support thereof avers as follows:

~NTIFF'S MOTION FOR METHOD OF SERVICE
AND NOW comes the Plaintiff, MICHAEL FORSYTHE, by and through his
attorneys, SHOLLENBERGEr{ & IANUZZI, LLP, and files the following Motion:
1. This cause of action arises out of a motor vehicle collision that
occurred on July 7, 1 <J<J7 on State Route 0214, otherwise known as Simpson Ferry
Road, Cumberland County, Pennsylvania.
2. At the aforesaid time and place, Plaintiff, MICHAEL FORSYTHE, was
the owner and operator of a 1 <J70 Ford Torino, bearing Pennsylvania registration
plate BKD4367.
3. At the aforesaid time and place, the Defendant, UN QIN YOU, was
acting as the agent, servant and/or employee or the Defendant, WOMAY
TRADING, INC., and was operating a 1 <J<J5 Mitsublshi Fuso with New York
registration plate XT8253, within the course and scope of the agency and/or
employment relationship with the Defendant, WOMAY TRADING INc:.
4. Plaintiff, MICHAEL FORSYTHE, was stopped with his turn signal on
in the Westbound lane of Simpson Ferry Road, waiting to take a left turn Into
Hardee's Restaurant.
5. Defendant's vehicle collided with the rear of Plaintiff's vehlc:le,

7. In a lelll!r d,lled Dec(!mlll'r 4, 1997, PI.lintiff forwarded copies of his
Complaint to Ihe Office of Prothonotary, Cumberland COllnty, Pennsylvani,l,
requesting ittl') forward 10 the Slwrlff for service, Cl~rtifll!d, tinll' sli\llllH>d copies of
the Compl.llnt, discovery docull1ents and the approprlatl! checks representlnf\
advanced costs. A copy of said I('ller is allached herl!to as Exhibit "A."
6. On or about)anuary n, 199B, Plaintiff reinstated his Complaint. A
copy of said lelter requestlnf\ relnstatell1ent to the Office of Prothonotary,
Cumberland County is allached hereto as Exhibit "B."
9. On or about Decemher 5,1997, the Shl!riff or Deputy Sheriff of
Cumberland County served the Defendants by U.S. Certified Mall a true ilnd
altested copy of the allached Compl,lint, together with Notice, Interrogatories and
Request for production of Documents.
10. On or about January 6, 199B, the Sheriff's Office sent Plaintiff return
of service, Indicating that the Defendants' certified mail was unopened and
returned to the Sheriff's Office on January 2, 1996 marked "Unclaimed." A copy
of the Sheriff's return is allached hereto as Exhibit "c."
11. On or about January 12, 1996, Plaintiff forwarded a leller to process
server, Mr. Paul Neiger of Olympic Process Serving, New York, and requested
that he serve Plaintiff's Complaint, Interrogatories and Request for Production on
the Defendants. Plaintiff requested a return of service confirming same.
12. On or about January 20, 1996, Mr. Neiger informed Plaintiff's
counsel that he went to the Defendants' addresses identified in the Plaintiff's
Complaint, and he could not locate Defendants. A copy of said lelter is attached
hereto as Exhibit "D."
13. Mr. Nieger did the following In order to locate and serve above

14. PlalntlH's counsellhls contacted Dd(!ndant, WOMA Y TRADING
INC.'S, Insurance carrier, Countrywide Insurance Co., 90 Washinglon Street, New
York, New York 10006, and has confirmed that the Defendant had coverage at
the time o( Ihls collision.
15. On or about March 10, 1998, PlaintlH's counsel spoke to a
representative o( Countrywide Insurance Co., Mr. George Cionsalves, and he
Indicated he would like a copy o( the Complaint (axed to him. A copy of the fax
sheet evidencing that Plaintiff forwarded the Complaint to Countrywide is attached
hereto as Exhibit "H."
16. On or about March 16, 1998, Steven E. Hoffman, Esq., entered his
appearance on behalf of the Defendants, WOMAY TRADING, INC. and UN
QUIN YOU.
17. Plaintiff's counsel asked Mr. Hoffman If he would accept service of
the Complaint on behalf of the Defendants.
18. Plaintiff received a letter from Mr. Hoffman indicating thai
Countrywide Insurance Co. would not authorize him to accept service on behalf

10006. Countrywide Insurance Co. has confirmed that the Defendant's had
coverage at the time of this collision.
8. On or about March 10, 1998, Plaintiff's counsel spoke to a

