r.. Statement of Facts and propedural Historv
Plaintiff filed a Complaint in Mortgage FOJ;eclosure on
December 8, 1997 against Defendants, Steven Brymesser and Patty
Brymesser, who are the mortgagors and real owners of the property
located at 3166 Ri tner Highway, Newville, Cumberland County,
Pennsylvania.
Defendant, Steven Brymesser ("Defendant") filed an
Answer with New Matter to Plaintiff's Complaint on February 19,
1998,
Plaintiff filed a Reply to New Matter. Defendant, Steven
Brymesser, is no longer represented by counsel: To date, the pro
se co-Defendant, Patty Brymesser has not filed an Answer.
Plaintiff has filed a Motion for Summary Judgment along with an
Affidavit. This Brief is offered in support of Plaintiff's Motion.
On April 24, 1996, the Defendants executed and delivered a
Mortgage Note in the sum of $68,000,00 payable to New Jersey
Mortgage and Investment Corp. contemporaneously with the execution
of the Note, the Defendants executed and delivered to New Jersey
Mortgage and Investment Corp., a real estate Mortgage which was
recorded in the Of f ice of the Recorder of Deeds of Cumberland
County in Mortgage Book 1316, Page 203. Subsequently, the Mortgage
was assigned to plaintiff and recorded on December 14, 1998 in Book
596, Page 706 of the Recorder of Deeds of cumberland County. The

The Note and Mortgage are in defaul t owing to the
tcwt thilt both Pefendants have failed to pay the monthl.y install-
lII.lIlt due on March 24, 1997, and all subsequent installments
t herenf tel'. Prior to the coml1lencement of this Mortgage Foreclosure
ilct tOil, the Pl.alntiff sent Notices pursuant to Act 91 of 1983.
f!owov'n', the De fendants have failed to reinstate their Mortgage and
Nato forcing Plaintiff to file this Action.
II. Statement of Ouestions Presenteg
A. Is the Plaintiff entitled to Summary Judgment by
reason of the Defendant's admissions and failure to
allege a valid defense?
B. Was the Plaintiff required to comply with the
notice provisions of Pennsylvania Act 6 of 19747
C. Did the plaintiff comply with the notice provisions
of Pennsylvania Act 91 of 1903?
III. Arqument
A. THE PLAINTI FF IS ENTITLED TO SUMMARY JUDGMENT BY
REASON OF THE DEFENDANT'S ADMISSIONS AND FAILuRE TO
ALLEGE A VALID DEFENSE.
Rule 1141 of the Pennsylvania Rules of civil Procedure states
that Rules relAting to civil actions shall apply to actions of
mortgage foreclosure,
Rule 1035.2 provides that:
"After the

relevant pleadings are closed, but within such time as not to
unreasonably delay trial, any party may movl;! for summary judgment
in whole or in part as a matter of law (1) w~enever there is no
genuine issue of any material fact as to a necessary element of the
cause of action or defense which could be established by additional
discovery or expert report...n
A Motion for Summary ,Judgment may properly be granted only if
the pleadings, depositions, answers to interrogatories and
admissions on file, together with the affidavits, if any, show that
there is no genuine issue as to any material fact and that the
moving parties are entitled to an entry of judgl1lent as a matter of
law. Entry of judgment is proper where the case presented is clear
and free from doubt and where trial would be a fruitless exercise.
Potts Mfq, Co. v, Loffredo, 96 Dauph, 413, affirmed 340 A,2d 468
(Pa. Super. 1974). The only issue before the Court is whether the
Defendant's Answer or New Matter raises any legal or factual issue
which provides a basis for denying the Plaintiff its request for
summary judgment.
In his Answer, the Defendant admits the identities of the
parties, as well as the Defendants' execution of the Note and
Mortgage for the subj ect property. Furthermore, the Defendant
admits he is one of the real owners of the aforementioned land and
he is not a member of the United States Armed Forces.
The Defendant denied or partially denied the averments pled in
Paragraphs 4, 7, 9 and 11 of Plaintiff's Complaint. Rule 1029 of
the Pennsylvania Rules of Civil Procedure governs the proper

Any payment tendered by the Defendonts sinet, the commencement
of their default on March 24, 1997 was not sufficient to fully

obligation to accept partial payments fOllowing a default in the
absence of an express contractual or statutory duty to the
cont rary, Pennsylvania Courts recognized over a century ago that
partial payment or incomplete tender will not cure or prevent a
defaUlt. The seminal case in Pennsylvania is l:.!Q1Jand v. SalnD~,
6A. 722, 5 Cent. 533, 4 Sadler 164 (1B86), wherein the Supreme
Court held a default upon a mortgage will not be prevented by a
partial payment of interest dUe. Accord, Mawhinney v. WestoG, 19
Dist. 982 (1910); Qrni.t;h v, Hootan, 3 Dist, 250 (1894). Moreover,
it is a generally recognized rule in other jurisdictions that
partinl or conditional tender of past due amounts does not prevent
the exercise of a mortgagee's option to accelerate, 55 Am,Jur. 2d
Mortgages !!l389 (1971, as SuPp. 1986), Therefore, in the absence of
a statutory right or contractual provision, a mortgagor cannot cure
a default or prevent the exercise of an cpt ion to accelerate with
a partial or conditional tender, ~
In the instant case, neither the Note nor the Mortgage
provides the Defendant with a contractual right to make partial
payments. Additionally, the Defendant does not have a statutory
right to submit partial payments or tender following a default.

