COMI'LAINT
I, The Plaintlll'in this action is an adult Individual, residing at the above address.
2. The Defendants in this action are husband and wife and reside at the above address.
3. The Plaintill'ls the niece of the Defendants.
4, On or about July 4, 1996, the Plaintiff went over to the Defendant's residence at 28
East Gate Road, Camp Hill, PA 17111 to celebrate Independence Day.
5. Cindy was accompanied her mother, Loretta Sullivan and both women arrived at the
Defendants' residence at about 3:30 P.M,
6. The Defendants owned a German short haired pointed, Madchen, who was in the past
friendly to the Plaintil1' and the dog spent the evening with the Plaintiff and other
guests.
7. At about 900pm, as the Plaintiff bent over to pet the dog, it lunged, bit her about the
eye and face requiring 15 stitches and otherwise inflicting severe, disabling injury,
pain, suffering, disfigurement, loss of wages, and other damages.
8. While Madchen was acquainted with and friendly to the Plaintiff from previous visits
to the Defendant's house and until July 4, 1996, had never shown any viciousness to
the Plaintiff, the dog had attacked other individuals and injured them.
9. In fact, in the weeks preceding the incident, the dog had become so violent that the
Defendants had purchased a muzzle to prevent further attacks.
10. All of these facts became known to the Plaintiff only some days after the unprovoked

14. The Defendant~ herein had a duty to control at all times Madchen, pUl11cularly those with
a known, vicious propensity under:
a, the cOl11mon law as udopted by Pcnnsylvunia Courts. MUleI' v, lIurst 448 A2d
614/1982\. Crnnce v. Sohanl.~ A:td 1230 (1985).
b. The Dog Luw us contained In 3 P. S. *460-702 which rcads:
It shall be unlawful for the owner or keeper of any dog to fall to kcep
at all times such dog either (3) under the rcasonable control of some
person.. ..
c, The ordinances of Borough of Camp Hill and County of Cumberland.
15. The Defendants breached this duty by allowing a dog with a known, vicious propcnslty
demonstrated that very day:
a, failing to rest ruin the dog in a cage, with a muzzle, or on a leash.
b. permitting the dog to roam freely in the house and yard
c. permitting the dog to come into any contact with the PlaintitT and other guests
once they entcred their house.
d. encouraging physical contact with the dog by guests.
16, As a proximate, legal result of the damagcs, the Plaintiff sutTered injuries as described
elsewhere herein in the past, presently, and in the future.

18. Defendants demand that appropriatc hearings bc conducted in this case prior to
&IlY award of delay damages.
19. Rule 238 ofthc Pennsylvania Rules of Civil Procedure, on its face, and as applied
is violative of the Due Process and Equal Protection clauses of the Fourteenth Amendment to the
Constitution of the United States, ~ 1983 of Title 42 of the United States Code and Article I, ~ 1,
6, II and 26 and Article V, ~ 100c) of the Pennsylvania COI.stitution and imposes a chilling effect
on tbe excrcise by Defendants of their constitutional rights.
20. Ifit is determined that the Answering Defendants are liable on the Plaintilrs cause
of action, the Answering Defendants aver that the Plaintilr s recovery should be eliminated or

reduced in accordancc with the Pennsylvania Comparativc Ncgllgcn.:e Act, 42 Pa. C.S. ~ 7102
because.
(a) Startled II sleeping dog;
(b) was Intoxicated and flllled to appropriately approach the sleeping dog; and
(c) failed to wely and appropriately approach thc sleeping dog.
21. It is further averred that if thc Plaintiff suffered any injuries/damages as alleged,
they were caused solely and primarily by Plaintilrs own carelessness, recklessness and negligence
because thc Plaintiff:
(II) Startled a sleeping dog;
(b) was intoxicated and failed to appropriately approach the sleeping dog; and
(c) failed to safely and appropriately approach the sleeping dog.
22. It is further averred by the Answering Defendwlts that if the Plaintiff suffered any
injuries/damages as alleged, said Plaintift' by her conduct assumed risk of those injuries/damages
because:
(a) Startled a sleeping dog;
(b) was intoxicated and failed to appropriately approach the sleeping dog; and
(c) failed to safely and appropriately approach the sleeping dog.
23. The Defendants' dog did not have any known, vicious propensity and was
appropriatcly restrained and maintained at all times.
WHEREFORE, Defendants deny that Plaintiff is entitled to judgment against thc
Defendants in the amount specified, or to any sum of money whatsoever, or to interest or costs