AND NOW comes the Plaintiff, MICHAEL FORSYTHE, by and

following:
1. The Plaintif f, MIClIAEL FORSYTHE, is an adul t
individual who currently resides at 205 Conodoquinet Avenue,
Camp Hill, Cumberland County, Pennsylvania 17011.
2. The Defendant, WOMAY TRADING, INC., is a New York
corporation with corporate offices located at 387 Adelphi
Street, Brooklyn, New York 11238.
3. The Defendant, LIN QIN YOU, is an adult individual
whose last known address is 62 Forsyth Street, 21, New York,
New York 10002.
4. The facts and circumstances hereinafter set forth
took place on July 7, 1997 at or about 1:53 p.m. on Simpson
Ferry Road, State Route 0214, Hampden Township, Cumberland
County, Pennsylvania.
5. At the aforesaid time and place, the Plaintiff,

Torino, bearing Pennsylvania registration plate BKD4367.
6. At the aforesaid time and place, the Defendant,
LIN QIN YOU, was acting as the agent, servant and/or
employee or the Defendant, WOMAY TRADING, INC., and was

'I, At the aforesaid time and place, PlaIntiff, MICHAEL
FORSYTHE, was stopped with his turn signal on in the
Westbound lane of Simpson Ferry Road, waiting to take a left
turn into Hardee's Restaurant.
8. At the aforenai d time and place, Defendant, LIN
QrN YOU, was travelling behind the PlaIntiff's vehicle and
collided with the rear of Plaintiff's vehicle, pushing it
into the Eastbound lane, causing it to collIde with another
vehicle and then coming to rest straddling the berm and
Westbound lane of Simpson Ferry Road.
9. As a result of the aforesaid collision, Plaintiff,
MICHAEL FORSYTHE, has suf fered serious and permanent
injuries, including but not limited to the following:
(a) Severe strain and sprain of the muscles,
tendon, ligaments and other soft tissues at
or about the cervical spine;
(b) Extreme emotional trauma;
(c) Concentric disc protrusion at C3-4 and C4-5;
(d) Disc protrusion at C5-6.
(e) Severe shock to the nerves and nervous
system;
(f) Severe headaches; and,
(g) Extreme mental and physical anguish.

diminution in his ability to enjoy life and life's pleasures
for which damages are claimed.
17. As a further result of the aforesaid injuries,
Plaintiff, MIOIAEL FORSYTHE, has incurred or may hereinafter
incur financial expenses and loss which exceed sums
recoverable under the limitations and exclusions of the
Pennsylvania Motor Vehicle Financial Responsibility Law for
which damages are claimed,
18. 1\13 a further result of this collision, Plaintiff,
MICHAEL FORSYTHE, has and may in the future incur reasonable
and necessary medical and rehabilitative costs and expenses
in excess in the amounts paid or payable pursuant to
Subchapter B of the Pennsylvania Motor Vehicle Financial
Responsibility Law, Workers' Compensation or any program,
group contract, or other arrangement for payment of benefits
as defined in 75 Pa.C.S,I\. Section 1719.
19. As a further result of this collision, Plaintiff,
MICHAEL FORSYTHE'S, 1970 Ford Torino was totalled as a
result of the July 7, 1997 motor vehicle collision.
20, As a further result of this collision, Plaintiff
has sustained a loss of use of his 1970 Ford Torino.
21. As a further result of this collision, Plaintiff
has sustained towing charges in the amount of $65.00 and
storage charges accruing at $9.00 per day which totalled a
$1,332.00 ai: the time of the filing of this Complaint. A
copy of said bill from Lucas' Body Shop where the vehicle
was towed and is currently being stored is attached hereto
as Exhibit "A."
22. Plaintiff may also incur citation charges from
Hampden Township city council as a result of the storage of

