COMPLAINT
I. In this case, the Appellant (McNaughton Homes, Inc.) was found to have
entered into a contract with the Appellee(s) (SCOII and MaryBeth Mangol) to
purchase a home at 2 t 34 Englewood Court, Enola P A. This home was to be
completed on Of before November 17, 1995.
2. As a precondition of selllement, the Appellant agreed to repair or replace thc
driveway at the above noted address for scratch marks on the concrete.
3. The Appellee(s) reported additional damages on the driveway on December
15, 1995 to the Appellant. The damages noted were tenned "vertieal
displacements" by the Appellant.
4. The Appellant refused to honor the contract and repair both the original
damage or the "vertical displacement" damages until October 1996, when an
allempt to cover the "vertical displacements" resulted in further damage to the
driveway. .
5. Repeated requests were made to the Appellant to repair the original damage
and correct the subsequent damages, however no response Was given.
6. The lack of attention to the damages resulted in the filillg of c1l1im CV 19
0000432.97 in District Court 09.3.04 where judgement was entered for the
Plaintiff (Scott and Mary Beth Mangol) on November 25, 1997.
This document serves as notice to file a complaint towards the appeal by the Appellant in

DEFENDANT'S PRELIMINARY OBJECTIONS
Defendant McNaughton Homes, Inc. preliminary objects to the
complaint as filed by Plaintiffs in the above-captioned matter as
follows:
I. Preliminary Obiection in the Nature of--s
Demurrer
1, Plaintiffs' one-page complaint fails to state a cause of
action against the Defendant upon which relief can be granted.
WHEREFORE, Defendant respectfully requests that a d~murrer be
entered against the Plaintiffs and in fayor of the Defendant.
II. Preliminary Obiection in a Nature of a MotiQn
to Strike the Complaint
2. Pennsylvania Rules of Ciyil Procedure 1017, 1018,1018,1,
1019, 1020, 1021, 1022 and 1026 establish the necessary contents of
a pleading, the form of a complaint and requirements for notices
and service of such pleadings,
3. Plaintiffs' one-page document which one of the Plaintiffs
described as "serving to file a complaint" fails to comply with the
provisions of such Rules regarding the form and content of
pleadings in that the alleged complaint fails to set forth the
material facts on WhlCh the Plaintiffs' alleged cause of action is
based in concise and summary form; fails to state whether or not
the claim is based on a writing and to attach a copy thereof; fails
to set forth in paragraph form one material allegation in each
paragraph; and fails to contain a notice to plead or a notice to
defend.
4. Defendant is incapable of responding to the document
which Plaintiffs have filed as a complaint other than by a general
denial of any liability whatsoever.
WHEREFORE, Defendant respectfully requests that this Honorable
Court strike off Plaintiffs' complaint for the failure of the
pleading to conform to law or to rule of court.
III, Motion to Strike Off the Complaint
5. This matter was an appeal from a judgment rendered by a
district justice which is, therefore, to be heard de novo by this
Court.
6. Plaintiffs' alleged complaint makes specific references
to the decision of the district justice below, which said decision
is irrelevant and impertinent and not a proper or material fact
upon which a cause of action may be based.
WHEREFORE, Defendant respectfully requests that any
allegations or assertions regarding thfJ determination made by the
district justice from which this appeal has been taken be stricken.
