At the aforementioned time and place, it was daylight, the road surface was dry, and there were no adverse weather conditions. 6. At the aforementioned time and place, the Plaintiff, CIIERYL RUDY, was a passenger in a motor vehicle being operated by her husband, RICHARD RUDY, and travelling south on S.R. 11. 7. At the aforementioned time and place, the Defendant, SARAH ANN HALEY, was operating a 1989 Ford Taurus owned by JEAN GRABARITS and MICIIAEL GRABARITS, and approaching a stop sign at Shady Lane, which intersected with S.R. 11. 8. At the aforementioned time and place, the Defendant, SARAH ANN HALEY, failed to observe the Rudy vehicle travelling on S.R. 11, causing her to strike the right front passenger portion of the Rudy vehicle. 9. At the aforementioned time and place the Plaintiff, CIIERYL RUDY, was wearing her seat belt. COUNT I Q1lIRXL RUDY v. SAR.l\H ANH HALEY NEGLIGENCE 10. Paragraphs 1 through 9 of the Plaintiffs' Complaint are incorporated herein by reference and made a part thereof as if set forth in full. 11. The accident was caused solely by the negligence of the Defendant, SARAH ANll HALEY, and was in no way the fault of the Plaintiffs, CHERYL RUDY or RICIIARD RUDY. 12. The consisted of: A. B. C. D. E. F. G. H. I. J. K. L. M. negligence of the Defendant, SARAH ANN HALEY, Inattentiveness; Following too closely; Driving too fast for conditions; Operating her vehicle at an excessive rate of speed under the circumstances; Failing to have her vehicle under proper and adequate control; Failing to apply the brakes in time to avoid the collision: Negligently applying the brakes; Failing to observe the Plaintiffs' vehicle lawfully on the highway: Failing to operate her vehicle in accordance with existing traffic conditions and traffic controls; Failing to keep a reasonable lookout for other vehicles l.awfully on the road; Operating her vehicle as to create a dangerous situation for vehicles on the roadway; Failing to stop at a stop sign: and Operating a motor vehicle in violation of the Pennsylvania Motor Vehicle Code, Section 3323, which is negligence per se. 13. As a direct and proximate result of the accident, the Plaintiff, CHERYL RUDY. suffered serious and permanent injuries whioh include the followingl A. Neck pain: B. Back pain; C. Shoulder painl D. Headaches I and E. Herniated disc. 14. As a direct and proximate result of the accident, the Plaintiff, CHERYL RUDY, has incurred the following medical expenses to date: Polyclinic Hospital 2/28/96 - 5/21/96 $ 1,915.00 Leidy Chiropractic 10/10/96 - 6/30/97 $ 8,891.00 Holy spirit Hospital 1/25/96 $ 122.00 Keystone Spine Center 3/27/97 - 6/09/97 $ 763.00 East Pennsboro Ambulance 1/25/96 $ 275.00 Donald A. Bruaw, D.O. 9/08/76 - 3/15/96 $ 100.00 Herd Clinic 11/11/96 - 1/15/97 $ 3,031.00 Alternative Physical Therapy 2/08/97 - 3/24/97 $ 780.00 James R. Hamsher, M.D. 12/17/96 - 10/07/97 $ 356.69 TOTAL: $ 16,233.69 15. As a direct and proximate result of the injuries sustained in the aocident, the Plaintiff, CHERYL RUDY, may continue to incur medical expenses in the future. 16. A~ a direct and proximate result of the injuries sustained in the accident, the Plaintiff, CHERYL RUDY, sustained a wage loss and may continue to incur additional wage loss in the future. 17. As a direct and proximate result of the injuries sustained in the motor vehicle accident, the Plaintiff, CHERYL RUDY, has been advised and, therefore, avers, that the aforementioned injuries are permanent in nature and effect. 18. As a direct and proximate result of the injuries sustained in the motor vehicle accident, the Plaintiff, CHERYL RUDY, has undergone in the past, and wlll continue in the future, to undergo great pain and sutfering. 19. As a direct and proximate result of the injurie~ sustained in the motor vehicle accident, the Plaintiff, CHERYL RUDY, has been obliged to expend various sums of money and to incur various expenses for the injuries that she has suffered, and may continue to incur the same in the future. 20. As a direct and proximate result of the injuries sustained in the motor vehicle accident, the Plaintiff, CHERYL RUDY, has suffered a permanent diminution of her ability to enjoy life and life's pleasures. 