AND NOW comes the Plaintiff, MICHAEL FORSYTHE, by and
through his attorney, the LAW OFFICES OF TIMOTHY A.
SHOLLENBERGER, and does respectfully represent the
follow.ing:
1. The Plaint.iff, MICHABL FORSYTHE, is an adult
individual who currently res.ides at 205 Conodoquinet Avenue,
Camp Hill, Cumberland County, Pennsylvania 17011.
2. The Defendant, WOMAY TRADING, INC., is a New York
corporat.ion with corporate offices located at 387 Adelphi
St.reet, Brooklyn, New York 11238.
3. The Defendant, LIN QIN YOU, is an adult .individual
whose last known address is 62 Forsyt.h Street, 21, New York,
New York 10002.
4. The facts and circumstances hereinafter set forth
took place on July 7, 1997 at or about 1:53 p.m. on Simpson
Ferry Road, State Route 0214, Hampden Township, Cumberland
County, Pennsylvania.
5. At the aforesaid time and place, the Plaintiff,
MICHABL FORSYTHE, was the owner and operator of a 1970 Ford
Torino, bearing Pennsylvania registration plate BKD4367.
6. At the aforesaid time and place, the Defendant,
LIN QIN YOU, was acting as the agent, servant and/or
employee or the Defendant, WOMAY TRADING, INC., and was

operating a 1995 Mitsubishi Fuso with New York registration
plate X'L'S253, within the counle and scop" at the agency
and/or employment relat iCJIlship with the Defendant.
7. At the afol'CHldid t im'~ and place, Plaint J. ff, MICHAEL
FORSYTHE, was stopped with his turn signal on in the
Westbound lane of Simpson Ferry Road, waiting to take a left
turn into Hardee's Restaurant.
S. At the aforellaid t.Lme and place, Defendant, LIN
QrN YOU, was travelling behind the Plaintiff's vehicle and
collided with the rear of Plaintiff's vehicle, pushing it
into the Eastbound lane, causing it to collide with another
vehicle and then coming to rest lltraddling the berm and
Westbound lane of Simpson Ferry Road.
9. As a result ot the aforesaid collision, Plaintiff,
MICHAEL FORSYTHE, hall suf fered serious and permanent
injuries, including but not limited to the following,
la) Severe strain and sprain of the muscles,
tendon, ligaments and other soft tissues at
or about the cervical spine;
lbJ Extreme emotional trauma;
lc) Concentric disc protrusion at C3-4 and C4-5;
(dJ Disc protrusion at C5-6,
Ie) Severe shock to the nerves and nervous
system;
(f) Severe headaches; and,
IgJ Extreme mental and physical anguish.

(g) In otherwise operating said vehicle in a
careless, reckless, and negligent manner and
in a manner violating the Motor Vehicle Code
of the Commonwealth of Pennsylvania.
12. As a direct and proximate result of the aforesaid
inj uries, Plaint if f, MICHAE:L FORSYTHE:, has undergone and in
the future will undergo great pain and suffering for which
damages are claimed.
11. As a further result of the aforesaid injuries,
Plaintiff, MICHAEL FORSYTHE, has suffered and may continue
to suffer a loss of ear'nings for which damages are claimed,
14. As a further result of the aforesaid injuries,
Plaintiff, MICHAEL FORSYTHE, ~ad and/or may in the future
incur expenses for medical treatment and rehabilitation for

MICHAEL FORSYTHE'S, 1970 Ford Torino was totalled as a
result of th,= July 7, 199'1 motor vehicle collision.
20. As a further re,mlt of this collision, Plaintiff
has sustained a loss of use of his 1970 Ford Torino.
21. As a further result of this collision, Plaintiff
has sustained towing charges in the amount of $65.00 and
storage charges accruing at $9.00 per day which totalled a
$1,332.00 at the tim2 of the filing of this Complaint. A
copy of said bill from Lucas' Body Shop where the vehicle
was towed and is currently being stored is attached hereto
as Exhibit "A."
22. Plaintiff llIay also incur citation charges from
Hampden TownshIp city council as a result of the storage of

25. At the aforesaid time and place, Defendant, LIN
QIN YOU, was operating the 1995 Mitsubishi Fuso, with the
expressed and/or implied permission of the Defendant, WOMAY
TRADING, INC.
26. Defendant, WOMAY TRADING, INC., was negligent in
that:
a. It entrusted the use of the 1995 Mitsubishi
Fuso to Defendant, Lit! Qin You, whom it knew,
or should have known, had a reputation for
reckless and/or negligent driving! and,
b. It entrusted said vehicle to Defendant, Lin
Qin You, when it was likely that he would
operate Defendant's vehicle in such a manner
as to create an unreasonable risk of harm to
others.
WHEREFORE, Plaintiff, MICHAEL FORSYTHE, demands
judgment against the Defendants, LIN QIN YOU and WOMAY
TRAD~NG, INC., for compensatory damages in all amoullt in
excess of the amount requiring compulsory arbitration.

