the Plaintiffs. A true and correct copy of the Construction Agreement Is attached hereto, Incorporated
herein by reference and marked as Exhibit "A."
5. Pursuant to the terms of the Construction Agreement, the price for the home was originally
$159,790.00.
6. The parties also executed a Construction Agreement Detail dated March 30, 1996 which
broke down and detailed the price of the home and added a site allowance for land Improvement In the
amount of $16,450.00. A true and correct copy of the Construction Agreement Detail Is attached hereto,
Incorporated herein by reference and marked as Exhibit "B."
7. Prior to signing the Construction Agreement attached hereto as Exhibit "A," Plaintiffs received
from the Defendant what was entltied "Kings Gap Standard Features" which provides the standard features
for homes constructed In the Kings Gap development. A true and correct copy of the Kings Gap Standard
Features Is attached hereto, Incorporated herein by reference and marked as Exhibit "C."
8. Under the heading "Site Improvements" on the Kings Gap Standard Features attached hereto
as Exhibit "C," there Is a listing for septic system.
9. At no time material hereto did the Defendant or any representatives or agents acting on
behalf of the Defendant nollfy or ,Inform the> Plaintiffs that there would be an additional charge for the
Installallon of a sand mound septic system.
10. On March 30, 1996, the parties eXllcuted a "Supplemental Agreement for Excavation, Well or
Other Work" which detailed how the site allowances were broken down and there is no men lion In that
document of a charge for the sand mound sepllc system. A true and correct copy of the Supplemental
Agreement Is attached hereto, Incorporated herein by reference and marked as Exhibit "D."
11. During the construction process, the Plaintiffs requested some changes 10 the basic design of
the home to reflect new features which the Plalntilrs wanted.
12. Each lime a request was made, the Defendant had the Plaintiffs sign a change order
reflecting thu work and the appropriate charges which were extras paid by the Plaint/ffs.

13. Change Order No.5 dated July 22,1996 renects a $500.00 charge entitled "Redesign: new
septic permit," which 'Nas for moving the sand mound septic system further back on the lot. A true and
correct copy of Change Order No.5 Is attached hereto, Incorporated herein by reference and marked as
Exhibit "E.'
14, Approximately two days prior to the nnal walk through when the Plaintiffs were to receive
their keys, Defendant forwarded a Change Order either via facsimile or through the mall renectlng a charge \
of $6,500.00 under the description "Install relocated sand mound' A true and correct copy of the Change
Order Is attached hereto, Incorporated herein by reference and marked as Exhibit "F,"
15, This Change Order was never requested by the Plaintiffs nor was It signed and agreed upon
by the Plaintiffs.
'16. When Plaintiffs contacted the Defendant concerning the Change Order they were advised by
Richard Roberts, President of the Defendant, that the sand mound septic system was not Included In the
price of the home and needed to be paid.
17. Plaintiffs never signed nor approved the Change Order as they were led to believe a septic
system was Included In the total price of the home.
18. At the time the Plaintiffs were provided keys to the home, Richard RobEUts provided them
with a nnanclal sheet outlining the amount the Plaintiffs had given as "good faith" money, $10,700.00, and
gave them a check for $3,500.00 after the $6,500.00 cost for the sand mound septic system was deducted.

19. Paragraphs 1 through 18 are Incorporated by reference as I' the same were more fully set
forth at length herein.
20. Shortly after moving Into the home, the Plaintiffs noticed that sections of the new carpeting
that was laid In the home had begun to separate in several areas, and there was tearing in the linoleum
flooring.
21. Despite several requests by the Plaintiffs to Mr. Roberts, nellher the carpeting nor the
linoleum flooring has been repaired.
22. it was the Plaintiffs understanding at the time they signed the Construction Agreement that
they were purchasing a home to be constructed consisting of quality carpeting which would not separate
and linoleum flooring which would not tear.
23. Defendant Is In breach of the Construction Agreement In that It has failed to provide the
Plaintiffs with carpeting which would not separate and linoleum flooring which would not tear shortly after
occupancy.
24. Defendant Is In breach of express and/or Implied warranties of merchantability and fitness for
a particular purpose, as a result of the separating carpet and torn linoleum flooring.
WHEREFORE, Plaintiffs, Robert T. Wekluk and Barbara B. Wekluk, demand judgMent against
Defendant, Roberts Homes, Inc., for the cost to repair the carpeting and linoleum flooring, plus costs and
interest, which amount is within the jurisdictional limit requiring compulSOry arbitration.

