VINCI, husband and wife, their heirs, administrators, executors, and assigns, CIVIL ACTION QUIET TITLE Defendants/Respondent MOTION FOR JUDGMENT 8Y DEFAULT AND NOW comes the Movant, George H. Bradney, by and through his attorneys, Stone LaFaver & stone, and brings the within Motion for Judgment by Default and in support thereof avers as follows: 1. The Movant is George U. Bradney, an adult individual whose address is 306 Evergreen, New Cumberland, Pennsylvania 17070. 2. The Movant filed a complaint in this matter on December 8, 1997, in the Court of Common Pleas of Cumberland County, Pennsylvania, to No. 97-6749 Civil Term. The averments set forth in Movant's complaint are incorporated by reference herein as though fully set forth at length. 3. By order dated December 10, 1997, this Uonorable Court granted leave to make service of the complaint upon the Dsfendants, John J. Vinci and Joan L. Vinci, their heirs, administrators, exscu- tors and assigns, by publication once in the Cumberland Law Journal -1- and a newspaper of general circulation in Cumberland County, pennsyl- vania, as provided by Pa. R.C.P. 410 and 430(b)(1). 4. Pursuant to the order dated December 10, 1997, Movant published notice of the complaint in the Cumberland Law Journal on December 26, 1997, and The Patriot News on December 23, 1997. True and correct copiee of the proofs of publication are attached her.eto as Exhibits "A" and "B" respectively. 5. Defendants, John J. Vinci and Joan L. Vinci, their heirs, administrators, executors and assigns, have not filed an answer, entered an appearance nor contacted Movant or Movant's attorney of record. WHEREFORE, Movant, George Il. Bradney, by his attorneys, stone LaFaver & stone, moves this Honorable Court to enter a default judgment against the Defendants, John J. Vinci and Joan L. Vinci, their heirs, administrators, executors and assigns, and prays that this Honorable Court decree: 1. That the Defendants, John J. Vinci and Joan L. Bradney Living Trust, being duly sworn according to law, deposes and says that: 1. He is the plaintiff in the foregoing complaint; 2. He has personal knowledge concerning the facts and circum- stances set forth in the complaint filed in this action; 3. When he purchased the property from Charlotte J. Stoner and John B. Starr, Executors of the Estate of Florence R. starr, he was aware that the defendants had attempted to purchase the within property but were unable to obtain financing and accordingly defaulted under the terms of the Installment Sales Agreement; 4. To the best of his knowledge, information, and belief the said defendants, JOHN J. VINCI and JOAN L. Bradney, individually and as sole 'l'rustee of the George II. Bradney Living Trust, by and through his attorneys, Stone LaFaver & Stone, and files this complaint to quiet title and avers as follows: 1. The plaintiff, George H. Bradney, is an adult individual whose address is 306 Evergreen, New Cumberland, PA 1'7070. 2. The last known address of the defendants, John J. Vinci and Joan L. Vinci, husband and wife, was 8 East Main Street, Shiremanstown, Cumberland County, Pennsylvania 17011. 3. Plaintiff originally obtained title to a tract of land and improvements thereon situate in the Borough of Shiremanstown, Cumberland County, Pennsylvania, known as 8 East Main Street pursuant to a deed of conveyance from Charlotte J. Stoner and John B. Starr, Executors under the Last Will and Testament of Florence R. Starr, deceased, dated August 17, 1972, and recorded August 18, 1972, in the -1- Office of tho Hocorder of IJUllds of Cumberland County, Pennsylvania in Deed Dook T, Volume 24, Page 711. Plaintiff subsequently conveyed subject property to George H. Dradney, Sole Trustee, or his succes- sors, in trust, under the George H. Dradney Living Trust dated July 18, 1994, a copy of which is attached hereto, made a part. hereof and marked Exhibit "A". 4. The tract of land conveyed to the plaintiff is more particu- larly bounded and described as follows: ALL THAT CERTAIN lot of ground situate on the South side 0 East Main Street in the Borough of Shiremanstown, Cumberland County, Pennsylvania, bounded and described as follows, to wit: BEGINNING at a point on the South side of Main Street at line of property of Sylvan Sheely, Jr., and wife; thence in a southerly direction along the western line of said property, two hundred (200) feet to an alley; thence in a westerly direction along the northern side of said alley, fifty (50) feet to a point at line of other property of the Florence Starr Estate; thence in a northerly direction along the eastern line of said proper.ty, two hundred (200) feet to Main Street; thence in an easterly direction along the southern line of Main Street, fifty (50) feet to a point, the place of BEGINNING. Having thereon erected a two (2) story brick dwelling house, numbered 8 East Main Street, with double garage in rear of lot. 5. By an Installment Sales Agreem&nt dated November 20, 1970, by and between Charlotte J. Stoner and John B. starr, Executors of the Estate of Florence R. Starr, deceased, and the defendants, the defendants acquired an equitable interest in the within described property. A copy of the said agreement is attached hereeto, made a part hereof and marked Exhibit "B". -2- 6. Plaintiff avers upon information and belief that the defen- dants defaulted under the terms of the Installment Salee Agreement but that a releaee or quit cla~n deed for the eame wae never recorded. 7. The plaintiff, neverthelees, believes that there is a cloud of suspicion upon the title to the said real estate described in the within complaint which may hinder plaintiff's possession and quiet enjoyment of said real estate or delay any proposed sale of the said real eetate; and the plaintiff, accordingly, commences this action to qlliet title to remove the apparent possible intereet or title in the herein defendants, their heire, adminietrators, executore, or aeeigns, if any. 8. The plaintiff brings this action to quiet title under the provisione of Pa. R.C.P. 1061, et eeq., and under the general powers of the court to quiet title to real estate pureuant to the provisione of the Act of Ae~embly so providing and the Pennsylvania Rules of Civil Procedure. WHEREFORE, the plaintiff respectfully requeate your Honorable Court to decree: 1. That eervice of the within complaint be ordered to be made by publication on the within defendants, their heirs, executors, adminietratore, and assigna. 2.