1, That I alii a Foreclosure Specialist of GE Capital Mortgage
Services, Inc" which has a business address of 4680 Hallmark Parkway,
San Bernardino, Cal ifornia 92407, and that I have personal knOWledge of
the facts hereafter set forth.
2, That in my capacity as 11 Foreclosure SpecialiBt,
responsibility to review and am familiar with the files of
Mortgage Services, Inc. with respect to its mortgagors,
Steven Brymesser and Patty Brymesser.

3. That GE Capital Mortgage Services, Inc. is the owner and holder
of a Note dated April 24, 1996, executed by Steven Brymesser and Patty
Brymesser, in the original amount of $68,000,00,
4. That said Note is secured by a Mortgage executed by Steven
Brymesser and Pat ty Brymesser, and recorded in Cumberland County
Mortgage Book 1316, Page 303, in the Recorder of Deeds Office of
Cumberland County, Pennsylvania, New Jersey Mortgage and Investment
Corp. was the original Mortgagee. The Mortgage was assigned t.o GE
Capital Mortgage Services, Inc, and recorded on December 4, 1998 in
Book 596, Page 706, True and correct copies of the Mortgage and
Assignment are attached hereto.
5. 'l'hat the present owners of record of the property are Steven
Brymesser and Patty Brymesser, whose last known mailing address is 3166
Ritner Highway, Newville, Pennsylvania 17241.
6. That said Note is now in default, the due date of the last
installment being March 24, 1997.
7. That the outstanding balance, exclusive of attorney's fees and
costs, as of March 24, 1999 is as follows:

NEW MATTER
12, On or about Mayor June of 1997/ Defendant Steve
Brymesser contacted Plaintiff in order deti!rmine the exact amount
the said mortgage was in arrears,
13, Defendant Steven Brymesser. was informed by the gentleman
with whom he spoke that the Defendants were behind in their
mortgage payments in an amount totaling approximately $1/400,00,
14, Following this conversation, Defendant Steven Brymesser
sent Plaintiff a check for $1,100,00 as partial payment of the
approximately $1,400,00 allegedly due at that time,
15, A short time later, the $1,100,00 check was returned to
Defendant uncashed, accompanied by an explanation that because it
was not for the then full amount of approximately $1,400,00,
Plaintiff would not accept Defendant's proffered payment,
16, At the time the check was returned, the Defendants were
unable to make full payment in satisfaction of the debt then due
and owing, but they were able to pay the $1,100,00 as partial
payment of the outstanding debt.
17, Plaintiff had a obligation to accept Defendant's
$1,100.00 check as partial payment of Defendants obligation to
Plaintiff, in that the $1,100,00 was approximately 78,5% of the
total amount then claimed due and owing,
18, As a result of Plaintiff's refusal to accept the
$1,100,00 as partial payment of Defendants' debt due and owing
Plaintiff, Defendants were unable to acquire sufficient capital to
overcome their ever-increasing obligation to Plaintiff,

19, This ever increasing obligation, as caused by Plaintiff's
refusal to accf,!pt Defendants partial payment, has resulted in the
present foreclosure complaint being filed against the Defendants by
the Plaintiff,
20, Had Plaintiff accepted Defendants proffered payment in
partial satisfaction of the debt, Defendants would have been able
to make the remaining 21,5% of the total amount then due and owing
only a short time later,
21, Based upon the foregoing facts Plaintiff is estopped from
pursuing this action,
22, Based upon the foregoing facts, Plaintiff has waived
their right to claim the entire balance due and is obligated to
create a payment schedule to allow Defendants a reasonable
opportunity to pay the amounts past due,
WHEREFORE, the Defendant Steve Brymesser prays this Court to
enter judgment in favor of Defendants and against Plaintiff, In

Affidavit that it sent written notices to both Defendants by
letters dated July 16, 1957. True and correct copies of the Act 91
Notices and the enclosures are attached to the Affidavit,
lB. Upon Affidavit filed concurrently with this Motion, the
status of the mortgage payments made to and received by Plaintiff
is verified and reveals that both Defendants are in default under
the terms of the Mortgage and that no cure has been effected.
19, The Affidavit further indicates that Plaintiff is the
owner and holder of the Mortgage Note dated April 24, 1996 executed
by both Defendants in the amount of $6B, 000.00 for real estate
situated at 3166 Ritner Highway, Newville, Cumberland County,
Pennsylvania, of which the Defendant is one of the record owners,

mortgagors. I Dcfcndant has not filed an unswcr to the motion, submitted u brief in
opposition to it, or uppeured at oral urgument.
For the reasons stuted in this opiuion, Plaintiffs motion lor summury judgmcnt will
be granted.
STATEMENT OF FACTS
The record in this case consists of a complaint, an answer with new matter tiled by
Defendant Steven Brymcsser, a reply to new matter, Plaintitl"s motion for summary
judgment, and an allidavit ofa foreclosure specialist employed by PlaintilTin support of the
motion for summary judgmellt. Plaintiffs complaint, tiled December 8, 1997, was served
personally upon Defendant at the mortgaged premises on December 12, 1997.2

[n the present mortgage forcclosure case, where Dclcndant mortgagor (a) has been
unable to ull1rmatively deny the existence of the mortgage obligution, the assignment of the
mortgage, the default, the Ul110unt owing to Pluintln; or the muiling of the Act 91 notice, (b)
Plaintiff's motion for summary judgment against Defcndunt has been supported by a detuiled

all1davit as aforesaid, and (c) Defcndant has not l1led a rcsponse to PluintlfT's motion ruising
the defcnse of the existence of u genuine issue of material fuet which would preclude the
relief requested by Plaintiff; Plaintiff is entitled to summary judgment against Defcndant.