25. Paragraphs 1 through 24 are incorporated by reference as if the same were more fully set

26. The Defendant, through Its agents and representatives, made statements and/or
representations to the Plaintiffs such that they were led to believe that the $16,450.00 listed on the
Construction Agreement Detail as "Allowance Site" was to cover any item not inciuded In the basic price of
the house including the installation of a sand mound septic system.

5. Pursuant to the terms of the Construction Agreement, the price for the home was originally
$159,790.00.
6. The parties also executed a Construcllon Agreement Detail dated March 30, 1996 which
broke down and detailed the price of the home and added a site allowance for land Improvement In the
amount of $16,450.00. A true and correct copy of the Construction Agreement Detail Is attached hereto,
Incorporated herein by reference and marked as Exhibit "B."
7. Prior to signing the Construction Agreement attached hereto as Exhibit "A." Plaintiffs received
from the Defendant what was entitled "Kings Gap Standard Features" which provides the standard features
for homes constructed In the Kings Gap development. A true and correct copy of the Kings Gap Standard
Features is attached hereto, incorporated herein by reference and marked as Exhibit "C."
8. Under the heading "Site Improvements" on the Kings Gap Standard Features attached hereto
as Exhibit "C," there Is a listing for septic system.
9. At no time material hereio did the Defendant or any representatives or agents acting on
behalf of the Defendant notify or Inform the Plaintiffs that there would be an additional charge for the
Installation of a sand mound septic system.
10. On March 30, 1996, the parties executed a "Supplemental Agreement for Excavation, Well or
Other Work" which detailed how the site allowances were broken down and lhere is no mention In that
document of a charge for the sand mound septic system. A true and correct copy of the Supplemental
Agreement is attached hereto, incorporated herein by reference and marked as Exhibit "D."
'11. During the construction process. !he Plaintiffs requested some changes to the basic design of
the home to reflect new features which the Plaintiffs wanted.
12. Each time a request was made. the Defendant had the Plaintiffs sign a chango order
reflecting the work and the appropriate charges which were extras paid by the Plaintiffs.
20. Shcrtly after moving Into the home, the Plaintiffs noticed that sections of the new carpeting
that was laid In the home had begun to separate In several areas, and there was tearing In the linoleum
flooring.
21. Despite several requests by the Plaintiffs to Mr. Roberts, neither the carpeting nor the
linoleum flooring has been repaired,
22. It was the Plaintiffs understanding at the time they signed the Construcllon Agreement that
they were purchasing a home to be constructed consisting of quality carpeting which would not separate
and linoleum flooring which would not tear.
23. Defendant is In breach of the Construcllon Agreement In that it has failed to provide the
Plaintiffs with carpeting which would not separate and linoleum flooring which would not tear shortly after
occupancy.
24. Defendant Is In breach of express and/or Implied warranties of merchantability and fitness for
a particular purpose, as a result of the separating carpet and torn linoleum flooring.
WHEREFORE, Plaintiffs, Robert T. Wekluk and Barbara B. Wekluk, demand judgment against
Defendant, Roberts Homes, Inc., for the cost to repair the carpeting and linoleum flooring, plus costs and
Interest, which amount is within the jurisdiclionallimlt requiring compulsory arbitration.

It is further denicd that this is Ihe total price lor relocating and installing the sand mound scptic
system in a location further hack on Ihe lot was $500. The $500 charge on Change Order No.5
represents the cost of the perk and probe test, the engineer's design and the cost of obtaining a new
pen11il. On the date that Change Order No.5 wus signed by the parties, July 22, 1996, Defendant
did not know what the cost of the new sand mound septic system was going to be. Defcndanttold
Plaintiffs on numerous occasions that the range of cost for a sand mound system would be betwcen
$6,500 and $8,500, the typical range which Defcndant quotcs to customers as an estimate of the price
of a like sand mound scptic system.