21. As a direct and proximate result of the injuries sustained in the motor vehicle accident, the Plaintiff, CHERYL RUDY, has suffered a loss of earnings and impairment of her earning power and capacity. WHEREFORE, the Plaintiff, CHERYL RUDY, demands judgment of the Defendant, SARAH ANN t~LEY, in an amount in excess of Thirty- Five Thousand Dollars ($35,000.00) and in excess of the amount required in compulsory arbitration. COUNT II RICHARD RUDY v. SARAH ANN HALBY LOSS or CONSORT~ 22. Paragraphs 1 through 21 of the Plaintiffs' Complaint are incorporated herein by reference and made a part thereof as if set forth in full. 23. As a direct and proximate result of the Defendant, SARA ANN HALEY'S, negligence, the Plaintiff, RICHARD RUDY, has been forced to incur the loss of society, companionship, and services of his wife, CHERYL RUDY. 24. The Plaintiff, RICHARD RUDY, will continue to incur the same losses in the future. WHEREFORE, the Plaintiff, RICHARD RUDY, demands jUdgement of the Defendant, SARAH ANN HALEY, in the amount in excess of the amount requiring Compulsory Arbitration. COUNT III CHBRYL RUDY v. JsAN KARIS ORABARITS Mnd MICHABL GRABARITS NBGL~ BNTRUSTMBNT 25. Paragraphs 1 through 24 of the Plaintiffs' Complaint are incorporated herein by reference and made a part thereof as if set forth in full. 26. The negligence of the Defendants, JEAN MARIE GRABARITS and MICHAEL GRABARITS, consisted of the followingl A. Failing to accompany a novice driver in their own personal vehicle while the novice driver was operating the vehicle I B. Failing to take adequate precautions to ensure that the novice driver would operate their vehicle in a reasonable and prudent manner/ C. Failing to adequately yecure the driving record of the Defendant, SARAH ANN HALEY/ D. Allowing a novice driver to operate their vehicle in a negligent manner/ E. Failing to ensure that a novice driver was capable of operating their automobile under prevailing weather conditions which existed at the time of the aocident/ and F. Negligently entrusting their motor vehicle to a novice driver. 27. The accident was caused by the negligence of the Defendants, JEAN MARIE GRABARITS and MICHAEL GRABARITS, and was in no way caused by the Plaintiffs. 28. Plaintiff incorporates Paragraphs 13 through 21 of her Complaint relating to damages, by reference, as if set forth in full. MiEREFORE, the Plaintiff, CHERYL RUDY, demands judgment of the Defendants, JEAN MARIE GRABARITS and MICHAEL GRABARITS, in an amount in excess of Thirty-Five Thousand Dollars ($35,000.00) and in excess of the amount required in oompulsory arbitration. COUHT IV RICIlARD RUDY v, JEMI MARIE ORABARIT8 and MICIlAEL ORABARITQ LOSS or CONSORTIUH 29. Paragraphs 1 through 28 of the Plaintiffs' Complaint are incorporated herein by reference and made a part thereof as it set forth in full. 30. As a direot and proximate result of the Defendants, JEAN HARlE GRABARITS and MICHAEL GRABARITS', negligenoe, the Plaintiff, RICHARD RUDY, has been foroed to inour the loss of sooiety, oompanionship, and services of his wife, CHERYL RUDY. 31. The Plaintiff, RICHARD RUDY, will oontinue to inour the same lossos in the future. WHEREFORE, the Plaintiff, RICHARD RUDY, demands judgement of the Defendants, JEAN MARIE GRABARITS and MICHAEL GRABARITS, in the amount in exoess of the amount requiring compulsory Arbitration. The Plaintiffs' claims for medical expenses and/or wage loss are barred, cr should be reduced in accordance with S 1722 of the Pennsylvania Motor Vehicle Financial Responsibility Act. 33. The Plaintiffs' claims for non-pecuniary damages may be barred pursuant to the limited tort option of the Pennsylvania Motor Vehicle Financial Responsibility Act. 34. Tho Plaintiffs' claims may be barred by tho applicable statute of limitations. 35. The collision referred to in the Plaintiffs' Complaint was caused by the carelessness, recklessness and negligence of Plaintiff, Richard Rudy, in that he: a) operated his motor vehicle without his headlights lit at at time when it was prudent to do so; b) driving too fast for conditions; c) failure to be alert and attentive at the wheel; d) failure to apply hill brakes or take proper evasive measures to avoid the collision. 36. The claims of Plaintiff, Richard Rudy, are barred, or should be be reduced in accordance with the Pennsylvania Comparative Negligence Act. WHEREFORE, Defendants, .Jean Marie Grabarits, Michael Grabarits and Sarah Ann Haley, respectfully request Your Honorable Court to dismiss the Plaintiff's Complaint with prejudice. 8 .
