adequately make repairs to the roof and
gutter areas of the home after being notified by Plaintiffs of the
problema with water leakage.
10. As a result of Defendant's breach of warranty, Plaintiffs
have sustained damages in an unliquidated amount.
WHEREFORE, Plaintiffs, William J. Kepner and Barbara Kepner,
respectfully request this Honorable Court to enter judgment in
their favor in the amount of $2,169.00, plus court costs and to

rain gutter and properly completed all work contracted with thn
Plaintiffs.
B. Denied. After reasonablo investigation, Defendant is
without sufficient knowledge or information to form a belief as
to the truth of this averment and strict proof thereof is
demanded at trial of. the matter. To the extent a response is
required, the allegations Bet Cor~l in Paragraph U of Plaintiffs'
Complaint states a conclusion of law to which no responsive
pleading is required. In that a response is required, it is
denied that the water leaks in tho Plaintiffs' homo were caused
by faulty installation of the gutter and flashing.
9. Denied. The allegation sot forth in Paragraph 9 of
Plaintiffs' Complaint states a conclusion of law to which no
responsive pleading is required. In that a response is required
it is denied that Plaintiffs' damages were caused by faulty
installation of the gutter and poor workmanship on the part of
Defendant.
COUNT I
BREACH OF CONTRACT
10. No response required.
11. Admitted in part and denied in part. It is denied that
the parties entered into an express oral contract. To the
contrary, the parties entered into a written agreement
specifically as set forth in Plaintiffs' Exhibit A.

12. Denied. The allegations set forth in Paragraph 12 of
Plaintiffs' Complaint states a conclusion of law to which no
responsive pl~ading is required. In the event a response is
required, it is denied that Defendant breached its contract with
Plaintiffs.
A. To the contrary, Defendant properly mounted the
replacement gutter.
B. To the contrary, Defendant properly installed or
sealed the aluminum fascia board.
C. To the contrary, Defendant properly performed work
on the drip edge.
D. To the contrary, Defendant properly instruoted or
supervised its workers and/or employees while working on
Plaintiffs' home.
E. To the contrary, Defendant performed work in
accordance with manufacturer's recommendations and/or standard
practices of the trade.
13. Denied. After reasonable investigation, Defendant is
without sufficient knowledge or information to form a belief as
to the truth of this averment and strict proof thereof is
demanded at trial of the matter.
14. Denied. After reasonable investigation, Defendant is
without sufficient knowledge or information to form a belief as
to the truth of this averment and strict proof thereof is
demanded at trial of the matter.

WHEREFORE, Defendnr.t respectfully requests this Honorable
Court enter judgment in its favor and against the plaintiffS
William J. Kepner and Barbara Kepner and responsible attorney's
fees for the cost of this action, and such other relief as the
Court deems just and proper.
COUNT II
BREACH OF WARRANTY
14. No response required.
15. Admitted in part and denied in part. It is admitted
that the quoted language is contained within the terms and
conditions of the proposal. The proposal contains many other
terms and conditions and the quoted language must be read as part
of the entire document. Denied in all other respects.
16. Denied. To the contr.ary, Defendant was never notified
of any problems with the job until it received a District Justice
complaint naming it as a Defendant.
17. Denied. The allegations set forth in Paragraph 17
states a conclusion of law to which no responsive pleading is
required. In the event a response is required, it is denied that
any expressed warranty was breached.
A. To the contrary, Defendant properly installed the
gutter and downspout.
B. To the contrary, Defendant properly installed or
sealed the aluminum fascia board.
C. To the contrary, Defendant properly performed work

on the drip edge.
D. To the contrary, Defendant adequately made repairs
to the roof and gutter ar.eas of the home after being notified by
plaintiff.s of water leakage problems.
18. Denied. The allegation set forth in paragraph 18 of
Plaintiffs' complaint states a conclusion of law to which no
responsive pleading is required. In that a response is required
it is denied that Defendant breached its warranty to plaintiffs.
The balance of the averment is denied in that after reasonable
investigatJ.on, Defendant is without sufficient knowledge or
information to form a belief as to the truth Of this averment and
strict proof thereof is demanded at trial of this matter.
WHEREFORE, Defendant respectfully requests this Honorable
Court enter judgment in its favor and against plaintiffs William
J. Kepner and Barbara Kepner and reasonable attorney's fees, the
costs of this action, and such other relief as the court deems
just and proper.