32. The Defendant, Roherts lIomes, Inc., is in Ihe busincss of constructing ncw
rcsidcnlial homcs on a "scalier lot basis." Defcndant docs not construct solely for Kings Gap
Devclopmcnt or any other dcvelopmcnt.
33. On or about March of 1996, prior to the cxccution of tbc Construction Agrecmcnt
which is attached to the Complaint as "Exhibit A", Plaintiffs rcquestcd thatlhc sand mound septic
system be movcd from its position on the original propcrty dcsignto a position farther back from
thc house.
34. At that lime, Defcndant explained to Plaintiffs lhat in ordcr to relocate and install the
sand mound septic systcm thc following preliminary steps would have to be completcd:
(a) a pcrk and probe soiltcst for prcssurc distribution;
(h) a ncw cngineer's dcsign; and
(c) a ncw permit.
35. Atthc same time, Defcndanttold Plaintiffs that be could not quote a price for the
systcm until the steps explaincd in Paragraph 33 abovc had bccn complctcd and the system installed.
36. At thc samc time, Defendant quotcd a range ofpl'ice~ for such a sand mound septic
systcm of $6,500 to $8.500, which is the range customarily quotcd by Dcfcndant for such a system.
37. On or about July 22.1996, the Pcrk and Probe tcst was complctcd. A true and correct
copy of the Perk and Probe test is attached hereto as Exhibit "A".
38. On or about the same timc, thc new permit was sought from the Dickinson Township
Supervisors. A truc and correct copy ofthc Permil Application is allachcd hereto as Exhibit "n".

39. On or lIbout August 15, 1996, the Pennit for Instllllation of Sewage Disposal System
was issucd by the Dickinson Township Supervisors. A true and correct copy of the Pcrmit is
lIttachcd herclo as Exhibit "C".
40. On or about July 31, 1996, the relocated sand mound septic system was dcsigned by
Grant Marshall Engineers. .A true and correct copy of the engineering report is attachcd hcreto as
Exhibit "0".
41. On or about July 22, 1996, Dcfcndants sent to Plaintiffs, Change Order No.5, which
was attached to Plaintiffs' Complaint as Exhibit "E." The $500.00 listed on Change Order No.5
represented the cost for thc rcdc~ign of the scptic systcm, including the Pcrk and Probe test and the
cost of the Permit.
42. Changc Order No.5 does not reflect a cost for the installation of the sand mound
scptic system.
43. On July 22,1996, August 9, 1996, August 12, 1996, August 19, 1996, August 20,
1996, August 24, 1996, August 25, 1996, August 29, 1996 and August 30, 1996, J.C. Hollinger
Excavating sent equipment and labor to the Plaintiffs' pwperty for the installation of the sand mound
septic system. A true and correct copy of the invoice for J.e. Hollinger is attached hereto as Exhibit
~.E".
44. On or about August 5, 1996, August 19, 1996 and August 26, 1996, Defendant
purchased equipment from Hempt Bros. Inc. for the installation of the sand mound septic system on
the Plaintiffs' property. A true and correct copy of the Hempt Bros., Inc. receipts arc attached hereto
as Exhibit "1'''.

45. On or about August 21, 1996, Defendant purchased equipment from Monarch
Products, Inc. for the installation of the sand mound scptic system on Plaintiffs' property. A true

46. The total rcceipts for thc labor and materials for the sand mound scptic systcm
installation on Plaintiffs' propcrty totaled in excess of$13,500.00. ~ Exhibils "E," "F," and "0"

47. As a result of an administrative error, Plaintiffs were only charged $6,500 to install
the sand mound septic system on Plaintiffs' property, as reOected on Change Order No.7 attached
to Plaintiffs' Complaint as Exhibit uF;" the cost was actually greater than $6,500.00.
48. When Plainti ffs were presented with Change Order No.7 for the installation of the
relocated sand mound septic system that they requested, Plaintiffs refused to sign the document.
49. Defendant has repaired Plaintiffs' carpeting as requested by Plaintiffs, in satisfaction
of any and all implied warranties.
50. Defcndant has rep.lired Plaintiffs' linoleum as requested
by Plaintiffs, in satisfaction of any and all implicd warranties.
51. Defendant has satisfied all implied warranties of merchantability and fitness for all
purposes.
52. Defendant did not at any time relevant to Plaintiffs' Complaint. misreprcsent,
mislead or uet in an improper manner in its dealings with Plaintiffs, regarding the cost of relocating
and installing the suml mOllnd septic system.

Soeclfications for Blevated Sand Hound Construction
Continuation
11. No equipment may be permitted on the downslope side of the mound with
the exception of lightweight equipment that is used to form the
downslope berm. ~o the greatest extent possible, aggregate Bnd the
cover material shall be placed from the upslope side of the mound.
.12. Where a mound system wi th trenches is used, the area between the
individtlal trenches shall be filled with minlllral soil.
13. ~he area surrounding the mound shall be graded to provide for
diversion of surface runoff waters.