AND NOW comes the Plaintiff. MICHAEL FORSYTHE. by and through his attorneys,
SHOLLENBERGER & JANUZZ', LLP, and files the following Motion:

1, This cause of action arises out of a motor vehicle collision that occLlrred on July 7.1997
on State Route 0214, otherwise known as Simpson Ferry Road, Cumberland County.
Pennsylvania,
2, On or about July 14, 1998. Plaintiff. MICHAEL FORSYTHE, filed a Motion for Method of
Service, A copy of said Motion Is attached hereto and Incorporated as Exhibit "A,"
3, On or about July 24, 1998, this Honorable Court entered an order directing Plaintiff to
publish a notice In a newspaper of general circulation In the New York City area, the last
,known addresses of the Defendants, A copy of the Court's Order Is attached hereto and
incorporated herein as Exhibit "8,"
4, Plaintiff. MICHAEL FORSYTHE, contacted the New York Times and the New York Daily
News and Inquired concerning the cost for publication of the Notice to Defend,
5. The cost to publish the Notice In the New York Daily News for one day In one borough
was quoted between $800,00 - $1.200,00 per day, A copy of the legal notice quote is
attached hereto and Incorporated herein as Exhibit "C,"
G, The cost to publish the Notice In the New York Times for one day was quoted as
$639.80, A copy of that quote Is attached hereto and Incorporated herein as Exhibit "0,"
7, Plaintiff believes that the cost of publication Is excessive In relation to the damages he
sustained In this collision, and will be prejudicial to him If he has to Incur this cost.
8, Plaintiff believes and therefore avers that he has demonstrated a good faith effort to
locate the Defendants through direct means and has complied with the provisions of the long-
arm statute by taking the following steps:
a, In a letter dated December 4, 1997. Plalntlffforwarded caples of his
Complaint to the Office of Prothonotary, Cumberland County. Pennsylvania,
requesting It to forward to the Sheriff for service certified. time stamped
caples of the Complaint, discovery documents and the appropriate checks
representing advanced costs,
b, On or about.January 8, 1998, Plaintiff reinstated his Complaint.
c, On or about December 5. 1997, the Sheriff or Deputy Sheriff of Cumberland
County served the Plaintiff's Complaint and Discovery on Defendants by U,S,
Certified Mall.
d, On or about January 6. 1998, the Sheriff's Office sent Plaintiff a return. of
service Indicating that the Defendants' certified mall was unopened and
returned to the Sheriff's Office on January 2. 19P3 marked "Unclaimed,"
e, On or about January 12. 1998. Plaintiff forwarded a letter to a New York
process server, Mr, Paul Neiger of Olympic Process Serving. and requested
that he serve Plaintiffs Complaint. Interrogatories and Request for Production
on the Defendants, Plaintiff requested a return of service confirming same,
f, Mr, Nieger did the following In order to locate and serve above named
Defendants:
1, Called a telephone number In attempt to reach the Defendant, L1N
QUIN YOU, and he was told by the answerer that he did not know
anyone by the Defendant's name,
2, Checked the phone book for a listing for Defendants. WOMAY
TRADING INC, and L1N QUIN YOU, In the New York area and found
no such listing,
3, Performed a search for the driver's license of Defendant, L1N QUIN
YOU. and it came back as a "no hit"

occurred on July 7/1997 on Stale Route 0214/ otherwise kl,own as Simpson Ferry
Road, Cumberland County, Pennsylvania,
2, AI the aforesaid time and place, Plalntilf, MICHAEL FORSYTHE, was
the owner and operator of a 1970 Ford Torino, bearing Pennsylva'lia re~istration
plate BKD4367,
3, At Ihe aforesaid time and place, the Defendant, UN QIN YOU/ was
acting as the agent, servant and/or employee or the Defendant, WOMAY
TRADING, INC., and was operating a 1995 Mitsubishi Fuso with New York
registration plate XT8253, within the course and scope of t~,e agency and/or
employment relationship with the Defendant, WOMAY TRf,OING INC.
4, Plaintlff, MICHAEL FORSYTHE, was stopped with his turn signal on
in the Westbound lane of Simpson Ferry Road, waiting to take a left turn into
Harde("s Restaurant.
5, Defendant's vehicle collided with the rear of Plaintiff's vehicle,
