It is believed, and therefore averred, that all bills regarding the account which is the subject of this lawsuit were paid by tenants that resided at 9 East Glenwood Drive, Camp Hill, Cumberland County, Pennsylvania. 15. During the period of October 1, 1996 through September 30, 1997 no one lived at the property which is the subject of this lawsuit. 16. Plaintiff claims are barred by the doctrine of waiver and estoppel. 17, It is believed, and therefore averred, that any and all bills relating to electrical services provided by the Plaintiff during the period of October 1, 1996 through the present are inaccurate and do not reflect the actual amount of electrical service provided to the subject property, 18. It is believed, and therefore averred, that the actions and inactions of the Plaintiff in seeking to collect from the Defendants the amounts set forth in the Complaint constitute violations of the regulations of the Public Utility Commission, specifically those regulations regarding billing and collecting amounts from residential electrical customers, 52 Pa. Code {l56.1 et seq., which actions and violations bar the Plaintiff from obtaining payment from the Defendants, 19. Plaintiff is not entitled to collect any late fees from Defendants. 20, Plaintiff failed to mitigate its damages. 3 Q WHEREFORE, Defendants respectfully request this Honorable Court to dismiss Plaintiffs Complaint with prejudice and award to them the costs in defending this action.