Distribution Network Placement
1. Atop the sand fill, a gravel bed of approximately ten inches in depth
containing a pressurized distribution network is to be placed to
distribute the effluent throughout the system.
2. ~he distribution system rests on six inches of gravel aggregate and is
covered to a depth of approximately two inches over the pipe.
Specifications for Buildinq Sewer
1. The building sewer pipe shall be at least 3 inch in diameter.
2. ~he grade of the building sewer shall be at least 1/8 inch per foot;
however, the grade of the 10 feet of building sewer immediately
preceding the treatment tank shall not exceed 1/4 in per foot.
3. Cleanouts shall be provided' at the junction of the building drain
and building sewer.
4. Cleanouts shall be provided at intervals of not more than 50 feet on
lines of 4-irlch diameter of less. In add.ition, cleanouts .hall be
provided at each change in direction of the sewer pipe.
5. Bends ahead of the treatment tank shall be limited to 45 degrees or
less where possible. If 90-degl'ee bends cannot be aw;>lded, they shall
be made with two 4S-degree bends.

1. Before and after installation, equipment and vehicles shall be.kept off
the proposed absorption area, including the downslope area, to prevent.
undue compaction of the soil. Care shall be exeroised during
oonstruotion to prevent undue oompaotion and damage to the system and
th~ downslope area.
2. Soil moisture levels during construction of the absorption area shall
be such that a sample of natural mineral soil taken from the level of
the proposed installation will crumble if compressed into a ball.
3. Vegetation shall be cut close to the ground throughout the area tQ be
utilized for the absorption area and berm. Bushes a.nd trees shall be
cut flush with the grQund surface; roots shall be.left in place. Cut
vegetation or organic litter shall be raked and removed from the
absorption and berm areas.
4. The proposed absorption area not obstructed by stumps or other
obstacles shall be roughed or plowed parallel with the contour to a
maximum depth of 6 inches, using a chisel plow or similar implement
attached to light-weight equipment. Rotary tllling shall be prohibited.
5. Under no circumstances may equipment travel on the plowed soil Burf~oe
until the Band is in place.
6. Immediately after plowing, Band shall be placed over the exposed plowed
surface. Sand shall be placed .from the upslope side of the bed using
only light weight equipment.
7. The slope ot the sand not directly beneath the aggregate ar.ea shall be
approximately 50'.
8. The top Qf the sand directly beneath the aggregate shall be level to a
tolerance at +/- 2 inches per 100 feet.
9. The mound shall be surrounded by a berm consisting at mineral tiloil
containing less than 20' coarse fragments with no coarse fragments
greater than 4 inches in diameter} more stable and lesD permeable than
the sand} and lightly compacted during construct.ion to contain and
protect the mound interior. The width of this berm shall be II minimum
of 3 feet at the top of the aggregate.
10. Upon completion, the outside slop~ of the berm may be no greater than
50\ and shall be seeded to assure the stability of the berm. The cover
OVer the aggregate shall be a minimum of 1 foot of soil suitable far
the growth of vegetation. Cover aggregate after building paper is
applied.

34. Admitted In Part. Denied In Part. It is admitted that the Defendant explained to the
Plaintiffs that the steps set forth In Paragraph 34 would have to be completed prior to relocating and
Installing the sand mound septic system. However, It Is denied that this explanation occurred prior to
execution of the construction agreement, as this conversation occurred after execution of the construction
agreement and while construction was undelWay.
35. Denied. Defendant never told Plaintiffs that he could not quote them a price for the sand
mound septic !lystem. Moreover, he did not explain the steps that were necessary for the relocation of the
septic system until after the execution of the construction agreement and after construction had begun. By
way of further answer, Defendant advised the Plaintiffs that the cost for the preliminary steps set forth In
Paragraph 34 wourd be $500.00.
36. Denied. Defendant never quoted a r<lnge of prices to the pralntlffs for a sand mound septic
system. The only price that was stated to the Plaintiffs was the $500.00 to cover the preliminary steps set
forth In Paragraph 34 of Defendant's New Matter. By way of further answer. II Defendant did quote a range
of prices of the septic syst"lm, that range of prices should have been reflected in the suppremental
